M\u00eb posht\u00eb po paraqesim nj\u00eb panoram\u00eb t\u00eb tarifave gjyq\u00ebsore duke i krahasuar me gjendjen ekonomike t\u00eb\u00a0 qytetar\u00ebve\u00a0 shqiptar\u00eb:<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li>Tarifa baz\u00eb \u00ebsht\u00eb 12.000 leke (p\u00ebrvec disa k\u00ebrkesave specifike ku varion nga 800 deri 9000 leke)<\/li>\n<li>Tarifa p\u00ebr shp\u00ebrblim d\u00ebmi \u00ebsht\u00eb 3% e vler\u00ebs s\u00eb \u00a0pretenduar n\u00eb objektin e padis\u00eb<\/li>\n<li>Sipas INSTAT 13.6% e shqiptareve jane te varfer ose tejet te varfer (mbi 400.000 persona).<\/li>\n<li>Paga mesatare \u00ebsht\u00eb afro 35.000 leke.<\/li>\n<li>Sipas INSTAT 13.3% jan\u00eb pun\u00ebk\u00ebrkues t\u00eb papun\u00eb (rreth 400.000 persona), pa p\u00ebrfshire ketu ata q\u00eb nuk jan\u00eb t\u00eb regjistruar si pun\u00ebkerkues, por q\u00eb jan\u00eb gjithsesi t\u00eb papun\u00eb<\/li>\n<li>Sipas INSTAT n\u00eb Shqiperi numerohen 390.000 pensioniste<\/li>\n<li>Sipas INSTAT n\u00eb Shqiperi numerohen 99.000 familje q\u00eb p\u00ebrfitojne ndihm\u00eb ekonomike<\/li>\n<li>Presionet nd\u00ebrkomb\u00ebtare p\u00ebr t\u00eb ndryshuar situaten jan\u00eb b\u00ebre nga Bashkimi Europian, Komisioneri p\u00ebr t\u00eb Drejtat e Njeriut pran\u00eb K\u00ebshillit t\u00eb Europ\u00ebs, Ambasadori USA. N\u00eb vendet e tjera ka mekanizma ligjore p\u00ebr t\u00eb p\u00ebrjashtuar nga pagesa e k\u00ebsaj tarife personat q\u00eb jan\u00eb n\u00eb pamundesi financiare.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>Kushtetuta parashikon n\u00eb nenin 155 q\u00eb edhe leht\u00ebsimi ose p\u00ebrjashtimi i kategorive t\u00eb caktuara t\u00eb paguesve b\u00ebhet me ligj, pra k\u00ebrkohet nd\u00ebrhyrje n\u00eb ligj dhe nuk mund t\u00eb zgjidhet me akte n\u00ebnligjore.<\/p>\n<p>N\u00eb komisionin e ligjeve \u00ebsht\u00eb d\u00ebrguar nj\u00eb projektligj me ndryshime q\u00eb do ti b\u00ebhen ligjit \u201cP\u00ebr ndihm\u00eb juridike\u201d duke parashikuar disa ndryshime n\u00eb lidhje me p\u00ebrjashtimin nga pagimi i tarifave gjyq\u00ebsore p\u00ebr \u00a0personat q\u00eb jan\u00eb n\u00eb pamund\u00ebsi fininaciare p\u00ebr ti paguar.<\/p>\n<p><b>2. Projektligji i paraqitur deri m\u00eb sot nuk e zgjidh situat\u00ebn p\u00ebr t\u00eb gjith\u00eb personat q\u00eb i drejtohen gjykat\u00ebs dhe jan\u00eb n\u00eb pamund\u00ebsi ekonomike p\u00ebr ti paguar tarifat gjyq\u00ebsore:<\/b><\/p>\n<p><b>\u00a0<\/b><\/p>\n<ul>\n<li>Nuk parashikohet p\u00ebrjashtimi nga detyrimi i t\u00eb gjith\u00eb personat \u00a0q\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb p\u00ebrpjes\u00ebtuar nuk jan\u00eb t\u00eb aft\u00eb t\u00eb paguajn\u00eb tarifat gjyq\u00ebsore. K\u00ebtu futen edhe ata individ\u00eb q\u00eb jan\u00eb t\u00eb pun\u00ebsuar, por tarifa gjyq\u00ebsore \u00a0p\u00ebr c\u00ebshtjen e tyre mund t\u00eb llogaritet shum\u00eb e lart\u00eb n\u00eb raport me t\u00eb ardhurat (shembull: tarifa \u00ebsht\u00eb 1 milion lek\u00eb, nd\u00ebrkoh\u00eb paga \u00ebsht\u00eb 30 mij\u00eb lek\u00eb n\u00eb muaj)<\/li>\n<li>Nuk parashikohen t\u00eb gjitha kategorit\u00eb e personave, por vet\u00ebm ata q\u00eb trajtohen me ndihm\u00eb ekonomike, viktimat e dhun\u00ebs n\u00eb familje dhe viktimat e trafikimit. K\u00ebtu bie n\u00eb sy fakti q\u00eb nuk p\u00ebrjashtohen si kategori ata q\u00eb k\u00ebrkojn\u00eb zhd\u00ebmtimin n\u00eb rastin e veprimit ose mosveprimit t\u00eb paligjsh\u00ebm t\u00eb organeve shtet\u00ebrore, sipas nenit 44 t\u00eb Kushtetut\u00ebs (shembull: G\u00ebrdeci, 21 janari etj)<\/li>\n<li>Krijohet konfuzion mes kompetencave p\u00ebr p\u00ebrjashtin nga tarifat gjyq\u00ebsore. Kodi i Procedur\u00ebs Civile ia jep k\u00ebt\u00eb kompetenc\u00eb gjyqtarit (neni 158\/a), nd\u00ebrsa me draftin e propozuar kompetenca i jepet Komisionerit p\u00ebr Ndihm\u00eb Ligjore<\/li>\n<li>Nj\u00eb tjet\u00ebr problem \u00ebsht\u00eb rasti kur personat aplikojn\u00eb te Komisioni dhe ky institucion vendos refuzimin ose mospranimin e p\u00ebrjashtimit nga taksa. Sipas projektligjit aplikanti ka t\u00eb drejt\u00eb ti drejtohet gjykat\u00ebs dhe gjykata merr vendimin e p\u00ebrjashtimit nga taksa. Problemi q\u00eb konstatohet \u00ebsht\u00eb se n\u00eb situat\u00ebn q\u00eb ndodhen gjykatat shiptare, sa probabilitet ka q\u00eb gjykata t\u00eb marr\u00eb nj\u00eb vendim p\u00ebrjashtimi kur Komisioni ka vendour mos-p\u00ebrjashtimin, sidomos n\u00eb rastet kur t\u00eb paditur jan\u00eb organet shtet\u00ebrore (rasti i G\u00ebrdecit, 21 janarit)?<\/li>\n<\/ul>\n<p><b>\u00a0<\/b><b>3. N\u00eb pikpamjen \u00a0projektligji duhet t\u00eb parashikoj\u00eb nd\u00ebrhyrje n\u00eb k\u00ebto raste:<\/b><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li>T\u00eb parashikohen disa kategori n\u00eb baz\u00eb t\u00eb c\u00ebshtjeve q\u00eb ata k\u00ebrkojn\u00eb t\u00eb adresojn\u00eb n\u00eb gjykat\u00eb, si viktimat e dhun\u00ebs n\u00eb familje, viktimat e veprimeve t\u00eb paligjshme t\u00eb organeve shtet\u00ebrore, personat q\u00eb k\u00ebrkojn\u00eb informacione mbi dokumentat zyrtare, personat qe kerkojne demshp\u00ebrblim p\u00ebr konfliktet e pun\u00ebs. Keto\u00a0 kategori mendojm\u00eb q\u00eb duhet\u00a0 t\u00eb p\u00ebrjashtohen pavarsisht gjendjes s\u00eb tyre ekonomike.<\/li>\n<li>T\u00eb parashikohen disa kategori n\u00eb baz\u00eb t\u00eb gjendjes s\u00eb tyre ekonomike, duke pasur parasysh jo vet\u00ebm varf\u00ebrin\u00eb ekstreme, por cdo rast kur pagesa e taks\u00ebs apo tarif\u00ebs gjyq\u00ebsore nuk \u00ebsht\u00eb n\u00eb p\u00ebrpjestim t\u00eb drejt\u00eb me gjendjen ekonomike t\u00eb k\u00ebrkuesit (shembull: tarifa \u00ebsht\u00eb 1 milion lek\u00eb, nd\u00ebrkoh\u00eb paga \u00ebsht\u00eb 30 mij\u00eb lek\u00eb n\u00eb muaj)<\/li>\n<li>T\u00eb parashikohen kriteret e sakta n\u00eb baz\u00eb t\u00eb t\u00eb cilave do t\u00eb vendoset p\u00ebrjashtimi nga tarifat gjyq\u00ebsore dhe jo t\u00eb lihet n\u00eb diskrecion t\u00eb Komisionit , i cili vendos rast pas rasti (sipas projktligjit) sepse\u00a0 kjo krijon nj\u00eb situat\u00eb subjektiviteti dhe anshm\u00ebrie (sidomos kur t\u00eb paditur jan\u00eb organet shtet\u00ebrore)<\/li>\n<li>Pavar\u00ebsisht nd\u00ebrhyrjeve me k\u00ebt\u00eb projektligj, q\u00eb do t\u00eb mund\u00ebsonin \u00a0nj\u00eb situat\u00eb ligjore t\u00eb qart\u00eb p\u00ebr p\u00ebrjashtimin nga tarifat gjyq\u00ebsore, duhet gjithashtu t\u00eb nd\u00ebhyhet me nj\u00eb amendament n\u00eb ligjin p\u00ebr taksat, dhe jo jo vet\u00ebm n\u00eb ligjin p\u00ebr ndihm\u00ebn
