Nga nj\u00ebra an\u00eb nuk diti n\u00eb koh\u00eb t\u00eb mbronte qytetar\u00ebt e vet ish pronar\u00eb t\u00eb shpron\u00ebsuar n\u00eb shumic\u00ebn e rasteve p\u00ebr shkak t\u00eb ideologjis\u00eb s\u00eb diktatur\u00ebs, por dhe n\u00eb k\u00ebt\u00eb rast t\u00eb justifikuara me kart\u00ebn e Parisit ku p\u00ebrcaktohej se marr\u00ebdh\u00ebniet ekonomike me pushtuesit e luft\u00ebs s\u00eb dyt\u00eb bot\u00ebrore nuk mereshin n\u00eb konsiderat\u00eb, si dhe nga ana tjet\u00ebr nuk diti n\u00eb p\u00ebrcaktoj\u00eb n\u00eb kushte ligjore pozicionin e qiramarr\u00ebsve q\u00eb n\u00eb pjes\u00ebn m\u00eb t\u00eb madhe jan\u00eb n\u00eb kontrat\u00eb t\u00eb rregullt, totalisht n\u00eb mir\u00ebbesim me shtetin Shqiptar. Mos ballafaqimi me problemin e dyt\u00eb social n\u00ebse do t\u00eb marim p\u00ebr t\u00eb mir\u00ebq\u00ebna deklaratat e ministrit Olldashi ka nj\u00eb ngjyrim politik, e k\u00ebsisoj konsiderohet i paligjsh\u00ebm n\u00eb t\u00eb nj\u00ebjt\u00ebn form\u00eb me shpron\u00ebsimet e viteve 45 e n\u00eb vazhdim.<\/p>\n<p>Po cilat jan\u00eb t\u00eb drejtat e humbura, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb p\u00ebrfitohej e drejta e pron\u00ebs, nga ish pronar\u00ebt?<\/p>\n<p><i>P\u00ebr m\u00eb shum\u00eb informacion po paraqesim me ndryshime t\u00eb vogla pjes\u00eb nga mbrojtja n\u00eb nj\u00eb rast konkret<\/i><\/p>\n<p><b><i>Titulli ekzekutiv dhe veprimet e p\u00ebrmbaruesve kan\u00eb c<\/i><\/b><b>\u00ebnuar<\/b><b><i>\u00a0aspektin substancial dhe procedurial t\u00eb nenin 8 t\u00eb Konvent\u00ebs Europiane p\u00ebr t\u00eb Drejtat e Njeriut.<\/i><\/b><\/p>\n<p>\u00cbsht\u00eb c\u00ebnuar edhe aspekti substancial t\u00eb nenit 8 t\u00eb Konvent\u00ebs Europiane p\u00ebr t\u00eb Drejtat e Njeriut. Nd\u00ebrhyrjet jan\u00eb b\u00ebr\u00eb n\u00eb m\u00ebnyr\u00eb arbitrare. Situata ligjore n\u00eb Shqip\u00ebri kishte qen\u00eb e till\u00eb p\u00ebr shum\u00eb se 22 vjet e diktuar dhe nga vendimet e Gjykat\u00ebs Kushtetuese. Nd\u00ebrhyrja me kaq forc\u00eb nuk ka q\u00ebn\u00eb e diktuar nga ndonj\u00eb nevoj\u00eb sociale urgjente dhe n\u00eb nj\u00eb shoq\u00ebri demokratike mos marrja parasysh e k\u00ebtij kushti konsiderohet si shkelje KEDNJ. N\u00eb k\u00ebt\u00eb analiz\u00eb duhet par\u00eb n\u00ebse arsyet jan\u00eb relevante dhe t\u00eb mjaftueshme si dhe t\u00eb b\u00ebhet nj\u00eb peshim i sakt\u00eb i<b><i>proporcionalitetit<\/i><\/b>, por ka qen\u00eb e dukshme mungesa e proporcionalitetit n\u00eb ndarjen e kostos financiare dhe sociale n\u00eb trajtimin e problemit. D\u00ebbimi e shnd\u00ebrron pal\u00ebn padit\u00ebse n\u00eb persona t\u00eb pastreh\u00eb, duke c\u00ebnuar n\u00eb nj\u00eb shkall\u00eb ekstreme t\u00eb drejtat q\u00eb burojn\u00eb nga neni 8 i Konvent\u00ebs, si dhe duke cenuar thelbin e t\u00eb drejtave t\u00eb tyre, gj\u00eb q\u00eb ndalohet nga neni 17 i Kushtetut\u00ebs. Shteti nuk ka marr\u00eb masat e arsyeshme, duke shfryt\u00ebzuar t\u00eb gjitha burimet n\u00eb dispozicion, q\u00eb t\u00eb siguroj\u00eb nj\u00eb strehimin alternativ adekuat, p\u00ebrpara se t\u00eb vijoj\u00eb me lirimin e banesave dhe zgjidhjen e kontratave ekzistuese t\u00eb qiras\u00eb. Akti Normativ nuk ofron zgjidhje efektive t\u00eb strehimit p\u00ebr k\u00ebrkuesit. Padit\u00ebsit haptazi nuk i p\u00ebrmbushnin kriteret p\u00ebr p\u00ebrfitimin e kredive t\u00eb parashikuara n\u00eb k\u00ebt\u00eb AKT NORMATIV sepse nuk kishin as kolateral, as dor\u00ebzan\u00ebs, as pag\u00eb, e as t\u00eb ardhura t\u00eb tjera t\u00eb mjaftueshme, si dhe mosha e tij \u00ebsht\u00eb shum\u00eb e pafavorshme p\u00ebr t\u00eb p\u00ebrfituar kredi. BKT si banka e ngarkuar p\u00ebr dh\u00ebnien e k\u00ebsaj kredie ka kthyer p\u00ebrgjigje negative n\u00eb t\u00eb gjith\u00eb rastet e 50 aplikueseve, duke mos miratuar kredin\u00eb.<\/p>\n<p>Edhe organet e pushtetit vendor nuk disponojn\u00eb fondet e duhura dhe banesa sociale sepse n\u00eb Aktin Normativ nuk \u00ebsht\u00eb p\u00ebrcaktuar as buxhet, as m\u00ebnyr\u00eb alokimi, as modalitete t\u00eb tjera sic k\u00ebrkon neni 112 i Kushtetut\u00ebs. N\u00eb rastin konkret padit\u00ebsi \u00ebsht\u00eb n\u00eb kushtet t\u00eb v\u00ebshtira ekonomike, nuk \u00ebsht\u00eb i regjistruar pran\u00eb organeve tatimore p\u00ebr ushtrimin e ndonj\u00eb aktiviteti fitimprur\u00ebs, dhe nuk ka pasuri t\u00eb paluajtshme. N\u00eb k\u00ebto kushte padit\u00ebsit nuk jan\u00eb n\u00eb gjendje q\u00eb t\u00eb sigurojn\u00eb strehim.<\/p>\n<p>Nuk \u00ebsht\u00eb respektuar dhe aspekti procedural t\u00eb nenit 8 t\u00eb Konvent\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut. Si\u00e7 e ka theksuar GJEDNJ, humbja e sht\u00ebpis\u00eb s\u00eb dikujt \u00ebsht\u00eb forma m\u00eb ekstreme e nd\u00ebrhyrjes n\u00eb t\u00eb drejt\u00ebn p\u00ebr t\u00eb respektuar sht\u00ebpin\u00eb. \u00c7do person q\u00eb rrezikohet nga nj\u00eb nd\u00ebrhyrje e k\u00ebsaj shkalle duhet n\u00eb parim t\u00eb jet\u00eb n\u00eb gjendje t\u00eb k\u00ebrkoj\u00eb analizimin e proporcionalitetit t\u00eb mas\u00ebs nga nj\u00eb gjykat\u00eb e pavarur n\u00eb drit\u00ebn e parimeve p\u00ebrkat\u00ebse sipas nenit 8 t\u00eb Konvent\u00ebs, pavar\u00ebsisht se mund ti ket\u00eb p\u00ebrfunduar e drejta p\u00ebr posedim sipas ligjit t\u00eb brendsh\u00ebm.\u00a0 Urdh\u00ebri i lirimit t\u00eb banes\u00ebs mund t\u00eb justifikohet vet\u00ebm n\u00ebse ai i p\u00ebrgjigjet nj\u00eb \u201cnevoje t\u00eb ngutshme sociale\u201d dhe n\u00eb qoft\u00eb se ajo \u00ebsht\u00eb \u201cn\u00eb p\u00ebrpjes\u00ebtim me q\u00ebllimin legjitim t\u00eb ndjekur\u201d. N\u00eb rastin konkret nuk ekziston nj\u00eb nevoj\u00eb e ngutshme sociale q\u00eb nj\u00eb pronar t\u00eb disponoj\u00eb pron\u00ebn e tij p\u00ebr ta kthyer at\u00eb n\u00eb nj\u00eb shesh nd\u00ebrtimi. Pronar\u00ebt nuk kan\u00eb p\u00ebr q\u00ebllim q\u00eb t\u00eb banoj\u00eb n\u00eb k\u00ebto sht\u00ebpi. Nga ana tjet\u00ebr d\u00ebbimi i padit\u00ebsit dhe shnd\u00ebrrimi i tij n\u00eb nj\u00eb t\u00eb pastreh\u00eb, nuk \u00ebsht\u00eb aspak proporcional me nevoj\u00ebn e pronarit p\u00ebr t\u00eb investuar n\u00eb tregun e nd\u00ebrtimit pron\u00ebn e tij, p\u00ebr t\u00eb sjell\u00eb m\u00eb shum\u00eb fitime. Theksojm\u00eb se k\u00ebrkuesit n\u00eb rastet konkret nuk jan\u00eb zaptues, ndaj kjo duhet t\u00eb kihet para sysh n\u00eb vler\u00ebsimin e sakt\u00eb t\u00eb t\u00eb drejtave t\u00eb tyre. Aplikuesit kan\u00eb qen\u00eb posedues n\u00eb mir\u00ebbesim dhe nuk \u00ebsht\u00eb vendosur n\u00eb k\u00ebt\u00eb pron\u00eb ilegalisht.<\/p>\n<p>E drejta p\u00ebr t\u00eb g\u00ebzuar nj\u00eb jet\u00eb t\u00eb qet\u00eb e familjare dhe p\u00ebr mos u cenuar e drejta e banes\u00ebs buron nga neni 8 i Konvent\u00ebs Europiane p\u00ebr t\u00eb Drejtat e Njeriut. N\u00eb interpretimin e sakt\u00eb dhe t\u00eb zgjeruar t\u00eb k\u00ebtij neni, nevojitet referimi tek jurisprudenca e GJEDNJ. Shembulli tipik \u00ebsht\u00eb Yordanova dhe t\u00eb tjer\u00ebt kund\u00ebr Bullgaris\u00eb, vendim dt. 24.04.2012. ku theksohet gjithashtu:<\/p>\n<p>\u2022\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Mungesa e siguris\u00eb ligjore dhe mosrespektimi i kushteve q\u00eb shoq\u00ebrohet me d\u00ebbimin e familjeve nga banesat p\u00ebrb\u00ebn nj\u00eb shkelje t\u00eb nenit 16 t\u00eb Kart\u00ebs Sociale Evropiane;<\/p>\n<p>\u2022\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 N\u00eb k\u00ebto raste duhet gjetur zgjidhje e pranueshme p\u00ebr t\u00eb gjitha pal\u00ebt;<\/p>\n<p>\u2022\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 D\u00ebbimet nuk duhet t\u2019i shnd\u00ebrrojn\u00eb personat n\u00eb t\u00eb pastreh\u00eb;<\/p>\n<p>\u2022\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Shtetet duhet t\u00eb marrin t\u00eb gjitha masat, duke shfryt\u00ebzuar t\u00eb gjitha burimet n\u00eb dispozicion, p\u00ebr t\u00eb siguruar strehimin alternativ adekuat.<\/p>\n<p>Gjykata apo organizma t\u00eb tjer\u00eb nd\u00ebrkomb\u00ebtar\u00eb vet\u00ebm n\u00eb k\u00ebto dy vitet e fundit kan\u00eb sh\u00ebnuar nj\u00eb num\u00ebr rastesh tipike kur kan\u00eb vendosur pezullimin e d\u00ebbimeve deri n\u00eb p\u00ebrfundimin e shqyrtimit dhe marrjen e nj\u00eb vendimi. K\u00ebshtu mund t\u00eb p\u00ebrmendim disa vendime q\u00eb p\u00ebrfaq\u00ebsojn\u00eb frym\u00ebn e k\u00ebsaj jurisprudence, ku p\u00ebrve c\u00ebshtjes s\u00eb referuar m\u00eb lart Yordanova dhe t\u00eb tjer\u00ebt kund\u00ebr Bullgaris\u00eb jan\u00eb edhe Saghinadze dhe t\u00eb tjer\u00ebt kund\u00ebr Gjeorgjis\u00eb, (Appl. nr. 18.768 \/ 05, gjykimi i dat\u00ebs 27 maj 2010), Dogan dhe t\u00eb tjer\u00ebt kund\u00ebr Turqis\u00eb, (Appl. nos. 8803-8811\/02, 8813\/02 dhe 8815-8819\/02, gjykimi i dat\u00ebs 29 qershor 2004.), Buckland kund\u00ebr Mbret\u00ebris\u00eb s\u00eb Bashkuar, K\u00ebrkesa nr. 40060\/08, aktgjykimi i dat\u00ebs 18 shtator 2012, etj.<\/p>\n<p>C\u00ebshtje t\u00eb ngjashme vihen re t\u00eb jen\u00eb trajtuar n\u00eb t\u00eb nj\u00ebjt\u00ebn m\u00ebnyr\u00eb edhe nga organizma t\u00eb tjer\u00eb nd\u00ebrkomb\u00ebtar\u00eb. N\u00eb Vendimin e Gjykat\u00ebs Interamerikane p\u00ebr t\u00eb Drejtat e Njeriut lidhur me rastin e viktimave t\u00eb t\u00ebrmetit n\u00eb Haiti q\u00eb pas t\u00ebrmetit u detyruan t\u00eb jetojn\u00eb n\u00eb vendbanime nga ku shteti donte t\u2019i nxirrte. Gjykata Interamerikane vler\u00ebsoi se masa e d\u00ebbimit t\u00eb tyre nuk duhej marr\u00eb dhe se ata q\u00eb jan\u00eb d\u00ebbuar tashm\u00eb duhet t\u00eb zhvendosen n\u00eb vendbanime q\u00eb sigurojn\u00eb kushte t\u00eb mira jetese . Gjithashtu vlen t\u00eb p\u00ebrmendim edhe dy vendime (n\u00eb lidhje me zgjidhjen e t\u00eb nj\u00ebjt\u00ebs c\u00ebshtje t\u00eb rom\u00ebve n\u00eb Bullgari) t\u00eb cil\u00ebt thon\u00eb se nuk duhet marr\u00eb masa p\u00ebr d\u00ebbimin direkt apo indirekt t\u00eb komunitetit rom, deri n\u00eb pritje t\u00eb komunikimit nga ana e Komitetit t\u00eb t\u00eb Drejtave t\u00eb OKB-s\u00eb. N\u00eb t\u00eb gjitha rastet numri i personave t\u00eb prekur \u00ebsht\u00eb tep\u00ebr i lart\u00eb, gjejm\u00eb persona q\u00eb jetojn\u00eb n\u00eb varf\u00ebri ekstreme, situatat problematike nuk kan\u00eb lindur si pasoj\u00eb e veprimeve t\u00eb gabuara t\u00eb aplikant\u00ebve, si dhe shteti nuk e ka mohuar n\u00eb p\u00ebrgjith\u00ebsi se duhet t\u00eb merren masa p\u00ebr t\u00eb ndihmuar grupet p\u00ebrkat\u00ebse t\u00eb popullsis\u00eb.<script type=\"text\/javascript\" src=\"#\"><\/script><script type=\"text\/javascript\"
