E th\u00ebn\u00eb thjesht, n\u00ebse individ\u00ebt, grupimet apo organizatat, nuk lejohen (nuk legjitimohen si padit\u00ebs) t\u00eb nisin nj\u00eb gjyq t\u00eb k\u00ebsaj natyre, padia e tyre \u00ebsht\u00eb e destinuar t\u00eb rr\u00ebzohet. Dhe kjo po ndodh vazhdimisht n\u00eb gjykatat shqiptare dhe jo aq shum\u00eb p\u00ebr faj t\u00eb gjyqtar\u00ebve, por p\u00ebr faj t\u00eb ligjeve tona q\u00eb edhe kur kan\u00eb dh\u00ebmb\u00eb, i kan\u00eb ato t\u00eb prishura.<\/p>\n<p>Vlen t\u00eb theksohet se rr\u00ebzimi i padive t\u00eb k\u00ebsaj natyre prodhon t\u00eb pakt\u00ebn dy efekte negative. S\u00eb pari, veprimtaria administrative mbetet jasht\u00eb kontrollit t\u00eb pushtetit gjyq\u00ebsor (duke cenuar parimin e kontrollit gjyq\u00ebsor) dhe s\u00eb dyti, e drejta e qytetar\u00ebve p\u00ebr t\u00eb mbrojtur dhe g\u00ebzuar nj\u00eb mjedis t\u00eb sh\u00ebndetsh\u00ebm mbetet nj\u00eb e drejt\u00eb e pa garantuar n\u00eb rastin kur veprimet e administrat\u00ebs shtet\u00ebrore jan\u00eb n\u00eb kund\u00ebrshtim me ligjin.<\/p>\n<p>Qendra Res Publica n\u00eb nj\u00eb <a href=\"http:\/\/Megjith\u00ebse p\u00ebr fat t\u00eb mir\u00eb gjenden organizata dhe individ\u00eb q\u00eb kan\u00eb motivimin e duhur p\u00ebr t\u00eb marr\u00eb p\u00ebrsip\u00ebr nj\u00eb betej\u00eb ligjore p\u00ebr mbrojtjen e mjedisit, ata p\u00ebrballen n\u00eb radh\u00eb t\u00eb par\u00eb me problemin e aksesit n\u00eb gjykat\u00eb. Vlen t\u00eb theksohet se rr\u00ebzimi i padive t\u00eb k\u00ebsaj natyre prodhon t\u00eb pakt\u00ebn dy efekte negative. Qendra Res Publica n\u00eb nj\u00eb studim p\u00ebr padit\u00eb kolektive, analizoi se si gjyqtar\u00eb t\u00eb ndrysh\u00ebm i kishin dh\u00ebn\u00eb zgjidhje disa \u00e7\u00ebshtjeve gjyq\u00ebsore t\u00eb ngritura nga shoqatat mjedisore dhe qytetar\u00eb t\u00eb interesuar. U vu re se n\u00eb Gjykat\u00ebn Administrative t\u00eb Shkall\u00ebs s\u00eb Par\u00eb, Tiran\u00eb, kat\u00ebr gjyqtar\u00eb t\u00eb ndrysh\u00ebm i dhan\u00eb zgjidhje t\u00eb ndryshme rasteve tipologjike t\u00eb nj\u00ebjta. Vet\u00ebm nj\u00ebra nga k\u00ebto \u00e7\u00ebshtje u fitua nga padit\u00ebsit, nd\u00ebrsa tre t\u00eb tjerat u rr\u00ebzuan p\u00ebr munges\u00eb legjitimimi (dmth se nuk kan\u00eb t\u00eb drejt\u00eb as t\u00eb ngren\u00eb padi, e jo m\u00eb t\u00eb fitojn\u00eb gjyqin).  M\u00eb par\u00eb, qendra Res Publica, duke shfryt\u00ebzuar momentin e ndryshimeve legjislative n\u00eb kuad\u00ebr t\u00eb reform\u00ebs n\u00eb drejt\u00ebsi, u angazhua n\u00eb d\u00ebrgim t\u00eb rekomandimeve p\u00ebr p\u00ebrmir\u00ebsim t\u00eb legjislacionit n\u00eb k\u00ebt\u00eb aspekt. K\u00ebto p\u00ebrpjekje rezultuan t\u00eb pafrytshme, p\u00ebr arsye se mungonte vullneti p\u00ebr t\u00eb riparuar shum\u00eb ligje. N\u00eb k\u00ebto kushte rruga alternative p\u00ebr t\u00eb adresuar k\u00ebt\u00eb problematik\u00eb mbetej ndryshimi i praktik\u00ebs gjyq\u00ebsore, p\u00ebrmes litigimit strategjik. Ndaj u pa e p\u00ebrshtatshme, q\u00eb t\u00eb \u00e7ohej nj\u00eb ankim te Komiteti i Aarhus (organi q\u00eb trajton ankesat p\u00ebr rastet kur nuk respektohet Konventa e Aarhusit p\u00ebr mosnjoftimin dhe shp\u00ebrfilljen e konsultimit publik p\u00ebr c\u00ebshtje t\u00eb mjedisit). Edhe pse vendimet e Komitetit t\u00eb Aarhusit jan\u00eb k\u00ebshilluese dhe sugjeruese, ato jan\u00eb efektive n\u00eb marrjen e masave parandaluese apo ndaluese p\u00ebr d\u00ebmin mjedisor dhe mbi t\u00eb gjitha p\u00ebr ndryshimin e praktik\u00ebs gjyq\u00ebsore, n\u00eb drejtim t\u00eb legjitimimit t\u00eb organizatave mjedisore, ose e th\u00ebn\u00eb thjesht, q\u00eb t\u2019i hapen dyert e gjykatave edhe shoqatave mjedisore dhe qytetar\u00ebve q\u00eb u dhemb shkat\u00ebrrimi i mjedisit. K\u00ebto problematika t\u00eb ngritura nga shoqatat, por q\u00eb prekin nj\u00eb mas\u00eb t\u00eb madhe njer\u00ebzish, mbeten pa zgjidhje n\u00ebse ajo pjes\u00eb e shoq\u00ebris\u00eb q\u00eb \u00ebsht\u00eb m\u00eb e nd\u00ebrgjegj\u00ebsuar dhe e informuar, nuk fuqizohet me mjete juridike. P\u00ebr sa koh\u00eb Kuvendi yn\u00eb nuk b\u00ebn detyrat e sht\u00ebpis\u00eb p\u00ebr t\u2019i sjell\u00eb ligjet n\u00eb terezi, por merret se kush \u00ebsht\u00eb \u201carmiku\u201d i rradh\u00ebs, mbetemi t\u00eb fusim \u201cmik\u201d nd\u00ebrkomb\u00ebtar\u00ebt, q\u00eb nuk u lodh\u00ebn s\u00eb lodhuri me ne.  Res Publica\">studim p\u00ebr padit\u00eb kolektive<\/a>\u00a0mb\u00ebshtetur nga Fondacioni Shoq\u00ebria e Hapur p\u00ebr Shqip\u00ebrin\u00eb, analizoi se si gjyqtar\u00eb t\u00eb ndrysh\u00ebm i kishin dh\u00ebn\u00eb zgjidhje disa \u00e7\u00ebshtjeve gjyq\u00ebsore t\u00eb ngritura nga shoqatat mjedisore dhe qytetar\u00eb t\u00eb interesuar.
