K\u00ebto shkelje jan\u00eb t\u00eb v\u00ebrtetuara edhe nga gjykata.<\/p>\n\n\n\n<p>T\u00eb pakt\u00ebn k\u00ebshtu ka ndodhur pallatin 141 n\u00eb Kombinat ku shkeljet ligjore jan\u00eb konstatuar edhe&nbsp; Gjykata Administrative e Tiran\u00ebs e cila urdh\u00ebroi shfuqizimin e t\u00eb gjitha akteve p\u00ebr shembjen e k\u00ebsaj godine.<\/p>\n\n\n\n<p>K\u00ebshilli Bashkiak i Tiran\u00ebs miratoi vendimin p\u00ebr prishjen e detyruar t\u00eb pallatit pas hartimit t\u00eb nj\u00eb akt ekspertize nga nj\u00eb kompani e kontraktuar nga Bashkia Tiran\u00eb dhe konfirmuar nga oponenca teknike e Institutit t\u00eb Nd\u00ebrtimit. Sipas akt-ekspertiz\u00ebs shkalla e d\u00ebmtimit t\u00eb pallatit 141 \u00ebsht\u00eb DS4 nd\u00ebrsa raporti mes kostos s\u00eb rind\u00ebrtimit t\u00eb pallatit dhe kostos s\u00eb riparimit \u00ebsht\u00eb llogaritur n\u00eb mas\u00ebn 80.02%. N\u00eb zbatim edhe t\u00eb Aktit Normativ nr. 9\/2019, sipas t\u00eb cilit n\u00eb ato raste kur kostot e riparimit kalojn\u00eb mas\u00ebn e 70 % t\u00eb kostos s\u00eb nd\u00ebritmit nga e para, godina duhet t\u00eb shembet, u vendos prishja e detyruar e pallatit n\u00eb Kombinat.<\/p>\n\n\n\n<p>Por t\u00eb gjitha procedurat e ndjekura nga Bashkia e Tiran\u00ebs jan\u00eb shfuqizuar nga gjykata e cila vendimmarrjen p\u00ebr prishjen e Pallatit 141 e konsideron nj\u00eb rast q\u00eb ka cenuar standardet e nj\u00eb procesi t\u00eb rregullt ligjor.<\/p>\n\n\n\n<p>Faktet e paraqitura gjat\u00eb gjykimit bind\u00ebn gjykat\u00ebn t\u00eb vendos\u00eb mos prishjen e Pallatit 141, sikurse k\u00ebrkoi Bashkia Tiran\u00ebs.<\/p>\n\n\n\n<p>Ky vendim ishte i 5-ti n\u00eb radh\u00eb dh\u00ebn\u00eb nga Gjykata Administrative e Tiran\u00eb q\u00eb shfuqizon aktet e&nbsp; Bashkis\u00eb Tiran\u00eb p\u00ebr prishjen e objekteve, kryesisht n\u00eb Kombinat.<\/p>\n\n\n\n<p>N\u00eb nj\u00eb mbledhje maraton\u00eb m\u00eb 28 Shtator 2020 K\u00ebshilli Bashkiak i Tiran\u00ebs vendosi shembjen e 19 pallateve n\u00eb zon\u00ebn e Kombinat, zon\u00eb n\u00eb t\u00eb cil\u00ebn ka projekte zhvillimi. N\u00eb shum\u00eb raste vendimet e K\u00ebshillit Bashkiak jan\u00eb ankimuar n\u00eb gjykat\u00eb e cila ka vler\u00ebsuar se vendimmarrjet kan\u00eb qen\u00eb t\u00eb gabuara dhe n\u00eb kund\u00ebrshtim me ligjin.<\/p>\n\n\n\n<p>Vendimmarrja mbi dokumente t\u00eb manipuluara<\/p>\n\n\n\n<p>Vet\u00ebm nj\u00eb dit\u00eb pasi kishte siguruar oponenc\u00ebn teknike t\u00eb Institutit t\u00eb Nd\u00ebrtimit, Kryetari i Bashkis\u00eb s\u00eb Tiran\u00ebs, Erion Veliaj mblodhi n\u00eb sall\u00ebn qendrore t\u00eb bashkis\u00eb punonj\u00ebs t\u00eb administrat\u00ebs s\u00eb tij por edhe ekspert\u00eb inxhinier\u00eb t\u00eb p\u00ebrfshir\u00eb n\u00eb procesin e rind\u00ebrtimit. Mbledhja u konsiderua si nj\u00eb d\u00ebgjes\u00eb publike me ata t\u00eb cil\u00ebt kan\u00eb kryer vler\u00ebsimet p\u00ebrkat\u00ebse p\u00ebr pallatet e d\u00ebmtuara nga t\u00ebrmeti i 26 N\u00ebntorit 2019. T\u00eb pranish\u00ebm n\u00eb sall\u00eb nuk ishin asnj\u00eb prej banor\u00ebve, sht\u00ebpia e t\u00eb cil\u00ebve me nj\u00eb t\u00eb r\u00ebn\u00eb t\u00eb lapsit u vendos t\u00eb rr\u00ebnohej.<\/p>\n\n\n\n<p><a href=\"https:\/\/tirana.al\/artikull\/zhvillohet-degjesa-e-dyte-publike-me-inxhinieret-per-pallatet-e-demtuara-nga-termeti\">Sipas njoftimit t\u00eb bashkis\u00eb,<\/a>&nbsp;kjo ishte seanca e dyt\u00eb e d\u00ebgjes\u00ebs publike q\u00eb bashkia zhvillonte p\u00ebr projektet e rind\u00ebrtimit dhe nga podiumi i kryebashkiakut Veliaj u siguroi banor\u00ebve se \u201clagjet e reja q\u00eb do t\u00eb nd\u00ebrtoheshin n\u00eb Kombinat dhe Kinostudio do t\u00eb ishin nd\u00ebr m\u00eb t\u00eb bukurat n\u00eb qytet\u201d.<\/p>\n\n\n\n<p>Duke iu referua akt ekspertizave t\u00eb hartuar nga inxhinier\u00eb t\u00eb kontraktuar nga Bashkia, Veliaj sqaroi se vendimmarrja p\u00ebr shembjen e pallateve ishte n\u00eb zbatim t\u00eb aktit normativ nr 9, i miratuar m\u00eb 16 dhjetor 2019.<\/p>\n\n\n\n<p>Sipas aktit, p\u00ebr shkall\u00ebn e d\u00ebmtimit DS4, sipas nenit 34, n\u00ebse nd\u00ebrhyrjet p\u00ebr riparimin e struktur\u00ebs s\u00eb godin\u00ebs kushtojn\u00eb m\u00eb shum\u00eb se 70% e kostos s\u00eb rind\u00ebrtimit nga e para t\u00eb godin\u00ebs, at\u00ebher\u00eb autoriteti p\u00ebrgjegj\u00ebs vendos shembjen e detyruara t\u00eb k\u00ebtij objekti.<\/p>\n\n\n\n<p>\u201cVendimi i bashkis\u00eb p\u00ebr prishjen e detyruar t\u00eb nd\u00ebrtesave n\u00eb pron\u00ebsi private apo publike, pra ato raste kur nd\u00ebrtesa \u00ebsht\u00eb e d\u00ebmtuar nga fatkeq\u00ebsia natyrore, kur nuk mund t\u00eb riparohet ose riparimi kushton m\u00eb shum\u00eb se 70% e kostos s\u00eb nd\u00ebrtimit nga e para, merret n\u00ebp\u00ebrmjet k\u00ebtij procesi transparent dhe bazuar n\u00eb parashikimet e aktit normativ\u201d- thoshte Veliaj teksa nga nj\u00eb video-projektor i vendosur n\u00eb sall\u00eb shfaqeshin imazhet e godinave t\u00eb d\u00ebmtuara nga t\u00ebrmetit i 26 n\u00ebntorit n\u00eb Kombinat.<\/p>\n\n\n\n<p>N\u00eb nj\u00eb nga pamjet ishte edhe pallatit 5 kat\u00ebsh i identifikuar si objekti nr. 141 n\u00eb rrug\u00ebn Sokrat Mosko, me shkall\u00eb d\u00ebmtimit t\u00eb vler\u00ebsuar DS4.<\/p>\n\n\n\n<p>Pik\u00ebrisht n\u00eb k\u00ebt\u00eb pallat, n\u00eb nj\u00eb apartament 61 m2, banonte edhe J.K. 56 vje\u00e7ari ndiqte n\u00eb ankth konkluzionet e eksperteve dhe deklararat e kryebashkiakut q\u00eb e vler\u00ebsonin pallatin ku ndodhej apartamenti i tij t\u00eb pa sigurt\u00eb p\u00ebr jet\u00ebn. Nga podiumi i sall\u00ebs s\u00eb mbledhjeve t\u00eb bashkis\u00eb, Veliaj deklaroi se kishte vendosur q\u00eb pallati ku jetonte familja e J.K. nuk kishte leverdi t\u00eb riparohej.<\/p>\n\n\n\n<p>Pas k\u00ebtyre deklaratave t\u00eb Veliaj, vendimet i K\u00ebshillit Bashkiak t\u00eb Tiran\u00ebs, t\u00eb marra m\u00eb 28 shator 2020, ishin thjesht\u00eb nj\u00eb formalitet.<\/p>\n\n\n\n<p>Megjith\u00ebse kryebashkiaku premtonte transparenc\u00eb dhe nd\u00ebrtime n\u00eb standarde evropiane, duket se fjal\u00ebt nuk bind\u00ebn J.K., i cili p\u00ebr t\u00eb m\u00ebsuar mbi ligjshm\u00ebrin\u00eb e vendimeve bashkiake iu drejtua avokat\u00ebve Dorian Matlija dhe Irena Dule.<\/p>\n\n\n\n<p>Ajo q\u00eb u zbulua ndoshta p\u00ebrb\u00ebn skandalin m\u00eb t\u00eb madh t\u00eb rind\u00ebrtimit t\u00eb objekteve t\u00eb d\u00ebmtuara nga t\u00ebrmeti n\u00eb Shqip\u00ebri. Akti i ekspertimit dhe oponenca teknike e Institutit t\u00eb Nd\u00ebrtimit, mbi t\u00eb cilin jan\u00eb marr\u00eb vendimet e Bashkis\u00eb Tiran\u00eb, ishin t\u00eb pasakta n\u00eb fakte dhe n\u00eb shifra.<\/p>\n\n\n\n<p>Pas k\u00ebsaj, 56 vje\u00e7ari vendos t\u2019i drejtohet gjykat\u00ebs. Fillimisht p\u00ebr t\u00eb k\u00ebrkuar vendosjen e mas\u00ebn s\u00eb sigurimit p\u00ebr t\u00eb penguar prishjen e objektit nga fadromat e m\u00eb pas&nbsp; shfuqizimin e oponenc\u00ebs teknike t\u00eb Institutit t\u00eb Nd\u00ebrtimit si dhe vendimin e K\u00ebshillit Bashkiak p\u00ebr shembjen e detyruar t\u00eb pallatit 141 n\u00eb Kombinat.<\/p>\n\n\n\n<p>P\u00ebrgjat\u00eb hetimit gjyq\u00ebsor, q\u00eb zgjati rreth nj\u00eb vit, u v\u00ebrtetua se vendimi i K\u00ebshillit Bashkiak ishte bazuar mbi ekspertiza tep\u00ebr t\u00eb pasakta, t\u00eb cilat m\u00eb pas ishin certifikuar nga Instituti i Nd\u00ebrtimit, pa b\u00ebr\u00eb asnj\u00eb vler\u00ebsim real t\u00eb k\u00ebtyre eskpertizave.<\/p>\n\n\n\n<p>J.K., fillimisht i paraqiti gjykat\u00ebs nj\u00eb akt ekspertimi t\u00eb firmosur nga dy inxhinier\u00eb t\u00eb cil\u00ebt e p\u00ebrcaktonin nivelin e d\u00ebmtimit t\u00eb pallatit n\u00eb DS3 dhe me kosto e riparimi 10,000,000 lek\u00eb, nd\u00ebrsa n\u00eb akt- ekspertiz\u00ebn e thelluar, t\u00eb hartuar nga nj\u00eb kompani e kontraktuar nga Bashkia e Tiran\u00ebs, vlera e riparimit t\u00eb pallatit \u00ebsht\u00eb p\u00ebrcaktuar me 41,189,612 lek\u00eb.&nbsp;<\/p>\n\n\n\n<p>\u201cBanor\u00ebt jan\u00eb investuar dhe kan\u00eb b\u00ebr\u00eb nj\u00eb akt privat ekspertize q\u00eb u paraqit para gjykat\u00ebs, p\u00ebr t\u00eb vler\u00ebsuar dhe shkall\u00ebn e d\u00ebmit. Ishte shum\u00eb e thjesht\u00eb p\u00ebr t\u00eb dal\u00eb n\u00eb p\u00ebrfundimin e vendimit t\u00eb kundra ligjsh\u00ebm t\u00eb bashkis\u00eb qoft\u00eb duke u nisur nga preventivi i punimeve, q\u00eb \u00ebsht\u00eb pjes\u00eb e t\u00eb gjith\u00eb dosjes q\u00eb ka sjell\u00eb pala e paditur\u201d \u2013 thot\u00eb avokatja Irena Dule.<\/p>\n\n\n\n<p>Nj\u00eb tjet\u00ebr anomali e konstatuar gjat\u00eb hetimit gjyq\u00ebsor ishte sip\u00ebrfaqja totale e pallatit mbi t\u00eb cil\u00ebn \u00ebsht\u00eb bazuar ekspertiza e thelluar. Sipas dosjes gjyq\u00ebsore sip\u00ebrfaqja e pallatit \u00ebsht\u00eb t\u00eb pak\u00ebn 210 m2 m\u00eb e madhe sa prezantohet n\u00eb dokumentet e bashkis\u00eb dhe aktet e ekspertimit. Kjo anomali ka ngritur dyshime se akt-ekspertiza e thelluar nuk \u00ebsht\u00eb bazuar verifikime n\u00eb terren.<\/p>\n\n\n\n<p>Rritja e kostove t\u00eb riparimit dhe z\u00ebrave t\u00eb punimeve ishte nj\u00eb tjet\u00ebr fakt q\u00eb u konstatua nga gjykata. Sipas preventivit t\u00eb b\u00ebr\u00eb nga Instituti i Nd\u00ebrtimit, i em\u00ebrtuar \u201cP\u00ebr punimet e e nd\u00ebrhyrjes strukturore p\u00ebr p\u00ebrforcimin e pallatit nr 141\u201d, kosto e punimeve rezulton t\u00eb jet\u00eb 34.596.519 lek\u00eb. Ky preventiv, sipas ekspertes s\u00eb caktuar nga gjykata p\u00ebrmbante punime t\u00eb panevojshme p\u00ebr p\u00ebrforcimin e objektit, t\u00eb tilla si suvatim nga jasht\u00eb me sistemin kapot, instalime kondicionimi apo edhe lulishte.<\/p>\n\n\n\n<p>Kur gjykata i k\u00ebrkoi ekspertes t\u00eb zbriste kostot e k\u00ebtyre punimeve, q\u00eb nuk kishin t\u00eb b\u00ebnin m\u00eb p\u00ebrforcimin e godin\u00ebs, vlera e punimeve p\u00ebr riparimin e pallatit rezultoi shum\u00eb her\u00eb m\u00eb e ul\u00ebt, rreth 28 milion lek\u00eb.<\/p>\n\n\n\n<p>E pa sakt\u00eb gjat\u00eb hetimit gjyq\u00ebsor rezultoi edhe shifra e rind\u00ebrtimit t\u00eb k\u00ebtij pallati, e cila ishte llogaritur p\u00ebr nj\u00eb sip\u00ebrfaqe m\u00eb t\u00eb vog\u00ebl sa \u00ebsht\u00eb n\u00eb realitet godina. Bashkia e kishte llogaritur vler\u00ebn e rind\u00ebrtimit n\u00eb shifr\u00ebn e 51.316.574 lek\u00ebve, pa p\u00ebrfshir\u00eb n\u00eb projekt kostot e prishjes e objektit ekzistues.<\/p>\n\n\n\n<p>Sipas aktit t\u00eb ekspertiz\u00ebs s\u00eb ekspertes s\u00eb caktuar nga gjykata kjo vler\u00eb ishte m\u00eb e lart\u00eb edhe p\u00ebr sip\u00ebrfaqen e 1650 m2 mbi t\u00eb cil\u00ebn ka p\u00ebrllogaritur kostot bashkia. Sipas ekspertes s\u00eb gjykat\u00ebs kosto e rind\u00ebrtimit rezulton t\u00eb jet\u00eb 54.883.770 lek\u00eb, pa shtuar k\u00ebtu edhe faktin se kostove shtes\u00eb p\u00ebr sip\u00ebrfaqen q\u00eb nuk \u00ebsht\u00eb p\u00ebrllogaritur pasi sip\u00ebrfaqja totale e pallatit 141 sipas gjykat\u00ebs \u00ebsht\u00eb 1860m2.<\/p>\n\n\n\n<p>Mbi baz\u00ebn e k\u00ebtyre fakteve gjykata ka zbuluar se edhe raporti mes kostos s\u00eb riparimit dhe nd\u00ebrtimit p\u00ebr k\u00ebt\u00eb objekt nuk \u00ebsht\u00eb e sakt\u00eb.<\/p>\n\n\n\n<p>Sipas oponenc\u00ebs teknike t\u00eb Institut t\u00eb Nd\u00ebrtimit, p\u00ebr pallatin 141 raporti mes kostos s\u00eb riparimit dhe kostos s\u00eb rind\u00ebrtimit rezulton t\u00eb&nbsp; jet\u00eb 80%. Nd\u00ebrsa p\u00ebr eksperten e gjykat\u00ebs ky raport \u00ebsht\u00eb 49% , duksh\u00ebm n\u00ebn limitin ligjor prej 70% i vendosur si kriter p\u00ebr rind\u00ebrtimin apo riparimin e objektit.<\/p>\n\n\n\n<p>Avokatja Irene Dule thot\u00eb se preventivi ka pasur kosto t\u00eb shtuara me q\u00ebllim tejkalimin ligjor prej 70% t\u00eb kostos.<\/p>\n\n\n\n<p>\u201cKa pasur z\u00ebra t\u00eb till\u00eb n\u00eb preventiv q\u00eb e kan\u00eb rritur vler\u00ebn e preventivit n\u00eb m\u00ebnyr\u00eb artificiale p\u00ebr ta kapur k\u00ebt\u00eb vler\u00eb mbi 70%. Ka pasur trotuare, pem\u00eb dekorative, sisteme kund\u00ebr zjarrit, veshje kapot, gj\u00ebra t\u00eb cilat nuk i sh\u00ebrbejn\u00eb qendrueshm\u00ebris\u00eb s\u00eb pallatit, si\u00e7 vet\u00eb akti normativ k\u00ebrkon, q\u00eb ti do t\u00eb investosh aq sa ta b\u00ebsh pallatin t\u00eb qendruesh\u00ebm dhe jo ta b\u00ebsh pallat luksi\u201d, \u2013 p\u00ebrfundon avokatja Dule.<\/p>\n\n\n\n<p>N\u00eb k\u00ebt\u00eb konkluzion ka dal\u00eb edhe gjykata. \u201cDuke iu referuar akt t\u00eb ekspertimit teknik nd\u00ebrhyrjet p\u00ebr riparimin e struktur\u00ebs s\u00eb pallatit 141 nuk kushtojn\u00eb m\u00eb shum\u00eb se 70% e kostos s\u00eb rind\u00ebrtimit t\u00eb nd\u00ebrtes\u00ebs. P\u00ebr shkak se nuk kushtojn\u00eb m\u00eb shum\u00eb se 70 % kjo struktur\u00eb nuk mund t\u00eb shembet p\u00ebr shkak se nuk p\u00ebrmbush kushtet dhe kriteret e parashikuara n\u00eb pik\u00ebn 4 t\u00eb nenit 34 t\u00eb aktit normativ.\u201d \u2013 thuhet n\u00eb vendimin e zbardhur t\u00eb gjykat\u00ebs, ku aktet e miratuara nga K\u00ebshilli Bashkiak cil\u00ebsohen t\u00eb nd\u00ebrmarra n\u00eb kund\u00ebrshtim me ligjin dhe Kushtetut\u00ebn e vendit.<\/p>\n\n\n\n<p>\u201cP\u00ebrsa m\u00eb sip\u00ebr aktet administrative objekt i k\u00ebtij gjykimi rezultojn\u00eb t\u00eb jen\u00eb nxjerr\u00eb n\u00eb kund\u00ebrshtim me aktin normativ duke cenuar k\u00ebshtu edhe t\u00eb drejt\u00ebn e pron\u00ebs private, e cila gjen mbrojte t\u00eb ve\u00e7ant\u00eb edhe nga Kushtetuta e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb\u201d- vijon arsyetimin gjykata.<\/p>\n\n\n\n<p>Mos njoftimi i banor\u00ebve p\u00ebr vendimmarrjen administrative \u00ebsht\u00eb nj\u00eb tjet\u00ebr shkelje, t\u00eb cil\u00ebn gjykata e ka konsideruar si cenim t\u00eb standardeve t\u00eb nj\u00eb procesi t\u00eb rregullt ligjor.<\/p>\n\n\n\n<p>\u201cMos njoftimi i padit\u00ebsit p\u00ebr procedimin administrativ, i cili \u00ebsht\u00eb finalizuar me aktin administrativ i cili \u00ebsht\u00eb objekt i k\u00ebtij gjykimi ka cenuar&nbsp; t\u00eb drejt\u00ebn p\u00ebr t\u2019u d\u00ebgjuar dhe mbrojtur n\u00eb procesin administrativ. N\u00eb k\u00ebto kushte gjykata vler\u00ebson se pal\u00ebt e paditura nuk kan\u00eb respektuar standardet e nj\u00eb procesi t\u00eb rregullt ligjor\u201d- vijon arsyetimin gjykata.<\/p>\n\n\n\n<p>Gjykata vler\u00ebson se K\u00ebshilli Bashkiak dhe Instituti i Nd\u00ebrtimit nuk kan\u00eb respektuar dispozitat q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me procedur\u00ebn e nxjerr\u00ebs s\u00eb aktive administrative.<\/p>\n\n\n\n<p>Ky vendim \u00ebsht\u00eb apeluar nga Bashkia e Tiran\u00ebs, nd\u00ebrsa sipas avokates Irena Dule jan\u00eb edhe nj\u00eb s\u00ebr\u00eb \u00e7\u00ebshtjes t\u00eb tjera q\u00eb po ndiqen n\u00eb gjykat\u00eb p\u00ebr t\u00eb nj\u00ebjtin set vendimesh t\u00eb K\u00ebshillit Bashkiak, q\u00eb lidhen me shembjen e detyrueshme t\u00eb godinave me pretendimin se jan\u00eb d\u00ebmtuar nga t\u00ebrmeti.<\/p>\n\n\n\n<p><em>* Ky artikull u realizua n\u00eb kuad\u00ebr t\u00eb projektit \u201cP\u00ebr nj\u00eb proces rind\u00ebrtimi
