Kryetar,<\/p>\n\n\n\n<p>Ne, k\u00ebrkuesit, n\u00eb cil\u00ebsin\u00eb e nj\u00eb organizate t\u00eb shoq\u00ebris\u00eb civile dhe komunitetit t\u00eb prekur, n\u00eb kuad\u00ebr t\u00eb Projektit \u201cP\u00ebr nj\u00eb proces rind\u00ebrtimi m\u00eb t\u00eb p\u00ebrgjegjsh\u00ebm\u201d, mb\u00ebshtetur nga \u201cL\u00ebviz Albania\u201d nj\u00eb projekt i Agjencis\u00eb Zvicerane p\u00ebr Zhvillim dhe Bashk\u00ebpunim, SDC, jemi njohur me praktik\u00ebn e paligjshme t\u00eb prishjes s\u00eb pallateve n\u00eb Nj\u00ebsin\u00eb Administrative nr. 6 Tiran\u00eb (zona e Kombinatit) dhe n\u00eb disa zona t\u00eb tjera t\u00eb qytetit t\u00eb Tiran\u00ebs, nga ana e Bashkis\u00eb Tiran\u00eb, P\u00ebr t\u00eb cilat kjo e fundit pretendon t\u00eb jen\u00eb prishur n\u00eb shkall\u00eb t\u00eb r\u00ebnd\u00eb nga t\u00ebrmeti.<\/p>\n\n\n\n<p>Me q\u00ebllim kontributin ton\u00eb, dhe n\u00eb frym\u00ebn e Planit t\u00eb Veprimit 2019-2023, n\u00eb zbatim t\u00eb Strategjis\u00eb Nd\u00ebrsektoriale Kund\u00ebr Korrupsionit, n\u00eb luft\u00ebn kund\u00ebr korupsionit, ju drejtohemi me k\u00ebt\u00eb shkres\u00eb p\u00ebr t\u2019Ju v\u00ebn\u00eb n\u00eb dijeni t\u00eb nj\u00eb praktike t\u00eb kundraligjshme me d\u00ebm jo vet\u00ebm kund\u00ebr interesit dhe t\u00eb drejtave t\u00eb shtetasve, por edhe n\u00eb d\u00ebm t\u00eb fondeve publik si\u00e7 shpjegohet m\u00eb posht\u00eb.&nbsp;<\/p>\n\n\n\n<p>Kjo praktik\u00eb, q\u00eb nis me hartimin e Akt-Ekspertizave t\u00eb Thelluara, me porosit\u00ebs Bashkin\u00eb Tiran\u00eb, duke vijuar me <em>\u201ccertifikimin\u201c<\/em> e k\u00ebtyre akt ekspertizave, p\u00ebrmes oponencave teknike p\u00ebrkat\u00ebse t\u00eb Institutit t\u00eb Nd\u00ebrtimit, e deri me miratimin e vendimeve t\u00eb K\u00ebshillit Bashkiak Tiran\u00eb, i cili vendos prishjen e pallateve, rezultojn\u00eb n\u00eb shkelje t\u00eb ligjit dhe si t\u00eb tilla, me pasoja p\u00ebr buxhetin e shtetit. Nj\u00eblloj e paligjshme rezulton t\u00eb jet\u00eb edhe vet\u00eb ekzekutimi i Vendimeve t\u00eb K\u00ebshillit Bashkiak Tiran\u00eb.<\/p>\n\n\n\n<p>Jan\u00eb rreth 67 vendime t\u00eb K\u00ebshillit Bashkiak Tiran\u00eb, t\u00eb cilat, n\u00eb dijenin\u00eb ton\u00eb jan\u00eb ekzekutuar n\u00eb 28 raste deri n\u00eb momentin e hartimit t\u00eb k\u00ebsaj k\u00ebrkese. &nbsp;<\/p>\n\n\n\n<p>Pezullimi i ekzekutimit t\u00eb vendimeve t\u00eb mbetura dhe rishikimi i tyre nga ana e Bashkis\u00eb dhe&nbsp; K\u00ebshillit Bashkiak Tiran\u00eb, do t\u00eb sillte si pasoj\u00eb nd\u00ebrprerjen e (1) d\u00ebmit t\u00eb m\u00ebtejsh\u00ebm financiar dhe (2) c\u00ebnimit t\u00eb interesave t\u00eb ligjshme t\u00eb shtetasve.<\/p>\n\n\n\n<p>Nga t\u00eb gjitha proceset e nisura n\u00eb Gjykat\u00ebn Administrative t\u00eb Shkall\u00ebs s\u00eb Par\u00eb, Tiran\u00eb, ka rezultuar se pallatet (objektet) e caktuar p\u00ebr prishje nuk plot\u00ebsojn\u00eb kriteret ligjore p\u00ebr prishje sepse nuk kan\u00eb shkall\u00eb t\u00eb lart\u00eb d\u00ebmtimi.<\/p>\n\n\n\n<p>N\u00eb \u00e7do rast t\u00eb p\u00ebrfundimit t\u00eb gjykimit, oponencat teknike t\u00eb Institutit t\u00eb Nd\u00ebrtimit dhe vendimet e K\u00ebshillit Bashkiak Tiran\u00eb, jan\u00eb shfuqizuar si akte t\u00eb paligjshme. Kjo ka ndodhur p\u00ebr t\u00eb pakt\u00ebn 6 pallate (objekte) p\u00ebr t\u00eb cilat gjykata ka shfuqizuar vendimet e K\u00ebshillit Bashkiak Tiran\u00eb si m\u00eb posht\u00eb:<\/p>\n\n\n\n<ul>\n<li>VKB nr. 105, dt. 28.09.2020;<\/li>\n\n\n\n<li>VKB nr. 106, dt. 28.09.2020;<\/li>\n\n\n\n<li>VKB nr. 107, dt. 28.09.2020;<\/li>\n\n\n\n<li>VKB nr. 117, dt. 28.09.2020;<\/li>\n\n\n\n<li>VKB nr. 121, dt. 28.09.2020;<\/li>\n\n\n\n<li>VKB nr. 157, dt. 24.11.2021.<\/li>\n<\/ul>\n\n\n\n<p>Nj\u00eblloj pritet q\u00eb gjykata t\u00eb vendos\u00eb p\u00ebr vendimet e prishjes s\u00eb t\u00eb pakt\u00ebn 3 pallateve t\u00eb tjer\u00eb, q\u00eb jan\u00eb ende n\u00eb shqyrtim, p\u00ebr t\u00eb cil\u00ebt \u00ebsht\u00eb paraqitur akt-ekspertiz\u00eb e ekspert\u00ebve t\u00eb caktuar nga gjykata. Sipas k\u00ebtyre akt-ekspertizave, pallatet nuk duhet t\u00eb prishen pasi shkalla e d\u00ebmtimit \u00ebsht\u00eb m\u00eb e vog\u00ebl (DS1-DS2). Konkretisht pritet t\u00eb shfuqizohen nga gjykata:<\/p>\n\n\n\n<ul>\n<li>VKB nr. 30, dt. 01.03.2021;<\/li>\n\n\n\n<li>VKB nr. 34, dt. 01.03.2021;<\/li>\n\n\n\n<li>VKB nr. 155, dt. 24.11.2021.<\/li>\n<\/ul>\n\n\n\n<p>N\u00eb t\u00eb nj\u00ebjtin p\u00ebrfundim duket se do t\u00eb rezultojn\u00eb edhe \u00e7\u00ebshtjet e nisura p\u00ebr 4 pallate t\u00eb tjera n\u00eb faz\u00eb shqyrtimi gjyq\u00ebsor, t\u00eb cilat, sipas akt-ekspertizave private t\u00eb b\u00ebra nga ekspert\u00eb t\u00eb licensuar, nuk jan\u00eb t\u00eb d\u00ebmtuar n\u00eb shkall\u00ebn DS4 &#8211; DS5 si\u00e7 pretendohet nga Bashkia Tiran\u00eb. Konkretisht b\u00ebhet fjal\u00eb p\u00ebr praktikat e:<\/p>\n\n\n\n<ul>\n<li>VKB nr. 151, dt. 24.11.2021;<\/li>\n\n\n\n<li>VKB nr. 154, dt. 24.11.2021;<\/li>\n\n\n\n<li>VKB nr. 118, dt. 28.09.2022;<\/li>\n\n\n\n<li>VKB nr. 110, dt. 15.11.2022.<\/li>\n<\/ul>\n\n\n\n<p>Nisur nga sa m\u00eb sip\u00ebr, argumentet p\u00ebr paligjshm\u00ebrin\u00eb e konstatuar nga ana jon\u00eb, por edhe nga Gjykata Administrative e Shkall\u00ebs s\u00eb Par\u00eb, Tiran\u00eb, po i rendisim si m\u00eb posht\u00eb:<\/p>\n\n\n\n<ol type=\"1\">\n<li><strong>Bashkia Tiran\u00eb ka porositur akt-ekspertiza t\u00eb panevojshme, me kosto p\u00ebr buxhetin e shtetit dhe me pasoja p\u00ebr qytetar\u00ebt<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Bashkia Tiran\u00eb, p\u00ebr t\u00eb kryer t\u00eb pakt\u00ebn rreth 90 Akt-Ekspertiza t\u00eb Thelluara, ka kontraktuar disa studio projektimi, me kosto p\u00ebr buxhetin e shtetit prej afro 3 milion lek\u00ebsh n\u00eb secilin rast. Mbi t\u00eb gjitha, nisma p\u00ebr kryerjen e k\u00ebtyre akt-ekspertizave n\u00eb t\u00eb gjitha rastet e shqyrtuara nga ana jon\u00eb, \u00ebsht\u00eb b\u00ebr\u00eb pa u plot\u00ebsuar kriteret ligjore p\u00ebr kryerjen e k\u00ebtyre akt-ekspertizave, me pasoj\u00eb shpenzimin e fondeve publike.<\/p>\n\n\n\n<p>Sipas Aktit Normativ nr. 9\/2019 \u201cP\u00ebr p\u00ebrballimin e pasojave t\u00eb shkaktuara nga fatkeq\u00ebsit\u00eb natyrore\u201d dhe akteve n\u00ebnligjore n\u00eb zbatim t\u00eb tij, parashikohet se \u00ebsht\u00eb Instituti i Nd\u00ebrtimit ai q\u00eb m\u00eb s\u00eb pari konstaton n\u00ebse pallatet (objektet) jan\u00eb t\u00eb d\u00ebmtuara n\u00eb shkall\u00eb t\u00eb leht\u00eb apo t\u00eb r\u00ebnd\u00eb dhe vet\u00ebm n\u00eb rast t\u00eb d\u00ebmtimit n\u00eb shkall\u00eb t\u00eb r\u00ebnd\u00eb, plot\u00ebsohen kushtet p\u00ebr t\u00eb vler\u00ebsuar m\u00eb tej pallatet me nj\u00eb Akt-Ekspertiz\u00eb t\u00eb Thelluar nga ana e Bashkis\u00eb.<\/p>\n\n\n\n<p>Vlen t\u00eb sqarojm\u00eb se \u00e7far\u00eb \u00ebsht\u00eb shkalla e d\u00ebmtimit t\u00eb nj\u00eb pallati e shprehur n\u00eb nivele nga DS1 n\u00eb DS5 dhe cili \u00ebsht\u00eb trajtimi ligjor p\u00ebr secil\u00ebn kategori d\u00ebmtimi. &nbsp;<\/p>\n\n\n\n<p>Nga p\u00ebrmbajtja e Aktit Normativ nr. 9\/2019 \u201cP\u00ebr p\u00ebrballimin e pasojave t\u00eb fatkeq\u00ebsis\u00eb natyrore\u201d dhe akteve n\u00ebnligjore n\u00eb zbatim t\u00eb tij, si VKM nr. 5, dt. 6.1.2020 \u201cP\u00ebr p\u00ebrcaktimin e rregullave dhe t\u00eb procedurave p\u00ebr p\u00ebrfitimet nga programi i granteve t\u00eb rind\u00ebrtimit dhe projektet model\u201d, VKM nr. 634, dt. 29.07.2020, \u201cP\u00ebr miratimin e marr\u00ebveshjes s\u00eb grantit nd\u00ebrmjet K\u00ebshillit t\u00eb Ministrave t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb dhe Konfederat\u00ebs Zvicerane p\u00ebr bashk\u00ebpunimin n\u00eb fush\u00ebn e rehabilitimit t\u00eb banesave pas fatkeq\u00ebsis\u00eb\u201d, rezulton se d\u00ebmtimet e shkaktuara nga t\u00ebrmeti vler\u00ebsohen me grupe sipas shkall\u00ebs s\u00eb d\u00ebmtimit nga DS0 deri n\u00eb DS5, ku DS0 nuk ka d\u00ebmtin dhe DS5 \u00ebsht\u00eb shkalla m\u00eb e r\u00ebnd\u00eb.<\/p>\n\n\n\n<p>Shkalla e d\u00ebmtimit p\u00ebrcakton edhe se n\u00eb cilin program t\u00eb rind\u00ebrtimit do t\u00eb p\u00ebrfshihet objekti dhe pronar\u00ebt e tij dhe sa do t\u00eb jet\u00eb shuma e p\u00ebrfitimit. K\u00ebshtu n\u00ebse shkalla e d\u00ebmtimit \u00ebsht\u00eb e leht\u00eb deri n\u00eb mesatare, (d\u00ebmtim q\u00eb i korespondon grupimit nga DS1 n\u00eb DS3 t\u00eb p\u00ebrfundimit t\u00eb ekspertizave) p\u00ebrfituesit do t\u00eb marrin nj\u00eb fond lek\u00ebsh t\u00eb p\u00ebrcaktuar n\u00eb var\u00ebsi t\u00eb d\u00ebmtimit. Konkretisht:<\/p>\n\n\n\n<ul>\n<li>d\u00ebmtimet e shkall\u00ebs DS1 &#8211; jo m\u00eb shum\u00eb se 100 000 lek\u00eb;<\/li>\n\n\n\n<li>d\u00ebmtimet e shkall\u00ebs DS2 &#8211; jo m\u00eb shum\u00eb se 250 000 lek\u00eb;<\/li>\n\n\n\n<li>d\u00ebmtimet e shkall\u00ebs DS3 &#8211; jo m\u00eb shum\u00eb se 500 000 lek\u00eb.<\/li>\n<\/ul>\n\n\n\n<p>Sa m\u00eb sip\u00ebr rezulton nga zbatimi i pik\u00ebs 4, kreu IV i VKM nr. 5, dt. 6.1.2020 \u201cP\u00ebr p\u00ebrcaktimin e rregullave dhe t\u00eb procedurave p\u00ebr p\u00ebrfitimet nga programi i granteve t\u00eb rind\u00ebrtimit dhe projektet model\u201d dhe shtojc\u00ebs 3 t\u00eb VKM nr. 634, dt. 29.07.2020, \u201cP\u00ebr miratimin e marr\u00ebveshjes s\u00eb grantit nd\u00ebrmjet K\u00ebshillit t\u00eb Ministrave t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb dhe Konfederat\u00ebs Zvicerane p\u00ebr ashk\u00ebpunimin n\u00eb fush\u00ebn e rehabilitimit t\u00eb banesave pas fatkeq\u00ebsis\u00eb\u201d.<\/p>\n\n\n\n<p>Nga ana tjet\u00ebr<strong>, n\u00ebse shkalla e d\u00ebmtimit \u00ebsht\u00eb e r\u00ebnd\u00eb dhe strukturore q\u00eb i korespondon shkall\u00ebs DS4, pallati do t\u00eb kaloj\u00eb n\u00eb nj\u00eb vler\u00ebsim t\u00eb thelluar<\/strong> ku do t\u00eb vler\u00ebsohen kostot e riparimit t\u00eb struktur\u00ebs. N\u00ebse k\u00ebto kosto jan\u00eb n\u00ebn 70% t\u00eb vler\u00ebs s\u00eb rind\u00ebrtimit, sipas preventimit t\u00eb punimeve pallati do t\u00eb riparohet (p\u00ebrforcohet). N\u00ebse k\u00ebto jan\u00eb mbi 70% t\u00eb kostos s\u00eb rind\u00ebrtimit, K\u00ebshilli Bashkiak vendos p\u00ebr prishjen e tij.<\/p>\n\n\n\n<p>Sa m\u00eb sip\u00ebr parashikohet n\u00eb neni 34, pika 4 e Aktit Normativ nr 9\/2019, ku parashikohet se:<\/p>\n\n\n\n<p><em>\u201c\u2026N\u00ebse sipas studimit t\u00eb thelluar, t\u00eb mb\u00ebshtetur dhe nga oponenca e Institutit t\u00eb Nd\u00ebrtimit, nd\u00ebrhyrjet p\u00ebr riparimin e struktur\u00ebs kushtojn\u00eb m\u00eb shum\u00eb se 70% e kostos s\u00eb rind\u00ebrtimit nga e para t\u00eb nd\u00ebrtes\u00ebs, nj\u00ebsia e vet\u00ebqeverisjes vendore ose autoriteti p\u00ebrgjegj\u00ebs vendos shembjen e detyruar t\u00eb objektit, q\u00eb kryhet sipas procedurave t\u00eb parashikuara n\u00eb nenin 35 t\u00eb k\u00ebtij akti\u2026.\u2019<\/em><\/p>\n\n\n\n<p>Th\u00ebn\u00eb ndryshe, fakti n\u00ebse nj\u00eb pallat i d\u00ebmtuar n\u00eb struktur\u00eb q\u00eb i korespondon shkall\u00ebs s\u00eb d\u00ebmtimit DS4 do t\u00eb prishet apo do t\u00eb riparohet, kjo \u00ebsht\u00eb \u00e7\u00ebshtje leverdisshm\u00ebrie ekonomike dhe jo domosdoshm\u00ebrie p\u00ebr ndonj\u00eb shkak tjet\u00ebr si p\u00ebr shembull rrezikshm\u00ebria e objektit. Kjo e fundit i korespondon shkall\u00ebs s\u00eb d\u00ebmtimit DS5 e cila \u00ebsht\u00eb shkalla m\u00eb e lart\u00eb e d\u00ebmtimit, ndaj objektet e d\u00ebmtuara me k\u00ebt\u00eb shkall\u00eb d\u00ebmtimi do t\u00eb prishen, pasi paraqesin rrezikshm\u00ebri p\u00ebr jet\u00ebn e qytetar\u00ebve.<\/p>\n\n\n\n<p>Kjo parashikohet n\u00eb nenin 35, pika 1 t\u00eb Aktit Normativ nr. 9\/2019, ku thuhet se:<\/p>\n\n\n\n<p><em>\u201cPrishja e detyruar e nj\u00eb nd\u00ebrtese apo disa nd\u00ebrtesave, n\u00eb pron\u00ebsi private apo publike, kryhet n\u00eb \u00e7do rast kur nd\u00ebrtesa \u00ebsht\u00eb d\u00ebmtuar nga fatkeq\u00ebsia natyrore dhe nuk mund t\u00eb riparohet ose kur p\u00ebrb\u00ebn rrezik p\u00ebr jet\u00ebn dhe sh\u00ebndetin e njer\u00ebzve, sipas p\u00ebrfundimeve n\u00eb aktkonstatimet apo aktvler\u00ebsimet paraprake t\u00eb Institutit t\u00eb Nd\u00ebrtimit ose n\u00eb aktekspertiz\u00ebn e thelluar, si dhe n\u00ebse riparimi kushton m\u00eb shum\u00eb se nd\u00ebrtimi nga e para, sipas rekomandimeve n\u00eb aktin e ekspertiz\u00ebs s\u00eb thelluar, t\u00eb hartuar sipas parashikimeve n\u00eb k\u00ebt\u00eb ligj.\u201d<\/em><\/p>\n\n\n\n<p>N\u00eb k\u00ebt\u00eb kontekst ligjor, fillimisht duhet b\u00ebr\u00eb nj\u00eb akt-konstatimi nga Instituti i Nd\u00ebrtimit, i cili vler\u00ebson n\u00ebse pallati \u00ebsht\u00eb i nj\u00eb shkalle d\u00ebmtimi mbi DS4 dhe vet\u00ebm n\u00eb baz\u00eb t\u00eb k\u00ebtij Akt- Konstatimi, Bashkia Tiran\u00eb do t\u00eb duhet t\u00eb hartoj\u00eb Akt-Ekspertizat e Thellluara.<\/p>\n\n\n\n<p>Nga v\u00ebzhgimi i kryer nga qendra Res Publica, ku nga 67 praktika (q\u00eb i korespondojn\u00eb 67 VKB-ve, Tiran\u00eb) jan\u00eb marr\u00eb n\u00eb shqyrtim t\u00eb detajuar, \u00ebsht\u00eb b\u00ebr\u00eb nj\u00eb depistim n\u00eb 15 dosje, t\u00eb cilat i jan\u00eb n\u00ebnshtruar edhe procesit gjyq\u00ebsor si\u00e7 e trajtuam m\u00eb sip\u00ebr. Ka rezultuar q\u00eb t\u00eb 15 pallatet p\u00ebrkat\u00ebs t\u00eb shpallur p\u00ebr prishje jan\u00eb n\u00eb shkall\u00eb d\u00ebmtimi t\u00eb leht\u00eb, n\u00eb pjes\u00ebn m\u00eb t\u00eb madhe t\u00eb rasteve DS2, n\u00eb ndonj\u00eb rast shkalla e d\u00ebmtimit ka q\u00ebn\u00eb pjes\u00ebrisht DS3 (sqaruar nga akt ekspertizat private dhe\/ose gjyq\u00ebsore se n\u00eb ndonj\u00eb segment pallati, p\u00ebr shkak t\u00eb amortizimit n\u00eb zon\u00ebn ku mbahen depozitat e ujit, ka shkall\u00ebn DS3), dhe n\u00eb ndonj\u00eb rast shkalla e d\u00ebmtimit ka qen\u00eb DS1. Nuk ka informacion shterues lidhur me rezultatet e akt-konstatimeve paraprake dhe rezultatet e kryera paraprakisht nga Instituti i Nd\u00ebrtimit, por n\u00eb disa raste kur kemi pasur informacion, kemi v\u00ebn\u00eb re se akt-konstatimi nuk ka evidentuar shkall\u00eb t\u00eb r\u00ebnd\u00eb d\u00ebmtimi, q\u00eb t\u00eb sugjeroj\u00eb kryerjen t\u00eb akt-ekspertizave t\u00eb thelluara. N\u00eb k\u00ebto kushte, duket se vendimarrja e Bashkis\u00eb Tiran\u00eb p\u00ebr kryerjen e Akt-Ekspertiz\u00ebs s\u00eb Thelluar \u00ebsht\u00eb e pabazuar dhe me kosto t\u00eb panevojshme p\u00ebr buxhetin e shtetit n\u00eb shum\u00eb raste. P\u00ebr m\u00eb tep\u00ebr k\u00ebto akt-ekspertiza paraqesin fakte t\u00eb pav\u00ebrteta, mbi t\u00eb cilat \u00ebsht\u00eb vendosur prishja e pallateve n\u00eb m\u00ebnyr\u00eb abuzive. &nbsp;<\/p>\n\n\n\n<p><strong>N\u00eb t\u00eb gjitha praktikat e shqyrtuara, ka rezultuar e provuar se shkalla e d\u00ebmtimit t\u00eb pallateve nuk ka qen\u00eb DS4 apo DS5, ndaj p\u00ebr t\u00eb pakt\u00ebn p\u00ebr k\u00ebto pallate nuk ka qen\u00eb e domosdoshme fare kryerja e akt ekspertizave t\u00eb thelluara nga ana e Bashkis\u00eb Tiran\u00eb dhe p\u00ebr pasoj\u00eb k\u00ebto pallate nuk duhet t\u00eb klasifikoheshin p\u00ebr prishje t\u00eb detyruar.<\/strong><\/p>\n\n\n\n<p><strong>Nisur nga sa m\u00eb sip\u00ebr ka arsye p\u00ebr t\u00eb v\u00ebn\u00eb n\u00eb dyshim sakt\u00ebsin\u00eb e t\u00eb gjitha VKB p\u00ebr prishjen e detyruar t\u00eb nd\u00ebrtesave (pallateve).<\/strong><\/p>\n\n\n\n<ul>\n<li><strong>Akt-espertizat e thelluara t\u00eb Bashkis\u00eb Tiran\u00eb dhe oponencat teknike t\u00eb Institutit t\u00eb Nd\u00ebrtimit p\u00ebrmbajn\u00eb nj\u00eb mori pasakt\u00ebsish, t\u00eb konstatuara rregullisht nga gjykata administrative<\/strong><\/li>\n<\/ul>\n\n\n\n<p>Akt-Ekspertiza e Thelluara t\u00eb p\u00ebrshkruara m\u00eb sip\u00ebr do duhej t\u2019i n\u00ebnshtroheshin oponenc\u00ebs teknike t\u00eb Institutit t\u00eb Nd\u00ebrtimit, si detyrim ligjor, e cila m\u00eb pas rekomandon p\u00ebr prishjen e detyruar t\u00eb pallatit: (1) n\u00ebse shkalla e d\u00ebmtimit \u00ebsht\u00eb DS5 ose; (2) prishjen e detyruar, n\u00ebse shkalla&nbsp; d\u00ebmtimit \u00ebsht\u00eb DS4 dhe kosto e riparimit \u00ebsht\u00eb mbi 70% e kostos s\u00eb rind\u00ebrtimit.<\/p>\n\n\n\n<p>Ajo q\u00eb \u00ebsht\u00eb konstatuar nga shqyrtimi i 15 praktikave \u00ebsht\u00eb se preventivi i kostos s\u00eb riparimit \u00ebsht\u00eb fryr\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb sforcuar, nd\u00ebrsa preventivi i kostos s\u00eb rind\u00ebrtimit \u00ebsht\u00eb ulur n\u00eb m\u00ebnyr\u00eb t\u00eb sforcuar, me q\u00ebllim rritjen n\u00eb m\u00ebnyr\u00eb fiktive t\u00eb raportit mes tyre p\u00ebr t\u00eb kaluar mas\u00ebn mbi 70%.<\/p>\n\n\n\n<p>Kjo \u00ebsht\u00eb e dukshme n\u00eb pamje t\u00eb par\u00eb dhe rezulton e till\u00eb edhe nga ekspertizat gjyq\u00ebsore dhe jasht\u00eb gjyq\u00ebsore. P\u00ebr ta ilustruar sjellim disa shembuj:<\/p>\n\n\n\n<ul>\n<li>nd\u00ebrsa te preventivi i riparimit evidentohen z\u00ebra t\u00eb panevojsh\u00ebm p\u00ebr riparimin e pallatit si: lulishte, trotuar\u00eb, sisteme kundra mbrojtjes nga zjarri, sisteme qendrore ftohje- ngrohje, etj, nga ana tjet\u00ebr n\u00eb preventivin e kostos s\u00eb rind\u00ebrtimit, jo vet\u00ebm q\u00eb k\u00ebto z\u00ebra&nbsp; mungojn\u00eb, por k\u00ebtu kostoja e vetme q\u00eb paraqitet \u00ebsht\u00eb \u00e7mimi mesatar i nd\u00ebrtimit t\u00eb Entit Komb\u00ebtar t\u00eb Banesave, q\u00eb sh\u00ebrben vet\u00ebm p\u00ebr referenc\u00eb p\u00ebr efekte fiskale dhe nuk paraqet koston reale t\u00eb nd\u00ebrtimit. N\u00eb fakt, kosto e rind\u00ebrtimit p\u00ebrmban edhe z\u00ebra t\u00eb tjer\u00eb, si\u00e7 \u00ebsht\u00eb prishja e objektit ekzistues, transporti i mbetjeve pas prishjes s\u00eb objektit, depozitimi i mbetjeve n\u00eb landfill, apo shpenzime p\u00ebr nd\u00ebrtimin sipas standardeve t\u00eb vendosura nga aktet e dala pas vendosjes s\u00eb \u00e7mimit mesatar t\u00eb nd\u00ebrtimit nga EKB, apo taksa mbi infrastruktur\u00eb, etj. Disa z\u00ebra, qartazi jan\u00eb p\u00ebrjashtuar nga kosto mesatare e EKB, sipas Udh\u00ebzimit t\u00eb K\u00ebshillit t\u00eb Ministrave nr. 3\/2016;<\/li>\n\n\n\n<li>nd\u00ebrsa te preventivi i kostos s\u00eb riparimit evidentohen z\u00ebra si \u201cprishja e suvas\u00eb\u201d n\u00eb pallate q\u00eb nuk kan\u00eb fare suva t\u00eb jashtme, p\u00ebr kontrast te preventivi i kostos s\u00eb rind\u00ebrtimit \u201charrohet\u201d t\u00eb futet z\u00ebri i prishjes s\u00eb objektit, a thua se trualli do ishte i lir\u00eb p\u00ebr nd\u00ebrtim;<\/li>\n\n\n\n<li>n\u00eb preventivat e riparimit jan\u00eb shtuar z\u00ebra t\u00eb panevojsh\u00ebm si g\u00ebrmimi i dheut kur nuk ka nevoja p\u00ebr nd\u00ebrhyrje ne themele, kurse n\u00eb llogaritjen e rind\u00ebrtimit nuk jan\u00eb matur sip\u00ebrfaqet n\u00eb m\u00ebnyr\u00eb korrekte.<\/li>\n\n\n\n<li>disa z\u00ebra t\u00eb shtuar te preventivi i riparimit jan\u00eb t\u00eb paaplikuesh\u00ebm, si sistemet qendrore ftohje-ngrohjes, pasi pallatet e ekspertuar jan\u00eb nd\u00ebrtime t\u00eb vjetra (nd\u00ebrtuar para viteve \u201990) dhe nuk mund t\u00eb akomodojn\u00eb sisteme t\u00eb till\u00eb;<\/li>\n\n\n\n<li>z\u00ebra si punime elektrike dhe hidraulike jan\u00eb paraqitur n\u00eb preventiva t\u00eb riparimit me shifra totale, t\u00eb pamb\u00ebshtetura n\u00eb asnj\u00eb metodologji apo projekt konkret. \u00cbsht\u00eb e pamundur t\u00eb nxirret kosto e instalimeve t\u00eb tilla pa pasur nj\u00eb projekt elektrik dhe hidraulik;<\/li>\n\n\n\n<li>n\u00eb preventivin e kostos s\u00eb riparimit \u00ebsht\u00eb shtuar n\u00eb m\u00ebnyr\u00eb abuzive edhe TVSH prej 20%, nd\u00ebrsa TVSH zbritet p\u00ebr k\u00ebto lloj punimesh sipas VKM nr. 143, dt. 13.02.2020. Madje \u00ebsht\u00eb shtuar pa gjetur mb\u00ebshtetje ligjore n\u00eb disa raste edhe fondi rezerv\u00eb prej 5%, nd\u00ebrkoh\u00eb q\u00eb fondi rezerv\u00eb aplikohet kur nuk ka projekt t\u00eb detajuar, kurse projektet n\u00eb fjal\u00eb pretendohet se jan\u00eb t\u00eb detajuar.<\/li>\n<\/ul>\n\n\n\n<p>T\u00eb gjitha k\u00ebto m\u00eb sip\u00ebr, por edhe t\u00eb tjera abuzime, jan\u00eb konstatuar edhe nga ekspert\u00eb t\u00eb tjer\u00eb t\u00eb pavarur, ose\/edhe nga ekspert\u00eb t\u00eb caktuar nga vet\u00eb gjykata. Gjithsesi, p\u00ebrve\u00e7 provave si m\u00eb sip\u00ebr, t\u00eb gjitha k\u00ebto jan\u00eb fakte t\u00eb cilat jan\u00eb leht\u00ebsisht t\u00eb evidentueshme nga ekspert\u00eb t\u00eb tjer\u00eb t\u00eb fush\u00ebs.<\/p>\n\n\n\n<p>Gjith\u00eb sa \u00ebsht\u00eb konstatuar m\u00eb sip\u00ebr ka qen\u00eb detyr\u00eb ligjore e Institutit t\u00eb Nd\u00ebrtimit t\u2019i evidentoj\u00eb n\u00eb b\u00ebrjen e oponenc\u00ebs teknike, e cila n\u00eb \u00e7do rast duket si \u201cnoterizim\u201d i Aktit t\u00eb Ekspertiz\u00ebs s\u00eb Thelluar. N\u00eb fakt oponencat teknike nuk kan\u00eb realizuar funksionin e tyre dhe kan\u00eb \u201ccertifikuar\u201d fakte t\u00eb pav\u00ebrteta, ndaj n\u00eb ato her\u00eb q\u00eb ato i jan\u00eb n\u00ebnshtruar shqyrtimit gjyq\u00ebsor jan\u00eb shfuqizuar n\u00eb t\u00eb gjith\u00eb rastet.<\/p>\n\n\n\n<p>N\u00ebse oponenca do t\u00eb ishte kryer n\u00eb standardin e duhur, procedura e nisur p\u00ebr prishjen e detyruar t\u00eb pallateve nuk do t\u00eb vazhdonte dhe d\u00ebmi i financave publike dhe t\u00eb drejtave t\u00eb shtetasve nuk do t\u00eb thellohej.<\/p>\n\n\n\n<ul>\n<li><strong>Pasakt\u00ebsia e akt-ekspertizave t\u00eb thelluara, p\u00ebrve\u00e7 d\u00ebmtimit t\u00eb interesave t\u00eb qytetar\u00ebve t\u00eb prekur, sjell pasoj\u00eb shp\u00ebrdorimin e fondeve t\u00eb buxhetit t\u00eb shtetit<\/strong><\/li>\n<\/ul>\n\n\n\n<p>P\u00ebrve\u00e7 d\u00ebmtimit t\u00eb interesave t\u00eb banor\u00ebve t\u00eb prekur t\u00eb pallateve q\u00eb jan\u00eb caktuar p\u00ebr prishje n\u00eb m\u00ebnyr\u00eb abuzive, sipas shpjegimeve t\u00eb dh\u00ebna n\u00eb pik\u00ebn 2 m\u00eb sip\u00ebr, n\u00eb rast se vijon zbatimi i VKB-ve, rrezikohet shp\u00ebrdorimi i fondeve publike.<\/p>\n\n\n\n<p>N\u00ebse akt-ekspertiza e thelluar e porositur nga Bashkia Tiran\u00eb ka nxjerr\u00eb nj\u00eb objekt p\u00ebr prishje dhe kostoja e nd\u00ebrtimit nga e para e nj\u00eb objekti t\u00eb till\u00eb \u00ebsht\u00eb 70-80 milon lek\u00eb (n\u00eb praktik\u00eb mund t\u00eb shkoj\u00eb dy her\u00eb m\u00eb e lart\u00eb), por n\u00eb realitet objekti ka nevoj\u00eb p\u00ebr p\u00ebrforcime n\u00eb vlera 10-20 milion lek\u00eb, at\u00ebher\u00eb kuptohet q\u00eb k\u00ebto vendimmarrje sjellin shp\u00ebrdorim t\u00eb fondeve t\u00eb buxhetit t\u00eb shtetit. Ky i fundit mund t\u00eb p\u00ebrballoj\u00eb ato raste kur realisht ka nevoj\u00eb p\u00ebr nd\u00ebrhyrje dhe jo t\u00eb gjitha rastet q\u00eb n\u00eb m\u00ebnyr\u00eb abuzive jan\u00eb shoq\u00ebruar me fryrje kostosh.<\/p>\n\n\n\n<p>N\u00eb t\u00eb gjith\u00eb rastet e trajtuar n\u00eb Gjykat\u00ebn Administrative t\u00eb Shkall\u00ebs s\u00eb Par\u00eb, Tiran\u00eb, rezulton se kostot e riparimit ishin gjithmon\u00eb m\u00eb t\u00eb ul\u00ebta, madje n\u00eb disa raste shum\u00eb m\u00eb t\u00eb ul\u00ebta. Pas vendimeve gjyq\u00ebsorw p\u00ebr shfuqzimin e VKB-s\u00eb dhe oponencave teknike t\u00eb Institutit t\u00eb Nd\u00ebrtimit, gjykata ka shmangur shp\u00ebrdorimin e fondeve publike.<\/p>\n\n\n\n<p>Kujtojm\u00eb k\u00ebtu q\u00eb n\u00eb gjykat\u00eb kan\u00eb shkuar vet\u00ebm pak raste dhe shumica e VKB-ve nuk i jan\u00eb n\u00ebnshtruar kontrollit gjyq\u00ebsor dhe prandaj \u00ebsht\u00eb e nevojshme t\u2019i n\u00ebnshtrohet auditimit nga KLSH.<\/p>\n\n\n\n<ul>\n<li><strong>Cenimi i t\u00eb drejtave t\u00eb njeriut dhe ekspozimi i buxhetit t\u00eb shtetit ndaj riskut p\u00ebr t\u00eb paguar d\u00ebmshp\u00ebrblime<\/strong><\/li>\n<\/ul>\n\n\n\n<p>VKB-t\u00eb e miratuara n\u00eb baz\u00eb t\u00eb akteve t\u00eb paligjshme t\u00eb p\u00ebrshkruara m\u00eb sip\u00ebr jan\u00eb p\u00ebr pasoj\u00eb t\u00eb paligjshme, e megjithat\u00eb ato 28 raste jan\u00eb ekzekutuar.<\/p>\n\n\n\n<p>N\u00eb \u00e7do rast edhe sikur k\u00ebto vendime t\u00eb ishin t\u00eb ligjshme, ekzekutimi i vendimeve \u00ebsht\u00eb b\u00ebr\u00eb pa njoftime paraprake ndaj banor\u00ebve, pa inventarizuar sendet e luajtsh\u00ebm me procesverbal, pa u siguruar atyre m\u00eb par\u00eb nj\u00eb streh\u00eb sipas normave t\u00eb strehimit dhe n\u00eb p\u00ebrgjith\u00ebsi pa respektuar k\u00ebrkesat ligjore t\u00eb ligjit nr. 22\/2018 \u201cP\u00ebr strehimin Social\u201d si dhe parashikimeve n\u00eb VKM nr. 361, dat\u00eb 29.05.2019, duke shkat\u00ebrruar pron\u00ebn private, sendet private me vler\u00eb monetare e emocionale, banes\u00ebn dhe jetes\u00ebn, n\u00eb m\u00ebnyr\u00eb t\u00eb paligjshme. K\u00ebto lloj shkeljesh n\u00eb vetvete p\u00ebrb\u00ebjn\u00eb d\u00ebm n\u00eb interesa t\u00eb ligjshme t\u00eb shtetasve me kosto t\u00eb pritshme n\u00eb buxhetin e shteti pasi ekspozojn\u00eb buxhetin e shtetit ndaj risqeve shtes\u00eb p\u00ebr shkak t\u00eb d\u00ebmshp\u00ebrblimeve q\u00eb gjykatat do t&#8217;i akordojn\u00eb secilit q\u00eb do t\u00eb k\u00ebrkoj\u00eb n\u00eb rrug\u00eb gjyq\u00ebsore shp\u00ebrblimin e d\u00ebmit. Rasti i par\u00eb \u00ebsht\u00eb ai i \u201cFondacioni Instituti p\u00ebr Inkurajimin Total\u201d<em>, <\/em>i cili zhvillonte aktivitetin e nj\u00eb kishe n\u00eb zon\u00ebn e Kombinatit dhe fitoi d\u00ebmshp\u00ebrblim nga gjykata p\u00ebr prishjen e pron\u00ebs s\u00eb tij n\u00eb pallatin nr. 153 n\u00eb Rrug\u00ebn Sokrat Mosko, vendosur p\u00ebr prishje me VKB nr. 121, dt. 28.09.2020, prishjen e t\u00eb cilit gjykata e konstatoi si nj\u00eb shpron\u00ebsim de facto, n\u00eb kund\u00ebrshtim me ligjin dhe Kushtetut\u00ebn.<\/p>\n\n\n\n<p>N\u00ebse nuk do t\u00eb ket\u00eb rishikim t\u00eb VKB-ve t\u00eb paekzekutuara, d\u00ebmshp\u00ebrblimet n\u00eb potencial t\u00eb t\u00eb gjith\u00eb individ\u00ebve t\u00eb prekur do t\u2019i r\u00ebndojn\u00eb buxhetit t\u00eb shtetit n\u00eb t\u00eb ardhmen.<\/p>\n\n\n\n<ul>\n<li><strong>Individ\u00ebt\/familjet e prekura n\u00eb pallatet e d\u00ebmtuar n\u00eb nivelet DS2-DS3 nuk po p\u00ebrfitojn\u00eb grantet p\u00ebr riparimin, si dhe pallatet e d\u00ebmtuar n\u00eb nivelin DS4, nuk po p\u00ebrforcohet ende, duke ekspozuar qytetar\u00ebt ndaj rrezikut<\/strong><\/li>\n<\/ul>\n\n\n\n<p>T\u00eb gjitha pallatet e shpallura p\u00ebr prishje t\u00eb detyruar mbi fakte t\u00eb pav\u00ebrteta si\u00e7 shpjeguam m\u00eb sip\u00ebr, jan\u00eb gjithsesi t\u00eb d\u00ebmtuara n\u00eb nivelet DS2 &#8211; DS3, e n\u00eb ndonj\u00eb rast DS4, dhe Bashkia Tiran\u00eb ka detyrimin p\u00ebr t\u2019i p\u00ebrfshir\u00eb banor\u00ebt e tyre n\u00eb nj\u00eb program rind\u00ebrtimi, duke i trajtuar me grante, si\u00e7 p\u00ebrshkruhet n\u00eb pik\u00ebn 1 m\u00eb sip\u00ebr. N\u00eb vitin e kat\u00ebrt pas t\u00ebrmetit t\u00eb 26 n\u00ebntorit 2019, mos trajtimi i k\u00ebtyre objekteve dhe banor\u00ebve\/pronar\u00ebve t\u00eb tyre sipas ligjeve, p\u00ebrs\u00ebri mund t\u2019i kushtoj\u00eb kosto gjyq\u00ebsore shtes\u00eb buxhetit t\u00eb shtetit.<\/p>\n\n\n\n<p>N\u00eb ato raste kur objektet jan\u00eb d\u00ebmtuar v\u00ebrtet n\u00eb shkall\u00ebn DS4 dhe kostoja e p\u00ebrforcimit realisht \u00ebsht\u00eb n\u00ebn 70% t\u00eb kostos s\u00eb rind\u00ebrimit, mosriparimi i k\u00ebtyre objekteve sjell situat\u00eb rreziku, duke mos nd\u00ebrhyre ende p\u00ebr p\u00ebrforcimin dhe duke vijuar me kok\u00ebfort\u00ebsi proceset gjyq\u00ebsore, nd\u00ebrkoh\u00eb q\u00eb banor\u00ebt jetojn\u00eb aty gjat\u00eb gjith\u00eb koh\u00ebs.<\/p>\n\n\n\n<p>*&nbsp;&nbsp;&nbsp; *&nbsp;&nbsp;&nbsp; *<\/p>\n\n\n\n<p>N\u00eb p\u00ebrfundim, mund t\u00eb themi n\u00eb m\u00ebnyr\u00eb t\u00eb p\u00ebrmbledhur se rezulton e qart\u00eb q\u00eb Bashkia Tiran\u00eb, s\u00eb bashku me Institutin e Nd\u00ebrtimit dhe K\u00ebshillin Bashkiak Tiran\u00eb n\u00eb efekt zinxhir dhe n\u00eb dukje me nj\u00eb dakord\u00ebsi t\u00eb dyshuar paraprake mes tyre, ka vendosur p\u00ebr prishjen e objekteve q\u00eb ligji nuk parashikon prishjen, duke u mb\u00ebshtetur n\u00eb fakte t\u00eb pasakta lidhur me shkall\u00ebn e lart\u00eb t\u00eb d\u00ebmtimit.<\/p>\n\n\n\n<p>Edhe sikur shkalla e d\u00ebmtimit t\u00eb ishte ajo e pretendura nga k\u00ebto institucione, p\u00ebrs\u00ebri k\u00ebto t\u00eb fundit nuk kan\u00eb ruajtur nj\u00eb ekuilib\u00ebr t\u00eb drejt\u00eb gjat\u00eb llogaritjeve p\u00ebr t\u00eb konkluduar p\u00ebr raportin mes kostos s\u00eb riparimit me at\u00eb t\u00eb rind\u00ebrtimit. Vihet re se q\u00ebllimisht nga nj\u00ebra an\u00eb fryhet preventivi i riparimeve n\u00eb m\u00ebnyr\u00eb artificiale, duke llogaritur edhe z\u00ebra t\u00eb paaplikuesh\u00ebm dhe\/ose t\u00eb panevojsh\u00ebm dhe nga ana tjet\u00ebr zvog\u00eblohet preventivi i rind\u00ebrtimit duke hequr edhe kosto t\u00eb dukshme t\u00eb domosdoshme.<\/p>\n\n\n\n<p>Gjithashtu mund t\u00eb shmangen pasojat negative p\u00ebr buxhetin e shtetit n\u00eb rastin e pezullimit t\u00eb ekzekutimit t\u00eb vendimeve ende n\u00eb fuqi deri n\u00eb rishikimin e tyre, nga ana e K\u00ebshillit Bashkiak si &nbsp;dhe kategorizimi i duhur i dh\u00ebnies s\u00eb granteve sipas shkall\u00ebs s\u00eb d\u00ebmtimit real q\u00eb kan\u00eb p\u00ebsuar k\u00ebto pallate.<\/p>\n\n\n\n<p>Neni 10 i ligjit nr. 154\/2014 \u201cP\u00ebr organizimin dhe funksionimin e kontrollit t\u00eb lart\u00eb t\u00eb shtetit\u201d, parashikon si nj\u00eb nga kompetencat e KLSH edhe kryerjen e auditimit objekt i k\u00ebtij sinjalizimi.<\/p>\n\n\n\n<p>P\u00ebr t\u00eb gjitha sa m\u00eb sip\u00ebr i drejtohemi institucionit q\u00eb Ju drejtoni, me k\u00ebrkes\u00ebn q\u00eb t\u00eb ushtroj\u00eb t\u00eb gjitha kompetencat q\u00eb i njeh ligji p\u00ebr t\u00eb ushtruar kontroll mbi k\u00ebt\u00eb pjes\u00eb t\u00eb veprimtaris\u00eb s\u00eb Bashkis\u00eb Tiran\u00eb dhe Institutit t\u00eb Nd\u00ebrtimit.<\/p>\n\n\n\n<p>Me respekt,<\/p>\n\n\n\n<p>Qendra Res Publica<\/p>\n\n\n\n<p>Grupimi p\u00ebr Kombinatin<\/p>\n\n\n\n<p><em>* Kjo let\u00ebr e hapur u realizua n\u00eb kuad\u00ebr t\u00eb projektit\u00a0\u201cP\u00ebr nj\u00eb proces rind\u00ebrtimi m\u00eb t\u00eb p\u00ebrgjegjsh\u00ebm\u201d\u00a0t\u00eb mb\u00ebshtur nga LevizAlbania, nj\u00eb projekt i Agjencis\u00eb Zvicerane p\u00ebr Zhvillim dhe Bashk\u00ebpunim, SDC.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Drejtuar:&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;
