K\u00ebshilli Bashkiak i Tiran\u00ebs vendosi p\u00ebr prishjen e detyruar t\u00eb nd\u00ebrtes\u00ebs, si rezultat i d\u00ebmtimit nga t\u00ebrmeti i dat\u00ebs 26 n\u00ebntor 2019. Ky vendim u bazua mbi analiz\u00ebn teknike nga Instituti i Nd\u00ebrtimit dhe Bashkia Tiran\u00eb, t\u00eb cilat pretenduan se shkalla e d\u00ebmtimit t\u00eb pallatit ishte e lart\u00eb dhe me kosto t\u00eb larta rind\u00ebrtimi, pra hajde ta zhdukim.<\/p>\n\n\n\n<p>Pasi u njoh\u00ebn me k\u00ebt\u00eb vendim, n\u00eb n\u00ebntor 2022 disa banor\u00eb t\u00eb pallatit k\u00ebrkuan hartimin e nj\u00eb plani ekspertimi pran\u00eb nj\u00eb studioje projektimi, nga i cili rezultoi se faktet n\u00eb t\u00eb cilat \u00ebsht\u00eb bazuar vendimi i KB ishin qartazi t\u00eb pav\u00ebrteta. Sipas k\u00ebtij vler\u00ebsimi, shkalla e d\u00ebmtimit t\u00eb pallatit nuk ishte e lart\u00eb si\u00e7 pretendohej.<\/p>\n\n\n\n<p>K\u00ebtu vlen t\u00eb sqarojm\u00eb shkurtimisht parashikimin e ligjit mbi trajtimin e shkall\u00ebs s\u00eb d\u00ebmtimit t\u00eb nd\u00ebrtesave nga t\u00ebrmeti. D\u00ebmet vler\u00ebsohen n\u00eb grupe sipas shkall\u00ebs s\u00eb d\u00ebmtimit nga DS1 n\u00eb DS5, ku DS1 \u00ebsht\u00eb shkalla m\u00eb e leht\u00eb e d\u00ebmtimit dhe DS5 m\u00eb e larta, kur objekti \u00ebsht\u00eb n\u00eb rrezik shembjeje. Shkalla e d\u00ebmtimit p\u00ebrcakton edhe se n\u00eb cilin program t\u00eb rind\u00ebrtimit do t\u00eb p\u00ebrfshihet objekti si dhe vler\u00ebn e kompensimit t\u00eb pronar\u00ebve. N\u00eb rastin konkret, K\u00ebshilli Bashkiak pretendoi se niveli i d\u00ebmit \u00ebsht\u00eb DS4, nd\u00ebrsa nga ekspertiza private rezultoi se d\u00ebmi hyn n\u00eb kategorin\u00eb DS2, pra nj\u00eb shkall\u00eb e ul\u00ebt d\u00ebmtimi q\u00eb k\u00ebrkon nj\u00eb fond riparimi n\u00eb shum\u00ebn prej 18,000,000 lek\u00eb.<\/p>\n\n\n\n<p>Nd\u00ebrkoh\u00eb, ligji parashikon se n\u00ebse pas studimit t\u00eb thelluar nd\u00ebrhyrjet p\u00ebr riparimin e struktur\u00ebs kushtojn\u00eb m\u00eb shum\u00eb se 70% e kostos s\u00eb rind\u00ebrtimit nga e para e nd\u00ebrtes\u00ebs, autoriteti p\u00ebrgjegj\u00ebs vendos shembjen e detyruar t\u00eb objektit. Pra edhe sikur vler\u00ebsimi ana e autoriteteve t\u00eb ishte i sakt\u00eb, pallati duhet t\u00eb prishej vet\u00ebm me kushtin e sapop\u00ebrmendur, gj\u00eb q\u00eb duhet t\u00eb provohej nga autoritetet.<\/p>\n\n\n\n<p>Me nj\u00eb shkelje t\u00eb qart\u00eb t\u00eb ligjit t\u00eb m\u00ebsip\u00ebrm dhe pa u konsultuar m\u00eb par\u00eb me banor\u00ebt, Bashkia vijoi me prishjen e pallatit. L.U. s\u00eb bashku me familjen e tij ndodhej prej disa koh\u00ebsh n\u00eb Itali dhe nuk ishte n\u00eb dijeni t\u00eb k\u00ebtij vendimi. Ai \u00ebsht\u00eb njoftuar q\u00eb t\u00eb \u201cngrej\u00eb leckat\u201d vet\u00ebm dy dit\u00eb p\u00ebrpara demolimit s\u00eb pallatit me telefon nga nj\u00eb punonj\u00ebs i Nj\u00ebsis\u00eb Bashkiake.<\/p>\n\n\n\n<p>Pasi mori masat t\u00eb kthehej n\u00eb Shqip\u00ebri dy dit\u00eb pasi mori njoftimin, L.U. e gjeti pallatin ku banonte t\u00eb rrethuar nga forca policore e me shkall\u00ebt n\u00eb shkat\u00ebrrim e sip\u00ebr. Forcat e policis\u00eb nuk e kan\u00eb lejuar t\u00eb marr\u00eb as sendet personale n\u00eb banes\u00eb.<\/p>\n\n\n\n<p>Disa dit\u00eb m\u00eb par\u00eb, banor\u00ebt e pallatit ishin njoftuar p\u00ebrmes nj\u00eb shpalljeje nga ana e bashkis\u00eb se vendimi i KB do t\u00eb ekzekutohej n\u00eb dt. 19 dhjetor 2022. Kjo i b\u00ebri banor\u00ebt t\u2019i drejtohen gjykat\u00ebs me nj\u00eb k\u00ebrkes\u00eb p\u00ebr mas\u00eb sigurim padie dhe mas\u00eb sigurim prove me q\u00ebllim q\u00eb t\u2019i shmangeshin pasojave t\u00eb pakthyeshme.<\/p>\n\n\n\n<p>Gjykata vendosi t\u2019i shqyrtoj\u00eb k\u00ebrkesat n\u00eb dt. 19 dhjetor, ora 9:00. Po k\u00ebt\u00eb dit\u00eb n\u00eb or\u00ebt e para t\u00eb m\u00ebngjesit, rreth or\u00ebs 4, fadromat e bashkis\u00eb kan\u00eb mb\u00ebrritur p\u00ebr shembjen e pallatit duke e finalizuar k\u00ebt\u00eb p\u00ebrpara shqyrtimit gjyq\u00ebsor t\u00eb or\u00ebs 9:00. Gjykata e rr\u00ebzoi k\u00ebrkes\u00ebn e banor\u00ebve duke qen\u00eb se vendimi kishte filluar t\u00eb ekzekutohej. Duke qen\u00eb n\u00eb dijeni t\u00eb k\u00ebrkes\u00ebs s\u00eb banor\u00ebve, bashkia ka nxituar t\u00eb prish\u00eb pallatin brenda nj\u00eb kohe rekord duke mbuluar dhe provat.<\/p>\n\n\n\n<p>P\u00ebrve\u00e7 vler\u00ebsimit t\u00eb gabuar mbi d\u00ebmtimin e pallatit, ekziston nj\u00eb standard n\u00eb legjislacionin p\u00ebr strehimin mbi m\u00ebnyr\u00ebn se si kryhet zhvendosja e banor\u00ebve n\u00eb raste t\u00eb tilla. Ky standard, q\u00eb p\u00ebrputhet me standardet nd\u00ebrkomb\u00ebtare, \u00ebsht\u00eb rekomanduar edhe me kontributin e avokat\u00ebve t\u00eb qendr\u00ebs \u201cRes Publica\u201d n\u00eb vitin 2017, ku p\u00ebr her\u00eb t\u00eb par\u00eb n\u00eb legjislacion u prezantua koncepti i ndalimit t\u00eb d\u00ebbimit t\u00eb banor\u00ebve dhe u vendos\u00ebn rregulla strikte se si duhet t\u00eb kryhet zhvendosja e tyre, n\u00eb ato raste kur zhvendosja \u00ebsht\u00eb e detyrueshme p\u00ebr t\u00eb mbrojtur nj\u00eb interes publik.<\/p>\n\n\n\n<p>Raste d\u00ebbimesh jan\u00eb konstatuar m\u00eb par\u00eb de facto n\u00eb komunitetet rome. Nd\u00ebrsa \u00e7\u00ebshtja n\u00eb fjal\u00eb \u00ebsht\u00eb rasti kur d\u00ebbimi po ndodh edhe <em>de jure<\/em>.<\/p>\n\n\n\n<p>Qytetari L.U. vendosi t\u2019i drejtohet gjykat\u00ebs me p\u00ebrfaq\u00ebsimin e avokat\u00ebve t\u00eb qendr\u00ebs \u201cRes Publica\u201d p\u00ebr t\u00eb konstatuar paligjshm\u00ebrin\u00eb e VKB p\u00ebr prishje t\u00eb detyruar t\u00eb nd\u00ebrtes\u00ebs, por edhe paligjshm\u00ebrin\u00eb e procedur\u00ebs s\u00eb zhvendosjes s\u00eb banor\u00ebve duke k\u00ebrkuar edhe d\u00ebmshp\u00ebrblimin p\u00ebrkat\u00ebs.
