{"id":2846,"date":"2023-12-18T16:47:57","date_gmt":"2023-12-18T15:47:57","guid":{"rendered":"https:\/\/www.respublica.org.al\/?p=2846"},"modified":"2023-12-18T16:58:26","modified_gmt":"2023-12-18T15:58:26","slug":"fitohet-beteja-e-banoreve-te-pallatit-myslym-keta-kunder-bashkise-se-tiranes-gjykata-rrezon-vendimin-e-keshillit-bashkiak-per-prishjen-e-nderteses","status":"publish","type":"post","link":"https:\/\/www.respublica.org.al\/web\/?p=2846","title":{"rendered":"Fitohet beteja e banor\u00ebve t\u00eb pallatit n\u00eb rrug\u00ebn \u201cMyslym Keta\u201d kund\u00ebr Bashkis\u00eb s\u00eb Tiran\u00ebs: Gjykata rr\u00ebzon vendimin e K\u00ebshillit Bashkiak p\u00ebr prishjen e nd\u00ebrtes\u00ebs"},"content":{"rendered":"\n<p>Gjykata Administrative e Tiran\u00ebs pranoi k\u00ebrkes\u00ebn e banor\u00ebve t\u00eb pallatit 183\/1 n\u00eb rrug\u00ebn \u201cMyslym Keta\u201d dhe rr\u00ebzoi vendimin e K\u00ebshillit Bashkiak t\u00eb dat\u00ebs 24 n\u00ebntor 2021 p\u00ebr prishjen e detyruar t\u00eb nd\u00ebrtes\u00ebs.<\/p>\n\n\n\n<p>Ky vendim ishte marr\u00eb nga K\u00ebshilli Bashkiak i Tiran\u00ebs si rezultat i d\u00ebmtimit t\u00eb pallatit nga t\u00ebrmeti i dat\u00ebs 26 n\u00ebntor 2019, bazuar mbi akt ekspertiz\u00ebn e Bashkis\u00eb Tiran\u00eb dhe oponenc\u00ebn teknike t\u00eb Institutit t\u00eb Nd\u00ebrtimit, t\u00eb cilat pretenduan se shkalla e d\u00ebmtimit t\u00eb pallatit ishte e lart\u00eb dhe me kosto t\u00eb larta rind\u00ebrtimi.<\/p>\n\n\n\n<p>N\u00eb n\u00ebntor 2022, banor\u00eb t\u00eb pallatit k\u00ebrkuan hartimin e dy akt ekspertizave nga studio projektimi private, nga t\u00eb cilat rezultuan se faktet n\u00eb t\u00eb cilat \u00ebsht\u00eb bazuar Vendimi i K\u00ebshillit Bashkiak ishin t\u00eb pav\u00ebrteta. Sipas k\u00ebtij vler\u00ebsimi, shkalla e d\u00ebmtimit t\u00eb pallatit nuk ishte e lart\u00eb si\u00e7 pretendohej.<\/p>\n\n\n\n<p>Nd\u00ebrkoh\u00eb, n\u00eb shkelje t\u00eb&nbsp;legjislacionin p\u00ebr strehimin mbi m\u00ebnyr\u00ebn se si kryhet zhvendosja e banor\u00ebve n\u00eb raste t\u00eb tilla (n\u00eb hartimin e t\u00eb cilit ka kontribuar edhe qendra \u201cRes Publica\u201d), banor\u00ebt jan\u00eb d\u00ebbuar nga sht\u00ebpit\u00eb e tyre pa asnj\u00eb lloj konsultimi p\u00ebrmes nj\u00eb njoftimi disa dit\u00eb p\u00ebrpara demolimit t\u00eb pallatit.<\/p>\n\n\n\n<p>N\u00eb k\u00ebrkesat ndaj Gjykat\u00ebs Administrative t\u00eb Tiran\u00ebs, avokat\u00ebt e qendr\u00ebs \u201cRes Publica\u201d i paraqit\u00ebn gjykat\u00ebs analiz\u00ebn ligjore si vijon:<\/p>\n\n\n\n<ul>\n<li>Vendimarrja p\u00ebr prishjen e pallatit \u00ebsht\u00eb \u201ce keqinformuar\u201d n\u00eb rastin m\u00eb t\u00eb mir\u00eb dhe n\u00eb keqbesim n\u00eb \u00e7do rast tjet\u00ebr, pasi \u00ebsht\u00eb kryer pa nj\u00eb akt konstatimi paraprak p\u00ebr vler\u00ebsimin e pallatit t\u00eb d\u00ebmtuar nga Instituti i Nd\u00ebrtimit (k\u00ebrkes\u00eb ligjore), nd\u00ebrkoh\u00eb q\u00eb nuk ka asnj\u00eb prov\u00eb q\u00eb tregon d\u00ebmtime t\u00eb pallatit (fotografi, etj).<\/li>\n\n\n\n<li>Vendimet jan\u00eb marr\u00eb bazuar n\u00eb fakte t\u00eb rreme. Ndryshe nga sa pretendohet n\u00eb to, pallati nuk \u00ebsht\u00eb d\u00ebmtuar n\u00eb shkall\u00ebn DS4 por DS1 (pra shkall\u00eb e ul\u00ebt d\u00ebmtimi) dhe raporti mes kostos s\u00eb rind\u00ebrtimit dhe kostos s\u00eb riforcimit \u00ebsht\u00eb n\u00ebn kufirin 70%, kriter ligjor p\u00ebr vendimin e prishjes s\u00eb nj\u00eb objekti. Gjat\u00eb k\u00ebtij gjykimi, ekspertja e caktuar nga gjykata pati p\u00ebr detyr\u00eb t\u00eb vler\u00ebsonte shkall\u00ebn e d\u00ebmtimit t\u00eb pallatit, dhe sipas saj d\u00ebmtimi i objektit \u00ebsht\u00eb n\u00eb nivelin DS1. I nj\u00ebjti vler\u00ebsim \u00ebsht\u00eb b\u00ebr\u00eb nga 2 akt ekspertiza private t\u00eb marra si prova, ku 3 ekspert\u00eb konfirmojn\u00eb se shkalla e d\u00ebmtimit t\u00eb pallatit ka rezultuar po n\u00eb nivelin DS1.<\/li>\n\n\n\n<li>Pala e paditur nuk u konsultua me banor\u00ebt p\u00ebr vendimarrjen, madje Vendimi i K\u00ebshillit Bashkiak nuk iu njoftua banor\u00ebve nga ana e Bashkis\u00eb Tiran\u00eb dhe K\u00ebshillit Bashkiak. Nj\u00eb vendimarrje e till\u00eb nga ana e Bashkis\u00eb Tiran\u00eb, ku konsultimi me banor\u00ebt duhet t\u00eb ishte b\u00ebr\u00eb para, gjat\u00eb dhe pas vendimit p\u00ebr shkat\u00ebrrimin e pron\u00ebs, \u00ebsht\u00eb n\u00eb shkelje t\u00eb ligjit p\u00ebr t\u00eb drejt\u00ebn e pron\u00ebs.<\/li>\n<\/ul>\n\n\n\n<p>P\u00ebr arsyet e parashtruara, k\u00ebrkesat Gjykat\u00ebs Administrative t\u00eb Shkall\u00ebs s\u00eb Par\u00eb i jan\u00eb paraqitur k\u00ebto k\u00ebrkesa:<\/p>\n\n\n\n<ul>\n<li>Shfuqizimi i Vendimit nr.154 dat\u00eb 24.11.2021 t\u00eb K\u00ebshillit Bashkiak t\u00eb Tiran\u00ebs \u201cP\u00ebr prishjen e detyruar t\u00eb nd\u00ebrtes\u00ebs private (pallati nr.83\/1 rruga \u201cMyslym Keta\u201d), si rezultat i d\u00ebmtimit nga t\u00ebrmeti i dat\u00ebs 26 n\u00ebntor 2019\u201d, lidhur me nj\u00ebsin\u00eb n\u00eb pron\u00ebsi t\u00eb padit\u00ebsit.<\/li>\n\n\n\n<li>Shfuqizimi i Oponenc\u00ebs Teknike t\u00eb akt-ekspertiz\u00ebs s\u00eb thelluar nr. 566\/3 prot. dat\u00eb 26.05.2021 t\u00eb Institutit t\u00eb Nd\u00ebrtimit, lidhur me nj\u00ebsin\u00eb n\u00eb pron\u00ebsi t\u00eb padit\u00ebsit.<\/li>\n<\/ul>\n\n\n\n<p>Gjykata Administrative e Tiran\u00ebs i pranoi k\u00ebrkesat e avokat\u00ebve t\u00eb qendr\u00ebs \u201cRes Publica\u201d, nd\u00ebrkoh\u00eb q\u00eb vendimi zyrtar pritet t\u00eb shpallet n\u00eb muajin janar.<\/p>\n\n\n\n<p>Kjo \u00e7\u00ebshtje tregon edhe nj\u00eb her\u00eb se kur qytetar\u00ebt b\u00ebhen bashk\u00eb p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb tyre kund\u00ebr paligjshm\u00ebris\u00eb, dhe i adresojn\u00eb ato n\u00eb rrug\u00ebn e duhur, mund t\u00eb fitojn\u00eb.<\/p>\n\n\n\n<p>Res Publica<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gjykata
