Themeltar, q\u00eb u p\u00ebrket pal\u00ebve:<\/p>\n<p><b>\u00a0<\/b><\/p>\n<p><b>PADIT\u00cbS<\/b>:\u00a0 \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 L\u00ebvizja Mjaft, perfaqesuar nga Dorian Matlija,<\/p>\n<p><b>\u00a0<\/b><\/p>\n<p><b>I PADITUR<\/b>:\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Kuvendi i Shqip\u00ebris\u00eb, p\u00ebrfaq\u00ebsuar nga Gazmend Bici,<\/p>\n<p>&nbsp;<\/p>\n<p><b>OBJEKTI<\/b>:\u00a0 \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Detyrim p\u00ebr dh\u00ebnie informacioni.<\/p>\n<p>&nbsp;<\/p>\n<p><b>BAZA LIGJORE<\/b>: \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Nenet 324 e vijues t\u00eb Kodit t\u00eb Procedur\u00ebs Civile, Ligji Nr. 8503\/1999 \u201cP\u00ebr t\u00eb drejt\u00ebn e informimit p\u00ebr dokumentat zyrtare\u201d, Ligji 9643\/2006 \u201cPer prokurimin publik\u201d,<\/p>\n<p>&nbsp;<\/p>\n<p>Gjykata konstatoi se ceshtja \u00ebsht\u00eb n\u00eb juridiksionin gjyq\u00ebsor dhe n\u00eb kompetenc\u00eb t\u00eb k\u00ebsaj gjykate, degjoi konkluzionet p\u00ebrfundimtare t\u00eb pal\u00ebve, t\u00eb cilat k\u00ebrkuan:<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li>Padit\u00ebsi k\u00ebrkoi pranimin e padis\u00eb,<\/li>\n<li>Pala e paditur k\u00ebrkoi rr\u00ebzimin e padis\u00eb,<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>dhe, pasi shqyrtoi provat dhe e bisedoi c\u00ebshtjen n\u00eb t\u00ebr\u00ebsi,<\/p>\n<p align=\"center\"><b>\u00a0<\/b><\/p>\n<p align=\"center\"><b>V\u00cbREN:<\/b>.<\/p>\n<p>&nbsp;<\/p>\n<p>Pala padit\u00ebse \u00ebsht\u00eb person juridik i regjistruar pran\u00eb Gjykat\u00ebs se rrethit gjyqsor Tiran\u00eb me Vendimin Nr.288 dat\u00eb 26.01.2006, me objekt veprimtarie rritjen e qytetaris\u00eb aktive, forcimi i komuniteteve, p\u00ebrmir\u00ebsimi i imazhit te vendit etj.<\/p>\n<p>&nbsp;<\/p>\n<p>Pala padit\u00ebse m\u00eb dat\u00eb 05.12.2011 i ka k\u00ebrkuar Kuvendit t\u00eb Shqip\u00ebris\u00eb informacion n\u00eb lidhje me :<\/p>\n<p>&nbsp;<\/p>\n<p>Raportin e Auditit t\u00eb Brendsh\u00ebm p\u00ebr vitet 2009 dhe 2010.<\/p>\n<p>&nbsp;<\/p>\n<p>Projekt buxhetin vjetor t\u00eb Kuvendit t\u00eb Shqip\u00ebris\u00eb t\u00eb miratuar nga Ministria e Financave p\u00ebr vitet 2009-2010.<\/p>\n<p>&nbsp;<\/p>\n<p>Tenderin publik q\u00eb ka patur si q\u00ebllim Rikonstruksionin e Godin\u00ebs ekzistuese t\u00eb Kuvendit.<\/p>\n<p>&nbsp;<\/p>\n<p>Tenderin publik q\u00eb ka patur si q\u00ebllim Rikonstruksionin e Sall\u00ebs s\u00eb Seancave Plenare.<\/p>\n<p>&nbsp;<\/p>\n<p>Tenderin publik q\u00eb ka patur si q\u00ebllim Mobilimin e Sall\u00ebs s\u00eb Seancave Plenare.<\/p>\n<p>&nbsp;<\/p>\n<p>Buxheti faktik i Kuvendit t\u00eb Shqip\u00ebris\u00eb p\u00ebr vitin 2009-2011.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>Mir\u00ebpo pala e paditur nuk i ka kthyer p\u00ebrgjigje pal\u00ebs padit\u00ebse p\u00ebr nj\u00eb koh\u00eb t\u00eb gjat\u00eb. Pala padit\u00ebse pasi ka pritur p\u00ebr nj\u00eb koh\u00eb t\u00eb gjat\u00eb p\u00ebrgjigje nga Kuvendi i Shqip\u00ebris\u00eb, i \u00ebsht\u00eb drejtuar gjykat\u00ebs me padi gjyq\u00ebsore p\u00ebr t\u00eb detyruar pal\u00ebn e paditur p\u00ebr dh\u00ebnie informacioni.<\/p>\n<p>&nbsp;<\/p>\n<p>Pala padit\u00ebse ka pretenduar se pala e paditur nuk ka respektuar ligjin p\u00ebr dh\u00ebnie informacioni pa asnj\u00eb shkak t\u00eb ligjsh\u00ebm. Pala padit\u00ebse ka k\u00ebrkuar. Cdo individ apo person juridik ka te drejt\u00eb t\u00eb informohet p\u00ebr aktivitetin e institucioneve shtet\u00ebore. Asnj\u00eb institucion shtet\u00ebror nuk mund t\u00eb refuzoj\u00eb t\u00eb jap\u00eb informacion p\u00ebrvec rasteve t\u00eb informacioneve t\u00eb klasifikuara. C\u00ebnimi i k\u00ebsaj t\u00eb drejte \u00ebsht\u00eb nj\u00eb d\u00ebmtim i r\u00ebnd\u00eb i besimit publik mbi institucionet.<\/p>\n<p>&nbsp;<\/p>\n<p>Pala e paditur ka pretenduar se ajo ka dh\u00ebn\u00eb informacionin e k\u00ebrkuar nga pala padit\u00ebse. Ky informacion \u00ebsht\u00eb dh\u00ebn\u00eb p\u00ebr cdo pik\u00eb q\u00eb ka k\u00ebrkuar pala padit\u00ebse. Pala padit\u00ebse mund t\u00eb marr\u00eb informacion nga p\u00ebr cdo aktivitet t\u00eb Kuvendit t\u00eb Shqip\u00ebris\u00eb. Ky informacion gjendet n\u00eb m\u00ebnyr\u00eb t\u00eb plot\u00eb n\u00eb faqen e internetit t\u00eb Kuvendit p\u00ebr cdo aktivitetet t\u00eb kryer nga Kuvendi i Shqip\u00ebris\u00eb. Pala e paditur ka pretenduar se ato kan\u00eb sjell\u00eb n\u00eb k\u00ebt\u00eb proces gjyq\u00ebsor t\u00eb gjith\u00eb informacionin e nevojsh\u00ebm q\u00eb ka k\u00ebrkuar pala padit\u00ebse. Mir\u00ebpo pala padit\u00ebse ka refuzuar k\u00ebt\u00eb informacion pa dh\u00ebn\u00eb asnj\u00eb arsye. Ato nuk kan\u00eb pranuar asnj\u00eb dokument q\u00eb Kuvendi i Shqip\u00ebris\u00eb ka paraqitur n\u00eb seancat gjyq\u00ebsore.<\/p>\n<p>&nbsp;<\/p>\n<p>Kushtetuta e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, n\u00eb nenin 42 t\u00eb saj, parashikon se:<\/p>\n<p>&nbsp;<\/p>\n<p><i>\u201cKushdo p\u00ebr mbrojtjen e t\u00eb drejtave, t\u00eb lirive dhe interesave t\u00eb tij kushtetuese dhe ligjore, ka t\u00eb drejt\u00ebn e nj\u00eb gjykimi t\u00eb drejt\u00eb dhe publik brenda nj\u00eb afati t\u00eb arsyesh\u00ebm nga nj\u00eb gjykat\u00eb e pavarur dhe e paanshme e caktuar me ligj\u201d. <\/i><\/p>\n<p>&nbsp;<\/p>\n<p>Ky parashikim kushtetues \u00ebsht\u00eb n\u00eb t\u00eb nj\u00ebjt\u00ebn linj\u00eb me neni 6 t\u00eb Konvent\u00ebs Europiane p\u00ebr Mbrojtjen e t\u00eb Drejtave t\u00eb Njeriut dhe Lirive Themelore:<\/p>\n<p>&nbsp;<\/p>\n<p><i>\u201cCdo person ka t\u00eb drejt\u00eb q\u00eb c\u00ebshtja e tij t\u00eb d\u00ebgjohet drejt\u00ebsisht, publikisht dhe brenda nj\u00eb afati t\u00eb arsyesh\u00ebm nga nj\u00eb gjykat\u00eb e pavarur dhe e paanshme, e krijuar me ligj, e cila do t\u00eb vendos\u00eb si p\u00ebr mosmarr\u00ebveshjet n\u00eb lidhje me t\u00eb drejtat dhe detyrimet e tij t\u00eb natyr\u00ebs civile, ashtu edhe p\u00ebr bazueshm\u00ebrin\u00eb e cdo akuze t\u00eb natyr\u00ebs penale q\u00eb i \u00ebsht\u00eb drejtuar\u201d. <\/i><\/p>\n<p>&nbsp;<\/p>\n<p>Nd\u00ebrkoh\u00eb, gjykatat detyrohen edhe nga neni 44 i Kushtetut\u00ebs, sipas t\u00eb cilit:<\/p>\n<p>&nbsp;<\/p>\n<p><i>\u201cKushdo ka t\u00eb drejt\u00eb t\u00eb rehabilitohet dhe\/ose t\u00eb zhd\u00ebmtohet n\u00eb p\u00ebrputhje me ligjin, n\u00eb rast se \u00ebsht\u00eb d\u00ebmtuar p\u00ebr shkak t\u00eb nj\u00eb akti, veprimi ose mosveprimi t\u00eb paligjsh\u00ebm t\u00eb organeve shtet\u00ebrore.<\/i><\/p>\n<p>&nbsp;<\/p>\n<p>P\u00ebr sa m\u00eb sip\u00ebr, vendimi objekt shqyrtimi do t\u00eb trajtohet nga gjykata si cdo akt administrativ.\u00a0 N\u00eb nenin 325 t\u00eb Kodit t\u00eb Procedur\u00ebs Civile parashikohet, nd\u00ebr t\u00eb tjera, se:<\/p>\n<p><i>\u00a0<\/i><\/p>\n<p><i>\u201cPadia, sipas nenit 324 t\u00eb k\u00ebtij Kodi, mund t\u00eb ngrihet kur padit\u00ebsi argumenton se akti administrativ \u00ebsht\u00eb i paligjsh\u00ebm dhe se <b>atij i c\u00ebnohen interesat dhe t\u00eb drejtat e tij n\u00eb m\u00ebnyr\u00eb t\u00eb drejt\u00ebp\u00ebrdrejt\u00eb<\/b> ose t\u00ebrthorazi, individualisht ose n\u00eb m\u00ebnyr\u00eb kolektive&#8230;\u201d<\/i><i><\/i><\/p>\n<p>&nbsp;<\/p>\n<p>N\u00eb nenin 3 t\u00eb Ligjit Nr.8503 dat\u00eb 30.06.1999 \u201cP\u00ebr t\u00eb drejt\u00ebn e informimit p\u00ebr dokumentat zyrtare\u201d parashikohet se<\/p>\n<p>&nbsp;<\/p>\n<p>E drejta e informimit<\/p>\n<p>&nbsp;<\/p>\n<p><i>\u00c7do person ka te drejte te k\u00ebrkoj\u00eb informacion p\u00ebr dokumentet zyrtare, qe kane te b\u00ebjn\u00eb me veprimtarin\u00eb e organeve shtet\u00ebrore dhe te personave qe ushtrojn\u00eb funksione shtet\u00ebrore, pa qene i detyruar te shpjegoje motivet.<\/i><\/p>\n<p><i>\u00a0<\/i><\/p>\n<p><i>Autoriteti publik \u00ebsht\u00eb i detyruar te jap\u00eb \u00e7do informacion ne lidhje me nj\u00eb dokument zyrtar, p\u00ebrve\u00e7 rasteve kur me ligj parashikohet ndryshe.<\/i><\/p>\n<p><i>\u00a0<\/i><\/p>\n<p><i>\u00c7do informacion p\u00ebr nj\u00eb dokument zyrtar, qe i \u00ebsht\u00eb dh\u00ebn\u00eb nj\u00eb personi, nuk mund t&#8217;i refuzohet asnj\u00eb personi tjet\u00ebr qe e k\u00ebrkon at\u00eb, me p\u00ebrjashtim te rastit kur ky informacion p\u00ebrb\u00ebn te dh\u00ebna vetjake te vete personit, te cilit i \u00ebsht\u00eb dh\u00ebn\u00eb informacioni.<\/i><\/p>\n<p>&nbsp;<\/p>\n<p>N\u00eb nenin 4 t\u00eb Ligjit Nr.8503 dat\u00eb 30.06.1999 \u201cP\u00ebr t\u00eb drejt\u00ebn e informimit p\u00ebr dokumentat zyrtare\u201d parashikohet se<\/p>\n<p>&nbsp;<\/p>\n<p><i>N\u00ebse informacioni i k\u00ebrkuar p\u00ebr nj\u00eb dokument zyrtar kufizohet me ligj, autoriteti publik i l\u00ebshon k\u00ebrkuesit nj\u00eb deklarate me shkrim, ne te cil\u00ebn tregohen arsyet e mosdh\u00ebnies se informacionit dhe rregullat ne baze te te cilave ai mund ta k\u00ebrkoj\u00eb at\u00eb.<\/i><\/p>\n<p>N\u00eb nenin 7 t\u00eb Ligjit Nr.8503 dat\u00eb 30.06.1999 \u201cP\u00ebr t\u00eb drejt\u00ebn e informimit p\u00ebr dokumentat zyrtare\u201d parashikohet se<\/p>\n<p>&nbsp;<\/p>\n<p>Format e dh\u00ebnies se informacionit<\/p>\n<p>&nbsp;<\/p>\n<p><i>K\u00ebrkuesit i vihet ne dispozicion nj\u00eb kopje e plote e dokumentit zyrtar, p\u00ebr te cilin k\u00ebrkon te informohet. Autoriteti publik, me k\u00ebrkes\u00eb te personit te interesuar ose duke sugjeruar vete, mund t&#8217;i ofroje k\u00ebrkuesit forma te tjera te dh\u00ebnies se informacionit, p\u00ebrfshi form\u00ebn verbale. Ne \u00e7do rast te tille, k\u00ebrkuesi jep me shkrim p\u00eblqimin p\u00ebr form\u00ebn e ofruar.<\/i><\/p>\n<p>&nbsp;<\/p>\n<p>N\u00eb nenin 10 t\u00eb Ligjit Nr.8503 dat\u00eb 30.06.1999 \u201cP\u00ebr t\u00eb drejt\u00ebn e informimit p\u00ebr dokumentat zyrtare\u201d parashikohet se<\/p>\n<p>&nbsp;<\/p>\n<p>Afati p\u00ebr mospranimin e k\u00ebrkes\u00ebs<\/p>\n<p>&nbsp;<\/p>\n<p><i>Autoriteti publik vendos p\u00ebr mospranimin e plote ose te pjessh\u00ebm te k\u00ebrkes\u00ebs brenda 15 dit\u00ebve nga depozitimi i saj. Ne rastin e mospranimit te k\u00ebrkes\u00ebs, p\u00ebrgjigjja negative, e plote ose e pjesshme, jepet e arsyetuar, me shkrim nga autoriteti publik.<\/i><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>N\u00eb nenin 16 t\u00eb Ligjit Nr.8503 dat\u00eb 30.06.1999 \u201cP\u00ebr t\u00eb drejt\u00ebn e informimit p\u00ebr dokumentat zyrtare\u201d parashikohet se<\/p>\n<p>&nbsp;<\/p>\n<p>Ankimi ne gjykate<\/p>\n<p>&nbsp;<\/p>\n<p><i>\u00c7do person ka te drejte te ankohet ne gjykate kur \u00e7mon se i jan\u00eb shkelur te drejtat e parashikuara nga ky ligj. Pala padit\u00ebse \u00ebsht\u00eb nj\u00eb person juridik q\u00eb ka objekt veprimtarie rritjen e qytetaris\u00eb aktive, forcimi i komuniteteve, p\u00ebrmir\u00ebsimi i imazhit te vendit etj. Qendra L\u00ebvizja Mjaft aktualisht po zbaton nj\u00eb projekt i cili n\u00eb themel t\u00eb tij ka informimin e qytetar\u00ebve mbi aktivitetin parlamentar t\u00eb deputet\u00ebve shqiptar. Si nga Statuti i pal\u00ebs padit\u00ebse ashtu edhe nga projekti q\u00eb po zbaton Qendra L\u00ebvizja Mjaft, ky subjekt legjitimohet t\u00eb k\u00ebrkoj\u00eb nj\u00eb informacion t\u00eb till\u00eb pasi plot\u00ebson t\u00eb gjitha kriteret dhe kushtet p\u00ebr t\u00eb marr\u00eb informacion n\u00eb interes t\u00eb publikut.<\/p>\n<p>&nbsp;<\/p>\n<p>Pala e paditur ka patur detyrimin ligjor q\u00eb t\u00eb jap\u00eb informacion t\u00eb plot\u00eb me t\u00eb gjitha dokumentat e k\u00ebrkuara nga pala padit\u00ebse. \u00c7do person ka te drejte te k\u00ebrkoj\u00eb informacion p\u00ebr dokumentet zyrtare, qe kane te b\u00ebjn\u00eb me veprimtarin\u00eb e organeve shtet\u00ebrore dhe te personave qe ushtrojn\u00eb funksione shtet\u00ebrore, pa qene i detyruar te shpjegoje motivet. Institucionet shtet\u00ebrore jan\u00eb t\u00eb detyruara te japin \u00e7do informacion ne lidhje me nj\u00eb dokument zyrtar, p\u00ebrve\u00e7 rasteve kur me ligj parashikohet ndryshe. Kjo \u00ebsht\u00eb nj\u00eb e drejt\u00eb thelb\u00ebsore e cdo individi p\u00ebr tu njohur me aktivitetin e institucioneve dhe enteve shtet\u00ebrore. Nuk mund t\u00eb refuzohet asnje k\u00ebrkes\u00eb p\u00ebr informacion pa dh\u00ebn\u00eb asnj\u00eb shpjegim apo arsye ligjore.<\/p>\n<p>&nbsp;<\/p>\n<p>N\u00eb Ligjin Nr.8503 dat\u00eb 30.06.1999 \u201cP\u00ebr t\u00eb drejt\u00ebn e informimit p\u00ebr dokumentat zyrtare\u201d parashikohet se n\u00ebse informacioni i k\u00ebrkuar p\u00ebr nj\u00eb dokument zyrtar kufizohet me ligj, autoriteti publik i l\u00ebshon k\u00ebrkuesit nj\u00eb deklarate me shkrim, ne te cil\u00ebn tregohen arsyet e mosdh\u00ebnies se informacionit dhe rregullat ne baze te te cilave ai mund ta k\u00ebrkoj\u00eb at\u00eb. N\u00eb rastin konkret pala e paditur nuk ka dh\u00ebn\u00eb asnj\u00eb sqarim n\u00eb lidhje me k\u00ebt\u00eb refuzim p\u00ebr dh\u00ebnie informacioni.<\/p>\n<p>&nbsp;<\/p>\n<p>Gjykata konstaton se praktika e krijuar p\u00ebr k\u00ebto k\u00ebrkesa p\u00ebr informacion nga pala e paditur \u00ebsht\u00eb nj\u00eb praktik\u00eb n\u00eb kund\u00ebrshtim t\u00eb plot\u00eb me frym\u00ebn dhe g\u00ebrm\u00ebn e Ligjit Nr.8503 dat\u00eb 30.06.1999 \u201cP\u00ebr t\u00eb drejt\u00ebn e informimit p\u00ebr dokumentat zyrtare\u201d. Ky informacion duhet t\u00eb jepet brenda afateve ligjore p\u00ebr subjektet e interesuara. P\u00ebr cdo rast duhet t\u00eb kthehet nj\u00eb p\u00ebrgjigje me shkrim q\u00eb t\u00eb informoj\u00eb subjektin e interesuar p\u00ebr informacionin e k\u00ebrkuar ose arsyen e refuzimit. Cdo c\u00ebnim i k\u00ebtyre rregullave shkon n\u00eb drejtim t\u00eb kund\u00ebrt me transparenc\u00ebn dhe informimin p\u00ebr aktivitetin e institucioneve shtet\u00ebrore.<\/p>\n<p>&nbsp;<\/p>\n<p>Pala e paditur ka arritur t\u00eb sjell\u00eb disa akte shkresore t\u00eb k\u00ebrkuara nga pala padit\u00ebse. Mir\u00ebpo k\u00ebto dokumenta jan\u00eb paraqitur n\u00eb seanc\u00eb gjyq\u00ebsore dhe jo duke ia dh\u00ebn\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb drejtp\u00ebrdrejt\u00eb pal\u00ebs padit\u00ebsen n\u00eb koh\u00ebn q\u00eb ky informacion k\u00ebrkohet. Q\u00ebllimi i k\u00ebrkimit t\u00eb cdo informacioni nga institucionet shtet\u00ebrore nuk \u00ebsht\u00eb nj\u00eb proces q\u00eb t\u00eb p\u00ebrfundoj\u00eb n\u00eb padi gjyq\u00ebsore. Ky duhet t\u00eb jet\u00eb nj\u00eb proces efektiv, i shpejt\u00eb dhe transparent. Cdo vones\u00eb e dh\u00ebnies s\u00eb k\u00ebtij informacioni do t\u00eb humbte q\u00ebllimin e k\u00ebrkuar t\u00eb informacionit por t\u00eb hidhte hije jo transparente n\u00eb aktivitetin e e institucioneve shtet\u00ebtore. Me t\u00eb drejt\u00eb pala padit\u00ebse i \u00ebsht\u00eb drejtuar gjykat\u00ebs pasi n\u00eb rastin konkret asaj i jan\u00eb shkelur te drejtat e parashikuara nga Ligji Nr.8503 dat\u00eb 30.06.1999 \u201cP\u00ebr t\u00eb drejt\u00ebn e informimit p\u00ebr dokumentat zyrtare\u201d. <i><\/i><\/p>\n<p>&nbsp;<\/p>\n<p>Meqen\u00ebse pala e paditur ka sjell\u00eb para gjykat\u00ebs informacion n\u00eb lidhje me Raportin e Auditit t\u00eb Brendsh\u00ebm p\u00ebr vitet 2009 dhe 2010, me Projekt buxhetin vjetor t\u00eb Kuvendit t\u00eb Shqip\u00ebris\u00eb t\u00eb miratuar nga Ministria e Financave p\u00ebr vitet 2009-2010, me Buxhetin faktik t\u00eb Kuvendit t\u00eb Shqip\u00ebris\u00eb p\u00ebr vitin 2009-2011, gjykata procedurialisht e pranon k\u00ebt\u00eb pjes\u00eb t\u00eb informacionit duke konsideruar q\u00eb ky informacion tashm\u00eb \u00ebsht\u00eb dh\u00ebn\u00eb. P\u00ebr pasoj\u00eb kjo pjese e padis\u00eb duhet t\u00eb rr\u00ebzohet sepse ky detyrim \u00ebsht\u00eb p\u00ebrmbushur nga pala e paditur.<\/p>\n<p>&nbsp;<\/p>\n<p>Mir\u00ebpo pavar\u00ebsisht se pala e paditur i ka sjell\u00eb k\u00ebto dokumenta zyrtare n\u00eb seanc\u00eb gjyq\u00ebsore, gjykata ka bindjen se institucionet shtet\u00ebrore nuk duhet t\u00eb sjellin informacion p\u00ebr k\u00ebto c\u00ebshtje pasi ato b\u00ebh\u00ebn objekt konfliktesh gjyq\u00ebsore.
