Se pavar\u00ebsin\u00eb e b\u00ebjn\u00eb ata me pun\u00ebn e tyre. Nj\u00eb mesazh ky t\u00eb thuash pak kontroversial, kur mendon aktet normative t\u00eb k\u00ebsaj Republike, jurisprudenc\u00ebn kushtetuese dhe sa e sa doktrin\u00eb q\u00eb deri m\u00eb sot i kan\u00eb atribuar Presidentit nj\u00eb rol ky\u00e7 n\u00eb mbar\u00ebvajtjen dhe pavar\u00ebsimin e organeve t\u00eb drejt\u00ebsis\u00eb, si gjyqtar\u00ebt e prokuror\u00ebt.<\/p>\n<p>N\u00eb fakt Kushtetuta e ngarkon shprehimisht Presidentin e Republik\u00ebs me rolin e garantit t\u00eb k\u00ebtyre organeve, ashtu si\u00e7 e ngarkon me rolin e garantit t\u00eb ligjshm\u00ebris\u00eb n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb. Kushtetuta u k\u00ebrkon qoft\u00eb gjyqtar\u00ebve e prokuror\u00ebve, qoft\u00eb Presidentit, qoft\u00eb organeve t\u00eb tjera shtet\u00ebrore t\u00eb kujdesen p\u00ebr mbar\u00ebvajtjen e pavar\u00ebsis\u00eb s\u00eb organeve t\u00eb drejt\u00ebsis\u00eb. Gjyqtar\u00ebve e prokuror\u00ebve ua k\u00ebrkon duke sanksionuar se ata duhet t\u2019i p\u00ebrgjigjen vet\u00ebm Kushtetut\u00ebs dhe ligjit. Presidentit ia k\u00ebrkon duke i l\u00ebn\u00eb n\u00eb dor\u00eb em\u00ebrimin e gjyqtar\u00ebve (me p\u00eblqimin e Kuvendit) dhe prokuror\u00ebve, dhe shkarkimin e prokuror\u00ebve, n\u00eb bashk\u00ebpunim me Prokurorin e P\u00ebrgjithsh\u00ebm. N\u00eb dor\u00eb t\u00eb Presidentit Kushtetuta dhe ligjet parashikojn\u00eb edhe nj\u00eb s\u00ebr\u00eb mekanizmash p\u00ebr ruajtjen e ligjshm\u00ebris\u00eb dhe kushtetutshm\u00ebris\u00eb. Kurse organeve t\u00eb tjera, sidomos organeve me natyr\u00eb t\u00eb past\u00ebr politike, si Kuvendi dhe K\u00ebshilli i Ministrave, u k\u00ebrkon t\u00eb mos nd\u00ebrhyjn\u00eb n\u00eb kompetencat e organeve t\u00eb tjera. T\u00eb respektojn\u00eb ndarjen dhe balancimin e pushteteve dhe pavar\u00ebsin\u00eb e institucioneve. Ua k\u00ebrkon sidomos organeve politike, meq\u00ebn\u00ebse ato historikisht jan\u00eb p\u00ebrpjekur t\u00eb shkelin ligjet, ta gjejn\u00eb veten jasht\u00eb rregullave normative dhe t\u00eb kontrollojn\u00eb organe t\u00eb tjera duke nd\u00ebrhyr\u00eb n\u00eb sferat e tyre t\u00eb kompetenc\u00ebs e duke ushtruar presion politik.<\/p>\n<p>Historikisht n\u00eb shum\u00eb eksperienca v\u00ebrdall\u00eb dhe historikisht n\u00eb Shqip\u00ebrin\u00eb post-totalitare, organet politike kan\u00eb tentuar t\u00eb kontrollojn\u00eb organet e drejt\u00ebsis\u00eb. Aq m\u00eb e v\u00ebrtet\u00eb \u00ebsht\u00eb kjo, kur n\u00eb nj\u00eb shtet si Shqip\u00ebria, organet e drejt\u00ebsis\u00eb duhet t\u00eb merren me administrimin e krimit e t\u00eb korrupsionit galopant, n\u00eb nivel t\u00eb organizuar shtet\u00ebror, e super t\u00eb denoncuar nga qytetar\u00eb, autoritete e subjekte vendase, deri dhe autoritete t\u00eb huaja per\u00ebndimoro-integruese.<\/p>\n<p>Presidentit i jan\u00eb besuar aq shum\u00eb kompetenca garancie p\u00ebr ruajtjen e ligjshm\u00ebris\u00eb, edhe pse ai \u00ebsht\u00eb konceptuar si p\u00ebrfaq\u00ebsues i popullit, i t\u00ebr\u00ebsis\u00eb s\u00eb shtetasve t\u00eb Republik\u00ebs, t\u00eb atyre q\u00eb lexojn\u00eb mesazhet e tij, t\u00eb atyre q\u00eb q\u00ebllohen n\u00eb dit\u00ebn p\u00ebr diell n\u00eb Republik\u00ebn q\u00eb ai kryeson, t\u00eb atyre q\u00eb ndjekin q\u00ebndrimet e tij p\u00ebr drejt\u00ebsin\u00eb e munguar akoma sot e k\u00ebsaj dite dhe p\u00ebrmas\u00ebn e frikshme t\u00eb krimit shtet\u00ebror. Sidomos n\u00eb momente kaq t\u00eb v\u00ebshtira, prej Presidentit pritet t\u00eb dal\u00eb n\u00eb an\u00ebn e shtetasve, atyre q\u00eb u vran\u00eb, e atyre q\u00eb mund t\u00eb ishin vrar\u00eb. T\u00eb pretendoj\u00eb respektimin e t\u00eb drejtave dhe lirive t\u00eb njeriut. T\u00eb liris\u00eb p\u00ebr t\u00eb protestuar, t\u00eb s\u00eb drejt\u00ebs p\u00ebr jet\u00ebn e sh\u00ebndetin, t\u00eb s\u00eb drejt\u00ebs p\u00ebr t\u00eb pasur e p\u00ebr t\u2019u trajtuar me dinjitet n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb.<\/p>\n<p>Prej Presidentit nuk pritet heshtja shurdhe, anashkalimi i pav\u00ebmendsh\u00ebm dhe as larja e duarve me prokuror\u00ebt n\u00eb momente ky\u00e7e t\u00eb veprimtaris\u00eb s\u00eb tyre, n\u00eb nj\u00eb koh\u00eb kur denoncimet p\u00ebr drejt\u00ebsin\u00eb e munguar, p\u00ebr nd\u00ebrhyrjet n\u00eb t\u00eb, p\u00ebr shkeljen e \u00e7do parimi e rregulli t\u00eb shtetit t\u00eb s\u00eb drejt\u00ebs, jan\u00eb n\u00eb rend t\u00eb dit\u00ebs. T\u00eb pakt\u00ebn q\u00eb nga G\u00ebrdeci i 2008, e nga 21 janari i 2011.<\/p>\n<p>Presidenti ka zgjedhur t\u00eb laj\u00eb duart, megjith\u00ebse Kushtetuta i ka besuar nj\u00eb rol t\u00eb ve\u00e7ant\u00eb organit\u00a0<em>super partes<\/em>lidhur me organet e drejt\u00ebsis\u00eb e t\u00eb garancis\u00eb, si\u00e7 jan\u00eb gjyqtar\u00ebt dhe prokuror\u00ebt. Sidomos prokuror\u00ebt. N\u00eb fakt, n\u00ebse lidhur me gjyqtar\u00ebt, Presidenti merr pjes\u00eb vet\u00ebm n\u00eb em\u00ebrimin e tyre (me p\u00eblqimin e Kuvendit), lidhur me prokuror\u00ebt, duke filluar nga krye prokurori, ai ka n\u00eb dor\u00eb em\u00ebrimin dhe shkarkimin e tyre. Pasi em\u00ebron me p\u00eblqimin e Kuvendit Prokurorin e P\u00ebrgjithsh\u00ebm, Presidenti em\u00ebron prokuror\u00ebt me propozimin e k\u00ebtij t\u00eb fundit. \u00cbsht\u00eb parashikuar pra nj\u00eb pjes\u00ebmarrje e dyfisht\u00eb e organeve kushtetuese p\u00ebr em\u00ebrimin e organeve t\u00eb garancis\u00eb, pik\u00ebrisht p\u00ebr t\u2019u siguruar, q\u00eb n\u00eb hapat e krijimit t\u00eb tyre, pavar\u00ebsin\u00eb e domosdoshme, si premis\u00eb e pashkelshme p\u00ebr mir\u00ebfunksionimin tyre.<\/p>\n<p>Roli i Presidentit \u00ebsht\u00eb akoma m\u00eb i r\u00ebnd\u00ebsish\u00ebm lidhur me Prokurorin e P\u00ebrgjithsh\u00ebm, i cili mund t\u00eb shkarkohet nga Presidenti, me propozimin e Kuvendit. Kjo formul\u00eb kushtetuese u shtjellua nga Gjykata Kushtetuese n\u00eb vendimin nr. 75 t\u00eb vitit 2002, duke sqaruar se k\u00ebshtu k\u00ebrkohej t\u2019i besohej Presidentit filtri i garancis\u00eb p\u00ebr Prokurorin e P\u00ebrgjithsh\u00ebm, duke i l\u00ebn\u00eb Kuvendit vet\u00ebm nism\u00ebn dhe Presidentit vendimmarrjen, mbi nj\u00eb propozim eventualisht t\u00eb motivuar politikisht dhe duke shkelur procesin e rregullt ligjor. Nj\u00eb nga arsyet pse Presidenti \u00ebsht\u00eb pra garant i ligjshm\u00ebris\u00eb.<\/p>\n<p>Vendimi nr. 75 i 2002, u pasua nga vendimi nr. 76 i t\u00eb nj\u00ebjtit vit, lidhur me shkarkimin e bujsh\u00ebm t\u00eb Prokurorit t\u00eb P\u00ebrgjithsh\u00ebm Arben Rakipi, n\u00eb shkelje flagrante nga Kuvendi t\u00eb \u00e7do rregulli p\u00ebr nj\u00eb proces t\u00eb rregullt ligjor. Gjykata Kushtetuese e shpalli antikushtetues vendimin p\u00ebr proprozimin e shkarkimit t\u00eb Kuvendit si dhe dekretin e Presidentit q\u00eb kishte \u201cratifikuar\u201d propozimin, pa kryer verifikimet e nevojshme lidhur me ligjshm\u00ebrin\u00eb dhe kushtetutshm\u00ebrin\u00eb e shkarkimit. Rasti b\u00ebri buj\u00eb edhe p\u00ebr m\u00ebnyr\u00ebn arrogante se si Kuvendi vendosi t\u00eb mos e zbatonte vendimin e Gjykat\u00ebs Kushtetuese, q\u00eb e detyronte t\u00eb p\u00ebrs\u00ebriste procedur\u00ebn e shkarkimit, duke garantuar Prokurorin e P\u00ebrgjithsh\u00ebm lidhur me t\u00eb drejtat e mbrojtjes, t\u00eb njohjes me materialet n\u00eb ngarkim t\u00eb tij, etj. Rasti b\u00ebri buj\u00eb edhe p\u00ebr m\u00ebsymjen politike q\u00eb iu b\u00eb jo vet\u00ebm Prokurorit t\u00eb P\u00ebrgjithsh\u00ebm, q\u00eb nuk u kthye m\u00eb n\u00eb detyr\u00eb, por edhe p\u00ebr m\u00ebnyr\u00ebn si u vu n\u00eb diskutim dhe u shkel autoriteti i Gjykat\u00ebs Kushtetuese, vendimet e t\u00eb cil\u00ebs jan\u00eb t\u00eb paapelueshme, p\u00ebrfundimtare dhe t\u00eb detyrueshme p\u00ebr t\u00eb gjith\u00eb.<\/p>\n<p>Megjithat\u00eb ai vendim p\u00ebrfaq\u00ebsoi themelin e domosdosh\u00ebm mbi t\u00eb cilin Gjykata Kushtetuese do t\u00eb nd\u00ebrtonte nj\u00eb jurisprudenc\u00eb t\u00eb konsoliduar, mbi pavar\u00ebsin\u00eb q\u00eb duhet t\u00eb g\u00ebzoj\u00eb Prokuroria dhe Prokurori i P\u00ebrgjithsh\u00ebm. N\u00eb fakt n\u00eb 2006-2008 Kuvendi s\u00ebrish tentoi t\u00eb propozonte shkarkimin e Prokurorit t\u00eb P\u00ebrgjithsh\u00ebm n\u00eb detyr\u00eb, Theodhori Sollakun, dhe s\u00ebrish Gjykata Kushtetuese shpalli antikushtetutshm\u00ebrin\u00eb e procedurave t\u00eb ndjekura nga Kuvendi. Procedura q\u00eb edhe pas 4 e m\u00eb shum\u00eb vitesh nga precedenti Rakipi, nuk ishin kuptuar si t\u00eb detyrueshme p\u00ebr organin politik. Me k\u00ebt\u00eb rast, Presidenti i at\u00ebhersh\u00ebm Alfred Moisiu, mbajti nj\u00eb q\u00ebndrim shum\u00eb korrekt duke mbrojtur Prokurorin e P\u00ebrgjithsh\u00ebm, duke mos dekretuar shkarkimin dhe duke rr\u00ebzuar propozimin e Kuvendit. Presidenti b\u00ebri at\u00eb q\u00eb pritej dhe k\u00ebrkohej prej tij. I q\u00ebndroi n\u00eb krah organeve t\u00eb drejt\u00ebsis\u00eb, p\u00ebrfshir\u00eb vet\u00eb Gjykat\u00ebn Kushtetuese, p\u00ebrball\u00eb sulmit t\u00eb p\u00ebrhersh\u00ebm nga organet politike. Presidenti Moisiu materializoi me p\u00ebrpikm\u00ebri shkronj\u00ebn dhe shpirtin e Kushtetut\u00ebs, duke mos lejuar nd\u00ebrhyrje arbitrare, jashte rregullave t\u00eb shtetit ligjor, n\u00eb kompetencat dhe veprimtarin\u00eb e organeve t\u00eb drejt\u00ebsis\u00eb.<\/p>\n<p>Kjo do t\u00eb ishte pritshm\u00ebria e ligjshme p\u00ebr rolin e Presidentit, i cili sot g\u00ebzon edhe shembujt e suksesit, m\u00eb shum\u00eb se paraardh\u00ebsit e tij. Q\u00eb ai t\u00eb b\u00ebnte p\u00ebrfaq\u00ebsuesin e qytetar\u00ebve, t\u00eb b\u00ebnte garantin me t\u00eb gjitha mjetet q\u00eb i jan\u00eb v\u00ebn\u00eb n\u00eb dispozicion. N\u00eb nj\u00eb vend ku krimi e korrupsioni shtet\u00ebror kan\u00eb brejtur thelbin e cil\u00ebsis\u00eb s\u00eb jet\u00ebs institucionale e qytetare. Nj\u00eb President n\u00eb krah t\u00eb drejt\u00ebsis\u00eb, nj\u00eb organ n\u00eb funksion opozitar, p\u00ebr t\u00eb balancuar gjith\u00eb\u00a0\u00e7ka pushteti politik tenton t\u00eb akaparroj\u00eb prej shekujsh.<\/p>\n<p>Ligjet e k\u00ebtij vendi, jurisprudenca kushetetuese autoritare e k\u00ebtij vendi, nd\u00ebrgjegjia institucionale e qytetare e ngarkojn\u00eb Presidentin me detyr\u00ebn q\u00eb ai t\u00eb b\u00ebj\u00eb pjes\u00ebn e tij p\u00ebr t\u00eb garantuar pavar\u00ebsin\u00eb e prokuror\u00ebve. Jo me larje duarsh, kur nevoja p\u00ebr nj\u00eb Prokurori t\u00eb pavarur denoncohet publikisht nga vendas e t\u00eb huaj. Jo me duar t\u00eb pastra.
