Megjithese kane kaluar dy muaj Gjykata Kushtetuese ende nuk po guxon te publikoje ate cfare duhej te kishte shkruar qe ne muajin Tetor ne vendimin qe hodhi ne rruge mijera familje. Shoqata thekson se mosarsyetimi i vendimit eshte nje shkelje e ligjit nga Gjykata Kushtetuese. Me poshte vijon teksti i plote i kerkeses.<\/em><\/p>\n<p align=\"left\"><b>I nderuar Z. Kryetar,<\/b><\/p>\n<p align=\"left\"><b>T\u00eb nderuar an\u00ebtar\u00eb t\u00eb Gjykat\u00ebs Kushtetuese,<\/b><\/p>\n<p>Me 31 tetor 2012 nga ana Juaj, me shkres\u00eb zyrtare dhe me an\u00eb t\u00eb mediave u b\u00eb publik fakti se lidhur me k\u00ebrkes\u00ebn e Shoqat\u00ebs s\u00eb Qeramarr\u00ebsve n\u00eb Sht\u00ebpit\u00eb Shtet\u00ebrore ish Pron\u00eb Private p\u00ebr t\u00eb shfuqizuar Aktin Normativ nr. 3 dt. 01.08.2012 dhe ligjin nr. 82\/2012, Gjykata Kushtetuese kishte vendosur \u201dRr\u00ebzimin e k\u00ebrkes\u00ebs\u201d.<\/p>\n<p>Meq\u00ebn\u00ebse kjo form\u00eb publikimi e vendimit nuk ishte n\u00eb p\u00ebrputhje me form\u00ebs e p\u00ebrcaktuar nga neni 72 i ligjit nr. 8577 dt. 10.02.2000 \u201dP\u00ebr organizimin dhe funksionimin e Gjykat\u00ebs Kushtesuese, neni 13 i Rregullores s\u00eb gjykat\u00ebs, dhe jurisprudenca e Gjykat\u00ebs Kushtetuese e cila i ka konsideruar vendimet e paarsyetuara gjithnj\u00eb si nj\u00eb shkelje e t\u00eb drejt\u00ebs p\u00ebr nj\u00eb proces t\u00eb rregullt ligjor, m\u00eb 09.11.2012 paraqit\u00ebm nj\u00eb k\u00ebrkes\u00eb p\u00ebr sqarim. P\u00ebrgjigja Juaj ishte q\u00eb vendimi do t\u00eb publikohej n\u00eb nj\u00eb koh\u00eb m\u00eb optimale.<\/p>\n<p>Deri m\u00eb sot, pas dy muajsh nga shpallja e nj\u00eb vendimi pa num\u00ebr, pa dat\u00eb, pa protokoll dhe pa arsyetim, q\u00eb shmangu k\u00ebrkes\u00ebn p\u00ebr pezullim t\u00eb aktit normativ nr. 3\/2012, po vijon t\u00eb cenoj\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb pakuptueshme aspektin thelb\u00ebsor t\u00eb t\u00eb drejt\u00ebs p\u00ebr nj\u00eb proces t\u00eb rregullt ligjor dhe aspektin procedural t\u00eb t\u00eb drejt\u00ebs p\u00ebr nj\u00eb jet\u00eb familjare dhe strehim.<\/p>\n<p>Tashm\u00eb ka kaluar cdo kufi i pritjes p\u00ebr arsyetimin e vendimit \u201dn\u00eb nj\u00eb koh\u00eb m\u00eb optimale\u201d. Tashm\u00eb kan\u00eb filluar t\u00eb zbatohen d\u00ebbimet n\u00eb mas\u00eb, zgjidhjet e kontratave t\u00eb qiras\u00eb dhe hedhja n\u00eb rrug\u00eb e shum\u00eb familjeve, ku nj\u00eb pjes\u00eb jan\u00eb planifikuar t\u00eb nxirren pik\u00ebrisht dit\u00ebn e Krishtlindjeve. N\u00eb shum\u00eb vende t\u00eb bot\u00ebs per\u00ebndimore ekzistojn\u00eb moratoriume q\u00eb pezullojn\u00eb d\u00ebbimet n\u00eb koh\u00eb t\u00eb pap\u00ebrshtatshme dimri, por ne t\u00eb pakt\u00ebn po k\u00ebrkojm\u00eb t\u00eb mos p\u00ebrballemi me moratoriumin e arsyetimit t\u00eb nj\u00eb vendimi q\u00eb na ka surprizuar t\u00eb gjith\u00ebve.<\/p>\n<p><b>T\u00eb nderuar an\u00ebtar\u00eb t\u00eb Gjykat\u00ebs Kushtetuese,<\/b><\/p>\n<p>mosarsyetimi na cenon drejtp\u00ebrs\u00ebdrejti n\u00eb aplikimin e t\u00eb drejtave tona sepse:<\/p>\n<ol start=\"1\">\n<li>Nuk po arrijm\u00eb t\u2019i ofrojm\u00eb informacion Gjykat\u00ebs Europiane p\u00ebr t\u00eb Drejtat e Njeriut rreth argumentave pro dhe kund\u00ebr p\u00ebr rr\u00ebzimin e k\u00ebrkes\u00ebs son\u00eb, duke l\u00ebn\u00eb k\u00ebt\u00eb gjykat\u00eb t\u00eb pasigurt\u00eb n\u00eb marrjen e masave t\u00eb p\u00ebrkohshme (Rregulli 39), pranimin e k\u00ebrkes\u00ebs p\u00ebr gjykim pilot (Rregulli 61) dhe trajtimin e c\u00ebshtjes me prioritet (Rregulli 41).<\/li>\n<li>Ka konfunzion n\u00ebse k\u00ebrkojm\u00eb nga gjykatat e rretheve gjyq\u00ebsore pezullimin me rastin e kund\u00ebrshtimit t\u00eb veprimeve p\u00ebrmbarimore, sipas nenit 609 t\u00eb Kodit t\u00eb Procedur\u00ebs Civile, pasi jo vet\u00ebm qytetar\u00ebt e pastreh\u00eb, por edhe gjykatat jan\u00eb skeptike t\u00eb aplikojn\u00eb pezullimin, nd\u00ebrkoh\u00eb q\u00eb Akti Normativ e ndalon k\u00ebt\u00eb dhe Gjykata Kushtetuese e rr\u00ebzoi k\u00ebrkes\u00ebn ton\u00eb ku ngrihej edhe kjo kritik\u00eb.<\/li>\n<li>Nuk mund t\u00eb k\u00ebrkojm\u00eb aplikimin e masave t\u00eb vecanta p\u00ebr persona vulnerab\u00ebl, t\u00eb cil\u00ebt jan\u00eb t\u00eb s\u00ebmur\u00eb me s\u00ebmundje terminale, s\u00ebmundje t\u00eb tjera t\u00eb rrezikshme p\u00ebr jet\u00ebn, invalid\u00eb, t\u00eb papun\u00eb, persona q\u00eb trajtohen me ndihm\u00eb ekonomike, rom\u00eb etj., p\u00ebr t\u00eb cil\u00ebn ju jeni n\u00eb dijeni q\u00eb g\u00ebzojn\u00eb mbrojtje t\u00eb vecant\u00eb nga neni 8 i Konvent\u00ebs Europian\u00eb p\u00ebr t\u00eb Drejtat e Njeriut.<\/li>\n<li>Nuk mund t\u00eb k\u00ebrkojm\u00eb pavlefshm\u00ebrin\u00eb e titujve ekzekutiv\u00eb n\u00eb rastet kur n\u00eb t\u00eb nj\u00ebjtin vit, m\u00eb 2012, pronar\u00ebt kan\u00eb humbur proceset gjyq\u00ebsor\u00eb p\u00ebr lirim dhe dor\u00ebzim sendi, me vendim gjykate t\u00eb form\u00ebs s\u00eb prer\u00eb, ose kan\u00eb hequr p\u00ebrfundimisht dor\u00eb nga e drejta e padis\u00eb, nd\u00ebrkoh\u00eb q\u00eb Akti Normativ i mbivendos pushtetit gjyq\u00ebsor vendimmarrjen administrative t\u00eb nj\u00eb Enti Komb\u00ebtar Banesash, q\u00eb fundja \u00ebsht\u00eb nj\u00eb pjes\u00eb e pushtetit ekzekutiv dhe k\u00ebshtu shkelet ndarja dhe balancimi i pushteteve.<\/li>\n<li>Nuk mund t\u00eb adresojm\u00eb c\u00ebshtjen tek subjektet q\u00eb kan\u00eb t\u00eb drejt\u00eb t\u00eb k\u00ebrkojn\u00eb kontrollin abstrakt t\u00eb Aktit Normativ nr.3\/2012 n\u00eb raport me nenin 101 t\u00eb Kushtetut\u00ebs, p\u00ebr arsye se ne e kemi ngritur dhe nuk e dim\u00eb ende n\u00ebse k\u00ebrkesa jon\u00eb \u00ebsht\u00eb rr\u00ebzuar p\u00ebr probleme substance apo p\u00ebr shkak t\u00eb munges\u00ebs s\u00eb legjitimitetit.<\/li>\n<li>Nuk dim\u00eb se cilat ishin arsyet q\u00eb detyruan gjykat\u00ebn tuaj q\u00eb t\u00eb vendos\u00eb ndryshe nga vendimet nr. 26\/2005 dhe 11\/2007, kur n\u00eb k\u00ebto vendime thuhet qart\u00eb se v\u00ebrtet siguria juridike nuk mund t\u00eb prevaloj\u00eb mbi interesin publik, por p\u00ebrfundimi i marr\u00ebdh\u00ebnieve t\u00eb qiras\u00eb pa siguruar streh\u00eb nuk mund t\u00eb justifikohet n\u00eb asnj\u00eb rast me interesin publik, pavar\u00ebsisht se kjo \u00ebsht\u00eb n\u00eb interesin e pronar\u00ebve nga ana tjet\u00ebr. N\u00ebse interesi publik nuk justifikon k\u00ebt\u00eb veprim, at\u00ebher\u00eb ne duhet t\u00eb dim\u00eb se cili ishte faktori q\u00eb justifikoi k\u00ebt\u00eb ndryshim qendrimi nga ana Juaj.<\/li>\n<li>Nuk dim\u00eb se cilat ishin provat q\u00eb gjykata Juaj u bazua p\u00ebr t\u00eb besuar se kredin\u00eb mund ta p\u00ebrfitojn\u00eb t\u00eb gjith\u00eb dhe se banesa sociale paska mjaftuesh\u00ebm p\u00ebr t\u00eb akomoduar qytetar\u00ebt e pastreh\u00eb.<\/li>\n<li>Nuk e dim\u00eb se cfar\u00eb p\u00ebrgjigjeje i keni dh\u00ebn\u00eb argumentit q\u00eb situata ekonomike nuk mund t\u00eb jet\u00eb argument p\u00ebr t\u00eb shkelur t\u00eb drejtat e shtetasve, aq m\u00eb tep\u00ebr kur para gjykat\u00ebs nuk erdhi ndonj\u00eb prov\u00eb p\u00ebr t\u00eb v\u00ebrtetuar se sa \u00ebsht\u00eb kostoja financiare e zgjidhjes p\u00ebr kategorin\u00eb ton\u00eb dhe sa mund\u00ebsi reale ka shteti p\u00ebr ta v\u00ebn\u00eb n\u00eb jet\u00eb k\u00ebt\u00eb zgjidhje.<\/li>\n<\/ol>\n<p align=\"left\"><b>T\u00eb nderuar an\u00ebtar\u00eb t\u00eb Gjykat\u00ebs Kushtetuese,<\/b><\/p>\n<p>Nuk ka kuptim q\u00eb t\u00eb vononi m\u00eb shum\u00eb arsyetimin e vendimit. Her\u00ebt a von\u00eb do ju duhet t\u00eb p\u00ebrballeni me moralin e k\u00ebsaj c\u00ebshtjeje. N\u00eb nj\u00eb koh\u00eb kur p\u00ebr Krishlindje ne po hidhemi n\u00eb rrug\u00eb se nuk marrim dot as kredi dhe as banes\u00eb sociale, Gjykata Kushtetuese po mban ende t\u00eb paarsyetur vendimin q\u00eb i erdhi kundra vendimeve t\u00eb m\u00ebparshme.<\/p>\n<p>Megjith\u00ebse Enti Komb\u00ebtar i Banesave i ka konsideruar rastet e tona sikur ne mund t\u00eb p\u00ebrfitojm\u00eb kredi dhe Ju e keni besuar k\u00ebt\u00eb gj\u00eb n\u00eb baz\u00eb t\u00eb fjal\u00ebve t\u00eb goj\u00ebs s\u00eb ministrit Olldashi, ju b\u00ebjm\u00eb me dije se pjesa d\u00ebrrmuese e familjeve tona nuk i ka p\u00ebrmbushur kriteret q\u00eb ka vendosur BKT n\u00eb faz\u00ebn e dyt\u00eb, sipas p\u00ebrcaktimeve n\u00eb marr\u00ebveshjen q\u00eb kjo bank\u00eb ka me Ministrin\u00eb e Financave dhe Ministrin\u00eb e Pun\u00ebve Publike dhe Transporteve, marr\u00ebveshje e cila nuk \u00ebsht\u00eb trajtuar n\u00eb gjykimin kushtetues p\u00ebr shkak t\u00eb investigimit t\u00eb cunguar q\u00eb Ju keni b\u00ebr\u00eb. Norma e miratimit te kredive deri tani \u00ebsht\u00eb shum\u00eb e ul\u00ebt. N\u00eb daljet publike t\u00eb Ministrit t\u00eb Pun\u00ebve Publike dhe Transporteve Z. Sokol Olldashi \u00ebsht\u00eb komunikuar se deri tani numri i kredive ka arritur 300, nd\u00ebrkoh\u00eb q\u00eb kjo shif\u00ebr \u00ebsht\u00eb shum\u00eb e ul\u00ebt n\u00eb krahasim shifr\u00ebn e d\u00ebrguar n\u00eb bank\u00eb nga EKB q\u00eb \u00ebsht\u00eb mbi 3000 familje. Por, deri tani banka po vazhdon t\u00eb rr\u00ebzoj\u00eb k\u00ebrkesat e qiramarr\u00ebsve p\u00ebr marrjen e kredis\u00eb, p\u00ebr shkak t\u00eb (1) mosh\u00ebs s\u00eb madhe, (2) pamund\u00ebsis\u00eb p\u00ebr t\u00eb siguruar dor\u00ebzan\u00ebs, (3) faktit q\u00eb ata nuk jan\u00eb t\u00eb lir\u00eb nga detyrime t\u00eb tjera (4) pag\u00ebs s\u00eb pamjaftueshme apo t\u00eb parregullt; (5) paaft\u00ebsis\u00eb paguese t\u00eb k\u00ebstit prej 20% q\u00eb duhet siguruar vet\u00eb, sepse jo t\u00eb gjith\u00eb jan\u00eb t\u00eb aft\u00eb ta sigurojn\u00eb at\u00eb, si dhe (6) faktit se kredik\u00ebrkuesit duhet t\u00eb disponojn\u00eb gjithashtu edhe nj\u00eb vler\u00eb kolaterali t\u00eb pakt\u00ebn sa 140% e vler\u00ebs s\u00eb kredis\u00eb s\u00eb k\u00ebrkuar. Madje edhe dor\u00ebzan\u00ebsi duhet t\u00eb paraqitet me nj\u00eb kolateral t\u00eb till\u00eb.<\/p>\n<p>Nga ana tjet\u00ebr, edhe organet e pushtetit vendor, nuk disponojn\u00eb fondet e duhura dhe banesa sociale, gj\u00eb q\u00eb p\u00ebrs\u00ebri Ju nuk e keni marr\u00eb n\u00eb konsiderat\u00eb p\u00ebr shkakt t\u00eb investigimit t\u00eb cunguar t\u00eb k\u00ebsaj c\u00ebshtjeje. Bashkit\u00eb e qyteteve Tiran\u00eb, Berat, Shijak, Delvin\u00eb, Corovod\u00eb, Durr\u00ebs, Vlor\u00eb, P\u00ebrmet, Pogradec etj na kan\u00eb informuar se\u00a0<b>nuk kan\u00eb fonde dhe as banesa t\u00eb mjaftueshme t\u00eb gatshme<\/b>, nd\u00ebrkoh\u00eb q\u00eb numri i aplikuesve \u00ebsht\u00eb shum\u00eb i lart\u00eb n\u00eb raport me numrin e pap\u00ebrfillsh\u00ebm t\u00eb banesave sociale aktuale. N\u00eb p\u00ebrgjith\u00ebsi ka shum\u00eb pak ose aspak apartamente, prej t\u00eb cil\u00ebve shpesh nuk jan\u00eb t\u00eb lir\u00eb. Gjithkund vihet re mungesa e fondeve. Nga k\u00ebto p\u00ebrgjigje demonstrohet qart\u00eb q\u00eb pjesa d\u00ebrrmuese e\u00a0<b>organeve t\u00eb pushtetit lokal nuk jan\u00eb n\u00eb gjendje t\u00eb komodojn\u00eb familjet e qiramarr\u00ebsve q\u00eb do t\u00eb mbetemi pa streh\u00eb.\u00a0<\/b>Nga sa m\u00eb sip\u00ebr del qart\u00eb q\u00eb instrumentat e strehimit t\u00eb mbi 3000 familjeve jan\u00eb\u00a0<b>joefektive.<\/b><\/p>\n<p>Shum\u00eb prej nesh nuk jan\u00eb realisht n\u00eb gjendje q\u00eb t\u00eb sigurojn\u00eb strehim dhe do t\u00eb mbeten t\u00eb pastreh\u00eb n\u00eb muajt e dimrit, n\u00eb prag t\u00eb festave t\u00eb fundvitit, dhe Ju nuk na keni dh\u00ebn\u00eb asnj\u00eb arsye pse Republika jon\u00eb na ktheu krah\u00ebt.<\/p>\n<p>Ne duam t\u00eb dim\u00eb pse nj\u00eb nd\u00ebrhyrje e k\u00ebsaj shkalle n\u00eb t\u00eb drejt\u00ebn e banimit u konsiderua prej Jush \u201ce nevojshme n\u00eb nj\u00eb shoq\u00ebri demokratike\u201d p\u00ebr nj\u00eb \u201cq\u00ebllim legjitim\u201d duke iu p\u00ebrgjigjur nj\u00eb \u201cnevoje t\u00eb ngutshme sociale\u201d, dhe se ajo ishte \u201cn\u00eb proporcion me q\u00ebllimin legjitim t\u00eb ndjekur\u201d.<\/p>\n<p>Ne nuk ishim asnj\u00ebher\u00eb kundra faktit q\u00eb pronar\u00ebt kan\u00eb t\u00eb drejt\u00eb t\u00eb rimarrin n\u00eb posedim pronat e tyre. Ne jemi dakord q\u00eb t\u2019i l\u00ebm\u00eb k\u00ebto sht\u00ebpi sa m\u00eb par\u00eb, pasi ato jan\u00eb n\u00eb shum\u00eb raste t\u00eb rr\u00ebnuara dhe k\u00ebrkojn\u00eb shum\u00eb kosto mir\u00ebmbajtjeje. Ajo q\u00eb k\u00ebrkojm\u00eb \u00ebsht\u00eb q\u00eb t\u00eb lirojm\u00eb k\u00ebto banesa vet\u00ebm n\u00ebse akomodimi yn\u00eb do t\u00eb jet\u00eb<b>efektiv<\/b>, pra kur shteti t\u00eb ket\u00eb gjetur nj\u00eb form\u00eb\u00a0<b>reale<\/b>, apo nj\u00eb m\u00ebnyr\u00eb t\u00eb p\u00ebrshtatshme p\u00ebr t\u00eb gjith\u00eb, ku t\u00eb p\u00ebrfshihen edhe ata\u00a0<b>q\u00eb nuk p\u00ebrfitojn\u00eb dot as kredi e as banes\u00eb sociale<\/b>\u00a0p\u00ebr shkak t\u00eb shum\u00eb arsyeve t\u00eb renditura m\u00eb lart. Juve mbase e keni menduar nj\u00eb p\u00ebrgjigje edhe p\u00ebr k\u00ebt\u00eb pjes\u00eb, por ne duhet ta dim\u00eb at\u00eb jo kur gjithcka t\u00eb ket\u00eb p\u00ebrfunduar, por p\u00ebrpara, q\u00eb edhe ne t\u00eb dim\u00eb se ku do i kalojm\u00eb festat e fundvitit.<\/p>\n<p>Edhe n\u00eb vitin 1997, n\u00eb nj\u00eb situat\u00eb aspak t\u00eb zakonshme, dy dit\u00eb p\u00ebrpara vendosjes s\u00eb gjendjes s\u00eb jasht\u00ebzakonshme, m\u00eb 27.02.1997 me Vendimin nr. 5, Gjykata Kushtetuese ka theksuar se duhet vler\u00ebsuar drejt fuqia paguese e qiramarr\u00ebsve n\u00eb raport me zgjidhjet efektive q\u00eb ofron ligji.<\/p>\n<p>N\u00eb kushtet e sotme, d\u00ebbimi n\u00eb zbatim t\u00eb Aktit Normativ nr. 3\/2012 do t\u00eb shnd\u00ebrroj\u00eb shum\u00eb persona n\u00eb t\u00eb pastreh\u00eb n\u00eb kuptimin e mir\u00ebfillt\u00eb t\u00eb fjal\u00ebs, duke iu cenuar atyre n\u00eb nj\u00eb shkall\u00eb ekstreme t\u00eb drejtat e tyre p\u00ebr banim, q\u00eb burojn\u00eb nga neni 8 i Konvent\u00ebs, n\u00eb tejkalim t\u00eb kufijve t\u00eb parashikuar nga neni 17 i Kushtetut\u00ebs.<\/p>\n<p align=\"left\"><b>T\u00eb nderuar an\u00ebtar\u00eb t\u00eb Gjykat\u00ebs Kushtetuese,<\/b><\/p>\n<p>Nj\u00eb nga pretendimet pse u miratua Akti Normativ nr.3\/2012 ishte meq\u00ebn\u00ebse n\u00eb Strasburg ishin aplikuar mbi 70 raste ku Shqip\u00ebria rrezikonte t\u00eb paguante nj\u00eb fatur\u00eb t\u00eb madhe. Por ama d\u00ebmi q\u00eb mund t\u2019i vij\u00eb Shqip\u00ebris\u00eb nga aplikimet e qiramarr\u00ebsve do t\u00eb ishte m\u00eb i madh sepse numri i aplikant\u00ebve \u00ebsht\u00eb shum\u00eb m\u00eb i madh.
