Kjo p\u00ebrpjekje, p\u00ebr t\u00eb cil\u00ebn Res Publica po ofron ndihm\u00ebn ligjore falas, nuk \u00ebsht\u00eb e para n\u00eb historin\u00eb e k\u00ebsaj shoqate para Gjykat\u00ebs Kushtetuese. Dy p\u00ebrplasje t\u00eb tjera m\u00eb dy ligje t\u00eb m\u00ebparsh\u00ebm kan\u00eb ndodhur m\u00eb 2005 dhe 2007. N\u00eb t\u00eb dy rastet Gjykata Kushtetuese ka pranuar k\u00ebrkesat e tyre, duke shfuqizuar ato ligje pasi nuk ishin nxjerr\u00eb n\u00eb p\u00ebrputhje me parimet kushtetuese.<\/p>\n<p>N\u00eb ndryshim nga dy her\u00ebt e tjera, k\u00ebsaj here ka nj\u00eb qasje shum\u00eb t\u00eb ashp\u00ebr nga politika dhe mazhoranca n\u00eb pushtet. Presioni politik \u00ebsht\u00eb evident deri n\u00eb nivel arrogant. Batutat \u201cdo t\u2019i nxjerrim jasht\u00eb me shqelma\u201d t\u00eb artikuluara nga ministra, jan\u00eb shprehje q\u00eb distancojn\u00eb qeverin\u00eb nga funksionimi i shtetit t\u00eb s\u00eb drejt\u00ebs. K\u00ebsaj here situata \u00ebsht\u00eb trajtuar si emergjente dhe K\u00ebshilli i Ministrave ka miratuar nj\u00eb akt normative me fuqin\u00eb e ligjit, i cili justifikohet vet\u00ebm n\u00eb situata t\u00eb urgjenc\u00ebs dhe nevoj\u00ebs ekstreme. Nj\u00eb risi tjet\u00ebr q\u00eb sjell\u00eb ky akt \u00ebsht\u00eb mohimi i t\u00eb drejt\u00ebs s\u00eb pezullimit t\u00eb urdh\u00ebrave t\u00eb ekzekutimit nga gjykatat.<\/p>\n<p>Duket qart\u00eb q\u00eb akti n\u00eb fjal\u00eb p\u00ebrb\u00ebn nj\u00eb prej vendimmarrjeve me cil\u00ebsin\u00eb m\u00eb t\u00eb dob\u00ebt nga ana e qeveris\u00eb aktuale. Ai \u00ebsht\u00eb n\u00eb t\u00eb nj\u00ebjt\u00ebn linj\u00eb defektoze sic \u00ebsht\u00eb edhe akti q\u00eb vendos taksat e palogjikshme p\u00ebr t\u00eb ngritur padi n\u00eb gjykat\u00eb, ose akti q\u00eb kufizon ekzekutimin e vendimeve gjyq\u00ebsore nga llogaria e buxhetit t\u00eb shtetit. Duket sikur atje n\u00eb zyr\u00eb ndonj\u00eb minist\u00ebr i cili ndjen fuqin\u00eb e maj\u00ebs s\u00eb stilolapsit t\u00eb tij, kujton se m\u00eb nj\u00eb t\u00eb r\u00ebn\u00eb t\u00eb saj do t\u00eb zgjidh\u00eb problemin e bezdisjes s\u00eb shtetit, duke shkelur me drit\u00ebshkurt\u00ebsi mbi parimet themelore mbi t\u00eb cilat ngrihet nj\u00eb shoq\u00ebri demokratike. Ministra si ai i dret\u00ebsis\u00eb q\u00eb e shikon shtetin dhe gjykatat si dyqanin e tij, apo ai i pun\u00ebve publike qe e sheh shtetin si cizme p\u00ebr t\u00eb kapur me shkelma qytetar\u00ebt, na duhet t\u2019i edukojm\u00eb me aksion ligjor t\u00eb mir\u00ebfillt\u00eb.<\/p>\n<p>Sigurisht q\u00eb n\u00eb rastin e qiramarr\u00ebsve t\u00eb pronave q\u00eb u jan\u00eb kthyer ish-pronar\u00ebve ekziston nj\u00eb debat i hapur, por qendra e tij duhet t\u00eb zhvendoset tek analiza e balanc\u00ebs s\u00eb interesave t\u00eb ligjsh\u00ebm t\u00eb pronar\u00ebve p\u00ebr t\u00eb g\u00ebzuar pron\u00ebn e tyre nga nj\u00ebra an\u00eb, dhe interesave t\u00eb ligjsh\u00ebm t\u00eb qiramarr\u00ebsve p\u00ebr strehim, mosc\u00ebnim t\u00eb siguris\u00eb juridike, mosdiskriminim, nga ana tjet\u00ebr. Ky debat b\u00ebhet zakonisht edhe n\u00eb instancat e gjykatave nd\u00ebrkomb\u00ebtare sic \u00ebsht\u00eb ajo e Strasburgut, apo komisione, si ai i OKB-s\u00eb. Res Publica ka pik\u00ebrisht k\u00ebt\u00eb q\u00ebllim, q\u00eb t\u00eb zhvendos\u00eb epiqendr\u00ebn e k\u00ebtij debati atje ku duhet dhe t\u2019i largohet sa m\u00eb shum\u00eb gjuh\u00ebs s\u00eb urrejtjes q\u00eb nxit konfliktin midis grupimeve, si pasoj\u00eb e pamjaftueshm\u00ebris\u00eb s\u00eb kultur\u00ebs juridike t\u00eb zyrtar\u00ebve t\u00eb lart\u00eb.<\/p>\n<p>Por cilat jan\u00eb pretendimet e qeramarr\u00ebsve? Ata kan\u00eb ngritur nj\u00eb s\u00ebr\u00eb pretendimesh q\u00eb kryesisht bazohen n\u00eb nenet 15, 17, 18 dhe 101 t\u00eb Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, nenet 6 dhe 8 t\u00eb Konvent\u00ebs Europiane p\u00ebr t\u00eb Drejtat e Njeriut, nenin 1 t\u00eb Protokollit 1 t\u00eb Konvent\u00ebs Europiane p\u00ebr t\u00eb Drejtat e Njeriut dhe nenet 2 e 11 t\u00eb Paktit Nd\u00ebrkomb\u00ebtar p\u00ebr t\u00eb Drejtat Ekonomike, Sociale dhe Kulturore. Le t\u2019i trajtojm\u00eb ato me rradh\u00eb:<\/p>\n<p>S\u00eb pari, Akti normativ i K\u00ebshillit t\u00eb Ministrave nr.3 dat\u00eb 1.08.2012, n\u00eb thelbin e tij k\u00ebrkon t\u00eb realizoj\u00eb rregullimin e marr\u00ebdh\u00ebnies qeramarr\u00ebs dhe ish pronar\u00eb p\u00ebrmes marrjes s\u00eb nj\u00eb kredie, pavar\u00ebsisht nga kushtet e saj, n\u00eb t\u00eb nj\u00ebjt\u00ebn m\u00ebnyr\u00eb si\u00e7 edhe parashikonte edhe ligji nr. 9235 dhe ligji nr .9583. K\u00ebto rregullime ligjore jan\u00eb shfuqizuar nga Gjykata Kushtetuese. N\u00eb k\u00ebto vendime arsyetohet shkelja e parimeve t\u00eb r\u00ebnd\u00ebsishme kushtetuese, q\u00eb lidhen direkt me t\u00eb drejta t\u00eb njohura dhe garantuara n\u00eb Kushtetut\u00eb si parimit t\u00eb siguris\u00eb juridike, si dhe konstatohet nj\u00eb trajtim diskriminues ndaj shtres\u00ebs s\u00eb qeramarr\u00ebsve, duke iu c\u00ebnuar t\u00eb drejt\u00ebn e tyre p\u00ebr t\u00eb jetuar dhe t\u00eb drejt\u00ebn p\u00ebr pasjen e nj\u00eb strehe. Fundja ata duan t\u00eb trajtohen nj\u00eblloj si 230 mij\u00eb familjet e tjera q\u00eb shteti u mund\u00ebsoi blerjen e nj\u00eb apartamenti me cmim favorizues.<\/p>\n<p>S\u00eb dyti, Akti Normativ nuk ofron nj\u00eb zgjidhje efektive t\u00eb strehimit t\u00eb kategoris\u00eb n\u00eb fjal\u00eb pasi pushteti vendor nuk ka informacion n\u00ebse disponon mjetet dhe fondet e duhura p\u00ebr t\u00eb realizuar procesin, si dhe BKT nuk bind se disponon mjetet e mjaftueshme p\u00ebr t\u00eb p\u00ebrballuar procesin e kredidh\u00ebnies. Sikur t\u00eb mos mjaftonin k\u00ebto, shum\u00eb prej k\u00ebrkuesve nuk mund t\u00eb p\u00ebrfitojn\u00eb kredin\u00eb me interes zero, pasi ata jan\u00eb shum\u00eb t\u00eb moshuar, jo t\u00eb gjith\u00eb jan\u00eb t\u00eb lir\u00eb nga detyrime t\u00eb tjera, pagat nuk i kan\u00eb n\u00eb nivel t\u00eb mjaftuesh\u00ebm, si dhe nuk kan\u00eb mund\u00ebsi t\u00eb p\u00ebrballojn\u00eb pjes\u00ebn prej 30% t\u00eb blerjes s\u00eb nj\u00eb apartamenti n\u00eb momentin q\u00eb banka nuk financon m\u00eb shum\u00eb se 70% t\u00eb vler\u00ebs s\u00eb tij. N\u00eb t\u00ebr\u00ebsin\u00eb e zgjidhjeve t\u00eb ofruara, duke qart\u00eb se ato jan\u00eb b\u00ebr\u00eb sa p\u00ebr t\u2019u justifikuar se gjoja ka zgjidhje, por ato nuk jan\u00eb efektive.<\/p>\n<p>S\u00eb treti, Akti Normativ sjell nj\u00eb regres t\u00eb t\u00eb drejtave. T\u00eb drejtat e k\u00ebsaj kategorie jan\u00eb pak\u00ebsuar. Masat regresive duhet t\u00eb b\u00ebhen vet\u00ebm p\u00ebr arsye shum\u00eb t\u00eb justifikuara n\u00eb raport me totalin e t\u00eb drejtave. Ato duhet t\u00eb jen\u00eb t\u00eb qarta dhe t\u00eb justifikuara mir\u00eb. Qeveria nuk ka arritur t\u00eb demonstroj\u00eb se nuk kishte asnj\u00eb mund\u00ebsi tjet\u00ebr pasi mori n\u00eb konsiderat\u00eb t\u00eb gjitha alternativat e mundshme.<\/p>\n<p>S\u00eb kat\u00ebrti, \u00ebsht\u00eb mohuar mund\u00ebsia e pezullimit t\u00eb urdh\u00ebrave t\u00eb ekzekutimit nga gjykata, n\u00eb kund\u00ebrshtim ligjin. N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb gjykata nuk ushtron dot funksionet e saj t\u00eb kontrollit mbi administrat\u00ebn. Akti gjithashtu p\u00ebrmban edhe gabime t\u00eb tilla si p\u00ebr shembull urdh\u00ebrat e ekzekutimit do t\u00eb k\u00ebrkohen nga Enti Komb\u00ebtar i Banesave dhe jo nga vet\u00eb pronar\u00ebt sic e k\u00ebrkon ligji. N\u00eb k\u00ebto kushte, shihet qart\u00eb se Akti Normativ \u00ebsht\u00eb nj\u00eb corb\u00eb me probleme t\u00eb m\u00ebdha legjitimimi, sidomos nga ana substanciale dhe se Avokati i Popullit theksonte se edhe gjuha e p\u00ebrdorur \u00ebsht\u00eb e pap\u00ebrshtatshme duke futur fjal\u00eb q\u00eb nuk p\u00ebrfaq\u00ebsojn\u00eb koncepte juridik\u00eb.<\/p>\n<p>S\u00eb pesti, Akti Normativ \u00ebsht\u00eb marr\u00eb n\u00eb kund\u00ebrshtim me nenin 101 t\u00eb Kushtetut\u00ebs, pasi nuk verifikohet urgjenca, si dhe natyra e masave q\u00eb merren nuk jan\u00eb t\u00eb p\u00ebrkohshme por t\u00eb p\u00ebrhershm\u00eb. \u00cbsht\u00eb e v\u00ebrtet\u00eb q\u00eb \u00ebsht\u00eb e nevojshme t\u00eb gjendet nj\u00eb zgjidhje finale p\u00ebr kthimin e banesave tek pronar\u00ebt e ligjsh\u00ebm, por kjo nevoj\u00eb nuk \u00ebsht\u00eb urgjente deri n\u00eb nivelin e marrjes s\u00eb nj\u00eb mase t\u00eb till\u00eb ekstreme nga qeveria e jo nga Kuvendi. Kjo situat\u00eb ka qen\u00eb e till\u00eb prej 20 vjet\u00ebsh. Q\u00eb nga viti 2007 kur daton vendimi i fundit i Gjykta\u00ebs Kushtetues e deri m\u00eb sot qeveria nuk e pa si urgjente situat\u00ebn. M\u00eb 01.08.2012 kjo nevoj\u00eb u b\u00eb befas urgjente, n\u00eb mesin e pushimeve verore. Qeveria nuk mori as mundimin t\u00eb shpjegoj\u00eb urgjenc\u00ebn q\u00eb e detyroi t\u00eb nxjerr\u00eb aktin normativ. Madje edhe n\u00eb diskutimet n\u00eb Kuvend bie n\u00eb sy vazhdimisht vet\u00ebm argumentimi i nevoj\u00ebs por aspak i urgjenc\u00ebs.<\/p>\n<p>Gjithashtu masat e marra nuk jan\u00eb t\u00eb p\u00ebrkohshme, pasi lirimi i banesave, lidhja e kredive afatgjata me interes zero, apo qoft\u00eb edhe d\u00ebrgimi i t\u00eb moshuarve t\u00eb jetojn\u00eb n\u00eb azil jan\u00eb masa me karakter t\u00eb p\u00ebrhersh\u00ebm q\u00eb nuk lidhen me ndonj\u00eb zgjidhje t\u00eb p\u00ebrkohshme p\u00ebr shkak t\u00eb ndonj\u00eb situtate emergjente.<\/p>\n<p>N\u00eb mb\u00ebshtetje t\u00eb k\u00ebtyre argumentave jan\u00eb edhe vendimet e m\u00ebparsh\u00ebm t\u00eb Gjykat\u00ebs Kushtetuese, por edhe vendime t\u00eb ngjash\u00ebm t\u00eb Gjykat\u00ebs Europiane t\u00eb t\u00eb Drejtave t\u00eb Njeriut, si c\u00ebshtja Yordanova kund\u00ebr Bullgaris\u00eb apo Gasimova kund\u00ebr Azerbajxhanit, ku jan\u00eb theksuar t\u00eb nj\u00ebjtat qendrime n\u00eb raport me kufizimin e t\u00eb drejt\u00ebs s\u00eb pronar\u00ebve kur shtetit i vihet p\u00ebrpara t\u00eb zgjidh\u00eb problemin e strehimit adekuat dhe p\u00ebrfundimtar t\u00eb poseduesit t\u00eb pronave n\u00eb fjal\u00eb. Madje n\u00eb c\u00ebshtjen bullgare, Gjykata e Strasburgut urdh\u00ebroi qeverin\u00eb q\u00eb t\u00eb pezullnte zbatimin e ligjit gjat\u00eb koh\u00ebs s\u00eb gjykimit.<\/p>\n<p>Nj\u00eb k\u00ebrkes\u00eb e till\u00eb p\u00ebr pezullimin e k\u00ebtij akti \u00ebsht\u00eb paraqitur edhe n\u00eb rastin konkret nga shoqata k\u00ebrkuese, ku theksohet se zbatimi i Aktit Normativ do te sillte pasoja serioze dhe te parikuperueshme. Pasojat mund t\u00eb jen\u00eb fizike sepse qiramarr\u00ebsit vazhdojn\u00eb t\u00eb jetojn\u00eb n\u00eb k\u00ebto banesa dhe se n\u00eb mes t\u00eb muajit n\u00ebntor do t\u00eb jemi p\u00ebrpara faktit t\u00eb kryer t\u00eb hedhjes n\u00eb rrug\u00eb t\u00eb mij\u00ebra familjeve. Kjo ndodh n\u00eb nj\u00eb koh\u00eb q\u00eb qeveria nuk ka kryer asnj\u00eb studim t\u00eb mir\u00ebfillt\u00eb e t\u00eb detajuar p\u00ebr familjet e pastreha se si paraqitet gjendja e tyre reale. Nuk dihet sa \u00ebsht\u00eb numri i t\u00eb moshuarve, grave shtatz\u00ebna, foshnjeve, invalid\u00ebve. Nuk dihet fare gjendja ekonomike e tyre. Nuk dihet se n\u00eb cil\u00ebn vler\u00eb qeramarr\u00ebsit kan\u00eb b\u00ebr\u00eb investime t\u00eb reja n\u00eb k\u00ebto banesa, shtesa, rikonstruksione, instalime, etj. Afati gjithashtu \u00ebsht\u00eb shum\u00eb i shkurt\u00ebr dhe jasht\u00eb logjik\u00ebs normale. Koha e zgjedhur \u00ebsht\u00eb e pap\u00ebrshtatshme, pasi po hyjm\u00eb n\u00eb stin\u00ebn e ftoht\u00eb. Autor\u00ebt e aktit nuk kan\u00eb menduar fare se ku do i cojn\u00eb njer\u00ebzit mobiljet, sa koh\u00eb do t\u2019i duhen t\u2019i transportojn\u00eb ato, cdo ndodh\u00eb me ata f\u00ebmij\u00eb apo t\u00eb moshuar q\u00eb do t\u00eb traumatizohen, etj.<\/p>\n<p>Situata paraqet rrezikun e nj\u00eb d\u00ebmi real dhe t\u00eb r\u00ebnd\u00eb sepse ndryshon n\u00eb m\u00ebnyr\u00eb drastike m\u00ebnyr\u00ebn e jetes\u00ebs s\u00eb njer\u00ebzve, t\u00eb cil\u00ebt do t\u00eb rrezikojn\u00eb t\u00eb humbasin vendet e pun\u00ebs p\u00ebr shkak t\u00eb diskonfortit t\u00eb krijuar. F\u00ebmij\u00ebt do t\u00eb bien ndjesh\u00ebm n\u00eb m\u00ebsime pasi nuk do ken\u00eb ku t\u00eb m\u00ebsojn\u00eb. T\u00eb s\u00ebmur\u00ebt do ta ken\u00eb mjaft t\u00eb v\u00ebshtir\u00eb dhe do rrezikojn\u00eb edhe jet\u00ebn. Madje edhe konfliktet me pronar\u00ebt do t\u00eb rrezikojn\u00eb degradimin deri n\u00eb pasoja t\u00eb r\u00ebnda p\u00ebr rendin.<\/p>\n<p>D\u00ebmi \u00ebsht\u00eb i pariparuesh\u00ebm gjithashtu, pasi po nuk u pezullua zbatimi i aktit nuk ka gjasa q\u00eb situata t\u00eb rikthehet n\u00eb normalitet, edhe sikur Gjykata Kushtetuese t\u00eb vendos\u00eb pozitivisht. Pronar\u00ebt po nisin t\u00eb marrin masa q\u00eb k\u00ebto prona ti shnd\u00ebrrojn\u00eb shum\u00eb shpejt n\u00eb sheshe nd\u00ebrtimi, duke furnizuar tregun e pasurive t\u00eb paluajtshme dhe at\u00eb t\u00eb nd\u00ebrtimeve. N\u00eb k\u00ebto kushte askush nga banor\u00ebt aktuale nuk do t\u00eb rikthehet n\u00eb gjendjen e tij t\u00eb m\u00ebparshme.<\/p>\n<p>Pasojat do t\u00eb ken\u00eb edhe nj\u00eb dimension social, pasi \u00ebsht\u00eb e ngarkuar me emocione negative nga retorika politike e p\u00ebrdorur nga p\u00ebrfaq\u00ebsues n\u00eb qeveris\u00eb n\u00eb Kuvend dhe n\u00eb media. Ata jan\u00eb p\u00ebrpjekur t\u00eb tregojn\u00eb se k\u00ebrkuesit jan\u00eb uzurpues abuzues, pasardh\u00ebs t\u00eb atyre q\u00eb dikur dhunonin shtres\u00ebn tjet\u00ebr, at\u00eb t\u00eb ish-pronar\u00ebve, t\u00eb cil\u00ebt sot presin t\u00eb g\u00ebzojn\u00eb pron\u00ebn e tyre por q\u00eb nuk po e g\u00ebzojn\u00eb p\u00ebr fajin e uzurpuesve. Batuta se m\u00eb 1 n\u00ebntor do t\u2019i nxjerrim me shqelma nga sht\u00ebpit\u00eb krijon iden\u00eb sikur k\u00ebta individ\u00eb nuk kan\u00eb pasur kurr\u00eb kontrata t\u00eb rregullta me shtetin, nuk jan\u00eb p\u00ebrkrahur kurr\u00eb nga Gjykata Kushtetuese. Ata po trajtohen nj\u00eblloj sikur k\u00ebta t\u00eb ishin nj\u00eb band\u00eb harbute abuzive q\u00eb tallet me ndjenjat e pronar\u00ebve t\u00eb shkret\u00eb. Retorika politike \u00ebsht\u00eb p\u00ebrpjekur t\u00eb paraqes\u00eb k\u00ebrkuesit si shkaktar\u00eb t\u00eb problemit real dhe si fajtor\u00eb pse pronar\u00ebt ende sot nuk g\u00ebzojn\u00eb pronat e tyre, duke fshehur faktin e v\u00ebrtet\u00eb se ka qen\u00eb paaft\u00ebsia e autoriteteve shtet\u00ebrore n\u00eb koh\u00eb t\u00eb ndryshme p\u00ebr t\u00eb zgjidhur p\u00ebrfundimisht problemin e qeramarr\u00ebsve, duke sjell\u00eb moszgjidhjen automatike t\u00eb problemit t\u00eb pronar\u00ebve. P\u00ebr k\u00ebt\u00eb arsye ka gjasa t\u00eb forta q\u00eb t\u00eb pronar\u00ebt t\u00eb jen\u00eb ngarkuar emocionalisht. Nga ana tjet\u00ebr, nga qeramarr\u00ebsit pritet q\u00eb t\u00eb ket\u00eb rezistenc\u00eb, e cila mund t\u00eb sjell\u00eb konflikte me pasoja t\u00eb r\u00ebnda p\u00ebr rendin.<\/p>\n<p>Por, nuk do mungojn\u00eb as pasojat e d\u00ebmshme juridike, pasi n\u00eb zbatim t\u00eb Aktit Normativ do t\u00eb nis\u00eb nj\u00eb vazhd\u00eb e t\u00ebr\u00eb marr\u00ebdheniesh juridike, t\u00eb cilat n\u00ebse akti do t\u00eb konsiderohet nul nga Gjykata Kushtetuese, edhe t\u00eb gjith\u00eb aktet e bazuara n\u00eb t\u00eb nuk do t\u00eb ken\u00eb vler\u00eb. Nd\u00ebrkoh\u00eb q\u00eb do t\u00eb jet\u00eb krijuar nj\u00eb katrahur\u00eb juridike me p\u00ebrmasa t\u00eb frikshme, duke p\u00ebrmendur k\u00ebtu lidhjen e qindra apo mij\u00ebra kontratave kredie n\u00eb kushtet e nevoj\u00ebs s\u00eb madhe; mij\u00ebra urdh\u00ebrave ekzekutiv\u00eb q\u00eb do t\u00eb dalin t\u00eb paligjsh\u00ebm dhe t\u00eb pavlefsh\u00ebm, nd\u00ebrkoh\u00eb q\u00eb p\u00ebrmbaruesit do t\u00eb ken\u00eb marr\u00eb pagesat e tarifave paradh\u00ebnie, etj.<\/p>\n<p>T\u00eb gjitha k\u00ebto pasoja fizike, sociale dhe juridike, do t\u00eb mund t\u00eb eliminoheshin n\u00ebse Gjykata Kushtetuese do t\u00eb pranoj\u00eb k\u00ebrkes\u00ebn p\u00ebr pezullimin e zbatimit t\u00eb Aktit Normativ deri n\u00eb p\u00ebrfundim t\u00eb gjykimit.<br \/>\nK\u00ebt\u00eb nism\u00eb e ka mb\u00ebshtetur edhe Avokati i Popullit i cili m\u00eb 10.09.2012 i ka d\u00ebrguar Kuvendit nj\u00eb shkres\u00eb ku thekson s\u00eb Akti Normativ \u00ebsht\u00eb i papajtuesh\u00ebm me Kushtetut\u00ebn. Ai thekson se shkelet parimi i siguris\u00eb juridike, si dhe konstatohet nj\u00eb trajtim diskriminues ndaj shtres\u00ebs s\u00eb qeramarr\u00ebsve. Avokati i Popullit nd\u00ebr t\u00eb tjera shprehet se nuk \u00ebsht\u00eb p\u00ebrligjur nevoja dhe urgjenca dhe se masat q\u00eb do t\u00eb rezultojn\u00eb prej zbatimit t\u00eb tij, kan\u00eb karakter t\u00eb p\u00ebrhersh\u00ebm. Afatet e p\u00ebrcaktuara p\u00ebr kryerjen e procedurave t\u00eb nevojshme nga organet komptente t\u00eb p\u00ebrcaktuara n\u00eb k\u00ebt\u00eb akt, jan\u00eb ekstremisht t\u00eb shkurtra. Akti ndalon pa t\u00eb drejt\u00eb vendimmarrjen e Gjykat\u00ebs kompetente t\u00eb Shkall\u00ebs s\u00eb Par\u00eb, dhe se nuk ndodhemi para rastit t\u00eb ekzistenc\u00ebs s\u00eb interesit publik, gj\u00eb q\u00eb do t\u00eb legjitimonte c\u00ebnimin e parimit t\u00eb siguris\u00eb juridike. Nd\u00ebrhyrja efektive e shtetit nuk ka q\u00ebn\u00eb n\u00eb nivelin e duhur p\u00ebr t\u00eb realizuar n\u00eb fakt nj\u00eb t\u00eb drejt\u00eb q\u00eb individ\u00ebve u garantohet nga Kushtetuta dhe gjith\u00eb kuadri ligjor ekzistues.<\/p>\n<p>M\u00eb 29 tetor shum\u00eb prej momenteve t\u00eb diskutuesh\u00ebm m\u00eb lart do t\u00eb marrin nj\u00eb p\u00ebrgjigje nga Gjykata Kushtetuese. Kjo p\u00ebrgjigje pritet t\u00eb jet\u00eb n\u00eb linj\u00ebn e qendrimeve t\u00eb m\u00ebparshme t\u00eb k\u00ebsaj gjykate. P\u00ebr k\u00ebt\u00eb arsye inkurajojm\u00eb pronar\u00ebt q\u00eb t\u00eb jen\u00eb t\u00eb pranish\u00ebm n\u00eb procesin kushtetues t\u00eb dat\u00eb 29 tetor n\u00eb or\u00ebn 10.00, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb kuptojn\u00eb si qendron e v\u00ebrteta, cilat jan\u00eb t\u00eb drejtat e tyre dhe deri ku shtrihet kufijt\u00eb e k\u00ebsaj t\u00eb drejte, si dhe t\u00eb kuptojn\u00eb se fajtor i vet\u00ebm q\u00eb ata nuk po g\u00ebzojn\u00eb pronat e tyre \u00ebsht\u00eb shteti, i cili gjithnj\u00eb ka ofruar zgjidhje t\u00eb karakterizuara nga demagogjia politike e momentit. N\u00ebse shteti do t\u00eb kishte ofruar me koh\u00eb zgjidhjen e pranueshme p\u00ebr qiramarr\u00ebsit, at\u00ebher\u00eb pronar\u00ebt do i kishin marr\u00eb pronat shum\u00eb koh\u00eb m\u00eb par\u00eb. Mungesa e vizionit dhe e kultur\u00ebs s\u00eb politik\u00ebb\u00ebr\u00ebsave, e kombinuar me munges\u00ebn reale t\u00eb interesit t\u00eb tyre p\u00ebr t\u00eb gjetur zgjidhje definitive t\u00eb k\u00ebtij problemi ka sjell\u00eb pasoj\u00ebn q\u00eb r\u00ebndon n\u00eb kurriz t\u00eb pronar\u00ebve.<\/p>\n<p>Pronar\u00ebt duhet t\u00eb qendrojn\u00eb gjakftoht\u00eb n\u00eb gjykimin e c\u00ebshtjes, dhe n\u00ebse Gjykata Kushtetuese do rr\u00ebzoj\u00eb edhe k\u00ebt\u00eb akt normativ, at\u00ebher\u00eb zhg\u00ebnjimi duhet t\u00eb b\u00ebhet m\u00ebsim p\u00ebr t\u2019i b\u00ebr\u00eb presionin e duhur pozitiv qeveris\u00eb q\u00eb t\u00eb gjej\u00eb nj\u00eb zgjidhje p\u00ebrfundimtare t\u00eb problemit n\u00eb fjal\u00eb, t\u00eb till\u00eb q\u00eb t\u00eb jet\u00eb e aft\u00eb t\u00eb kaloj\u00eb provimin e Gjykat\u00ebs Kushtetuese nj\u00eb her\u00eb e mir\u00eb.<\/p>\n<p>D.
