Kur Kuvendi, Ministria e Drejt\u00ebsis\u00eb dhe ajo e Financave rrit\u00ebn taks\u00ebn e gjykat\u00ebs, askush nuk e mendoi q\u00eb kjo do t\u00eb krijonte nj\u00eb problem t\u00eb madh parimor.<\/p>\n<p>Askush nga Kuvendi nuk mendoi se dy ministrave po u lihej n\u00eb dor\u00eb kufizimi i nj\u00eb t\u00eb drejte themelore t\u00eb njeriut, i t\u00eb drejt\u00ebs p\u00ebr nj\u00eb proces t\u00eb rregullt ligjor. E drejta e aksesit n\u00eb gjykat\u00eb \u00ebsht\u00eb e p\u00ebrfshir\u00eb n\u00eb t\u00eb drejt\u00ebn e procesit t\u00eb rregullt ligjor dhe kjo e drejt\u00eb kufizohet vet\u00ebm me ligj, e jo me akte ministrash, p\u00ebr t\u00eb shmangur abuzimin me nj\u00eb t\u00eb drejt\u00eb t\u00eb till\u00eb kaq delikate nga autoritete q\u00eb nuk p\u00ebrfaq\u00ebsojn\u00eb vullnetin e sovranit, sikund\u00ebr \u00ebsht\u00eb Kuvendi.<\/p>\n<p>K\u00ebshtu Ministri i Drejt\u00ebsis\u00eb n\u00eb bashk\u00ebpunim me Ministrin e Financave, duke p\u00ebrdorur tashm\u00eb kompetenc\u00ebn e re t\u00eb dh\u00ebn\u00eb me ligj, parashikuan rritjen e taksave\/tarifave t\u00eb sh\u00ebrbimeve nga administrate gjyq\u00ebsore. Rritja e nivelit baz\u00eb u b\u00eb me 8 her\u00eb brenda nj\u00eb periudhe shum\u00eb t\u00eb shkurt\u00ebr kohore (fillimisht nga 1.500 lek\u00eb u rrit n\u00eb 3.000 dhe m\u00eb pas n\u00eb 12.000 lek\u00eb), nd\u00ebrsa rritja e nivelit t\u00eb lart\u00eb t\u00eb taks\u00ebs u b\u00eb me 3 her\u00eb, nga 1% n\u00eb 3% t\u00eb vler\u00ebs s\u00eb k\u00ebrkes\u00ebpadis\u00eb. Pra, p\u00ebr cdo 100.000 lek\u00eb q\u00eb k\u00ebrkoheshin nga gjykata duhej t\u00eb paguheshin 3.000 lek\u00eb.<\/p>\n<p>N\u00eb momentet e para ndaj k\u00ebtyre ndryshimeve pati reagime sporadike nga komuniteti i jurist\u00ebve, por m\u00eb shum\u00eb se kund\u00ebr rritjes s\u00eb vler\u00ebs, ata ishin kund\u00ebr faktit q\u00eb ky kufizim po miratohej me nj\u00eb akt ministror dhe jo me ligj sic k\u00ebrkon Kushtetuta. Zv. Ministri i asaj kohe, Z. Eduard Halimi, i cili sot \u00ebsht\u00eb Minist\u00ebr i Drejt\u00ebsis\u00eb, u shpreh p\u00ebr gazetaren M.Picari se rritja ishte e p\u00ebrballueshme pasi pal\u00ebt jan\u00eb t\u00eb aft\u00eb t\u00eb paguajn\u00eb avokat\u00ebt e tyre n\u00eb vlera disa her\u00eb m\u00eb t\u00eb larta se taksa e padis\u00eb. Ministri Halimi n\u00eb k\u00ebt\u00eb analiz\u00eb mori parasysh vet\u00ebm nj\u00eb pjes\u00eb t\u00eb realitetit shqiptar, sic \u00ebsht\u00eb ai i individ\u00ebve q\u00eb trokasin n\u00eb zyrat e avokat\u00ebve t\u00eb njohur, paguajn\u00eb shuma relativisht t\u00eb majme dhe taksa e padis\u00eb \u00ebsht\u00eb nj\u00eb formalitet i par\u00ebnd\u00ebsish\u00ebm p\u00ebr k\u00ebt\u00eb kategori n\u00eb mir\u00ebqenie ekonomike. Mir\u00ebpo individ\u00ebt e varf\u00ebr, t\u00eb cil\u00ebt nuk kan\u00eb mund\u00ebsi t\u00eb paguajn\u00eb as avokatin dhe as taks\u00ebn e padis\u00eb, nuk u mor\u00ebn parasysh. N\u00eb ligj apo edhe n\u00eb aktin e ministrit nuk ishte p\u00ebrfshir\u00eb asnj\u00eb klauzol\u00eb p\u00ebrjashtuese p\u00ebr individ\u00ebt q\u00eb nuk kan\u00eb aft\u00ebsi paguese. K\u00ebta individ\u00eb, duke mos pasur mund\u00ebsi objektive t\u00eb derdhin taks\u00ebn prej 12.000 lek\u00ebsh, apo prej 3% t\u00eb vler\u00ebs s\u00eb k\u00ebrkuar, ata nuk kan\u00eb t\u00eb drejt\u00eb t\u00eb d\u00ebgjohen nga nj\u00eb gjykat\u00eb e caktuar me ligj.<\/p>\n<p>Pa humbur shum\u00eb koh\u00eb nis\u00ebn t\u00eb verfikoheshin raste konkrete t\u00eb individ\u00ebve t\u00eb cil\u00ebt po u mohoej aksesi n\u00eb gjykat\u00eb dhe k\u00ebshtu nisi nj\u00eb p\u00ebrplasje me nj\u00eb konstante rritjeje p\u00ebr t\u00eb p\u00ebrmbysur k\u00ebt\u00eb realitet t\u00eb gabuar. Res Publica, me mb\u00ebshtetjen e Fondacionit \u201cShoq\u00ebria e Hapur p\u00ebr Shqip\u00ebrin\u00eb\u201d, ka sh\u00ebnuar disa raunde p\u00ebrpjekjesh, t\u00eb cilat kan\u00eb evoluar si m\u00eb posht\u00eb:<\/p>\n<p><b><i>\u00a0<\/i><\/b><\/p>\n<p><b><i>Raundi 1<\/i><\/b><\/p>\n<p>Reagimet e para zyrtare erdh\u00ebn nga Res Publica n\u00eb vitin 2010, kur para Gjykat\u00ebs s\u00eb Rrethit Gjyq\u00ebsor Tiran\u00eb u paraqit\u00ebn k\u00ebrkesat e para p\u00ebr p\u00ebrjashtimin nga taksa e padis\u00eb p\u00ebr familjar\u00ebt e viktimave t\u00eb G\u00ebrdecit. Shp\u00ebrthimi i 15 marsit 2008 ishte shkaku i ardhjes s\u00eb nj\u00eb pasoj\u00eb tep\u00ebr t\u00eb r\u00ebnd\u00eb, t\u00eb humbjes s\u00eb jet\u00ebs s\u00eb 26 shtetasve dhe Res Publica ngriti padi p\u00ebr familjet e 23 prej k\u00ebtyre viktimave. N\u00eb t\u00eb gjith\u00eb rastet konstatohej nj\u00eb d\u00ebm i madh, sic \u00ebsht\u00eb humbja e jet\u00ebs s\u00eb an\u00ebtar\u00ebve t\u00eb familjes, ku n\u00eb shum\u00eb raste ata kishin l\u00ebn\u00eb pas f\u00ebmij\u00eb t\u00eb mitur t\u00eb cil\u00ebt i kishin pasur n\u00eb ngarkim. Nga ana tjet\u00ebr niveli ekonomik i tyre ishte shum\u00eb i ul\u00ebt. Ky lloj kombinimi i nj\u00eb d\u00ebmi shum\u00eb t\u00eb madh me nj\u00eb nivel ekonomik shum\u00eb t\u00eb ul\u00ebt ishte dhe rasti m\u00eb flagrant i paaft\u00ebsis\u00eb objektive paguese n\u00eb raport me taks\u00ebn tep\u00ebr t\u00eb lart\u00eb, e cila varionte nga 500 mij\u00eb deri n\u00eb mbi 4 milion lek\u00eb (t\u00eb reja). Res Publica e gjendur n\u00eb t\u00eb tilla rrethana e pa t\u00eb arsyeshme t\u00eb investonte kapacitetet e saj p\u00ebr t\u00eb gjetur nj\u00eb zgjidhje p\u00ebrfundimtare t\u00eb problemit n\u00eb fjal\u00eb.<\/p>\n<p>Nj\u00eb nga m\u00ebnyrat e tentuara ishte orientimi i gjykat\u00ebs q\u00eb t\u00eb vler\u00ebsonte drejtp\u00ebrdrejt nenin 6 t\u00eb Konvent\u00ebs Europiane p\u00ebr t\u00eb Drejtat e Njeriut, i cili parimisht duhet t\u00eb gjej\u00eb zbatim para kodeve e ligjeve vendase. Me an\u00ebn e k\u00ebsaj p\u00ebrpjekjeje u synua q\u00eb t\u00eb testohej gjyq\u00ebsori, e m\u00eb pas t\u00eb konsolidohej praktika, duke e konsideruar baz\u00ebn ligjore q\u00eb siguronte Konventa si t\u00eb mjaftueshme. Por praktika tregoi se gjyqtar\u00ebt nuk ishin ende t\u00eb gatsh\u00ebm t\u00eb b\u00ebnim nj\u00eb kap\u00ebrcim t\u00eb till\u00eb parimor. N\u00eb diskutimet e b\u00ebra jepej gjithnj\u00eb mesazhi se parashikimet p\u00ebr kategori t\u00eb ve\u00e7anta personash duhej t\u00eb parashikoheshin me ligj dhe se parashikimet e Konvent\u00ebs ishin shum\u00eb t\u00eb p\u00ebrgjithshme, dhe t\u00eb pakuptueshme sidomos nga Kontrolli i Lart\u00eb i Shtetit. Ky institucion mund t\u00eb p\u00ebrb\u00ebnte nj\u00eb k\u00ebrc\u00ebnim serioz p\u00ebr gjykat\u00ebn dhe se asnj\u00eb nga gjyqtar\u00ebt nuk preferonte t\u00eb aventuronte n\u00eb uj\u00ebrat e trazuara t\u00eb p\u00ebrdorimit t\u00eb nj\u00eb diskrecioni t\u00eb keqinterpretuesh\u00ebm. Mesazhi i transmetuar ishte se niveli aktual i bot\u00ebkuptimit juridik k\u00ebrkonte zgjidhje m\u00eb konkrete, m\u00eb t\u00eb qarta, pa l\u00ebn\u00eb shum\u00eb hap\u00ebsira interpretimi.<\/p>\n<p><b><i>Raundi 2<\/i><\/b><\/p>\n<p>Pas d\u00ebshtimit t\u00eb zgjidhjes s\u00eb thjesht\u00eb dhe natyrale t\u00eb problemit, Res Publica mori p\u00ebrsip\u00ebr t\u00eb komunikonte me vet\u00eb Ministrin e Drejt\u00ebsis\u00eb Z. Bujar Nishani, t\u00eb cilit iu drejtua me nj\u00eb shkres\u00eb m\u00eb 18.03.2011. N\u00eb shkres\u00eb b\u00ebhej nj\u00eb analiz\u00eb e qart\u00eb e penges\u00ebs q\u00eb p\u00ebrb\u00ebnte taksa e padis\u00eb prej 3% t\u00eb vler\u00ebs s\u00eb k\u00ebrkuar.<\/p>\n<p>Duke qen\u00eb se sipas llogaritjeve, nisur nga praktikat vendase por edhe ato t\u00eb Gjykat\u00ebs Europiane t\u00eb t\u00eb Drejtave t\u00eb Njeriut, shifrat e k\u00ebrkuara n\u00eb k\u00ebrkes\u00eb padi do t\u00eb ishin mbi 100.000 Euro p\u00ebr familjar, ndaj edhe taksa n\u00eb k\u00ebto raste do t\u00eb llogaritej t\u00eb pakt\u00ebn n\u00eb mas\u00ebn 3000 Euro. Kjo shif\u00ebr ishte e pap\u00ebrballueshme, n\u00ebse merrej n\u00eb konsiderat\u00eb q\u00eb shum\u00eb padit\u00ebs ishin pa pun\u00eb dhe pa t\u00eb ardhura t\u00eb tjera, si dhe t\u00eb tjer\u00ebt q\u00eb ishin t\u00eb pun\u00ebsuar, kishin t\u00eb ardhura n\u00ebn 200 Euro n\u00eb muaj, duke e pasur edhe k\u00ebta t\u00eb pamundur aksesin n\u00eb gjykat\u00eb. Sipas llogaritjeve k\u00ebrkimi i nj\u00eb t\u00eb drejte t\u00eb ligjshme duhej shoq\u00ebruar me nj\u00eb sakrific\u00eb prej vitesh, sikur k\u00ebta njer\u00ebz t\u00eb mos konsumonin asgj\u00eb dhe paga e tyre t\u00eb shkonte vet\u00ebm p\u00ebr t\u00eb paguar taks\u00ebn e padis\u00eb. Situata b\u00ebhej edhe m\u00eb e v\u00ebshtir\u00eb n\u00ebse merrnim n\u00eb konsiderat\u00eb faktin q\u00eb k\u00ebto nivele t\u00eb ardhurash ishin shum\u00eb af\u00ebr minimumit jetik, duke b\u00ebr\u00eb praktikisht t\u00eb pamundur kursimin e cdo qindarke. N\u00eb k\u00ebto kushte, familjar\u00ebt e viktimave t\u00eb G\u00ebrdecit nuk mund t\u00eb ushtronin t\u00eb drejt\u00ebn q\u00eb t\u2019i drejtohen gjykat\u00ebs n\u00ebse ky nivel i taks\u00ebs do t\u00eb q\u00ebndronte i pal\u00ebkundur para tyre dhe nuk do t\u00eb kishte asnj\u00eb p\u00ebrjashtim.<\/p>\n<p>Ministrit Nishani iu b\u00eb e qart\u00eb se Kodi i Procedur\u00ebs Civile parashikon mund\u00ebsit\u00eb e p\u00ebrjashtimit nga taksa, por kushtet dhe kriteret ia delegon legjislacionit p\u00ebrkat\u00ebs p\u00ebr taksat. Ligji p\u00ebr taksat nga ana tjet\u00ebr nuk parashikon asgj\u00eb n\u00eb lidhje me p\u00ebrjashtimin nga pagimi i taks\u00ebs t\u00eb atyre individ\u00ebve q\u00eb nuk kan\u00eb mund\u00ebsi ta paguajn\u00eb at\u00eb, apo cfar\u00ebdo lloj kategorie tjet\u00ebr. K\u00ebrkesa iu drejtua Ministrit t\u00eb Drejt\u00ebsis\u00eb dhe Ministrit t\u00eb Financave pasi ata ishin autoritetet q\u00eb kan\u00eb kompetenc\u00ebn t\u00eb p\u00ebrcaktojn\u00eb modalitetet e k\u00ebsaj takse.<\/p>\n<p>P\u00ebr qendr\u00ebn Res Publica ishte jasht\u00eb logjike q\u00eb k\u00ebrkimi n\u00eb rrug\u00eb gjyq\u00ebsore i d\u00ebmit t\u00eb humbjes s\u00eb jet\u00ebs, i cili p\u00ebr nga vet\u00eb natyra e tij \u00ebsht\u00eb shum\u00eb i madh, t\u00eb kusht\u00ebzohej nga nj\u00eb prag takse t\u00eb pakap\u00ebrcyesh\u00ebm. Ministrit iu k\u00ebrkua q\u00eb t\u00eb vler\u00ebsonte edhe faktin se n\u00eb rastin konkret d\u00ebmi pretendohej t\u00eb kishte ardhur nga veprimtaria shtet\u00ebrore dhe shteti nuk mundej dhe nuk duhej t\u00eb p\u00ebrdorte instrumenta pengues sic \u00ebsht\u00eb taksa e pakap\u00ebrcyeshme p\u00ebr t\u00eb nisur aksionin ligjor kund\u00ebr vet\u00eb administrat\u00ebs shtet\u00ebrore. Ministrit iu k\u00ebrkua t\u00eb vler\u00ebsonte drejt parimin e aksesit t\u00eb domosdosh\u00ebm n\u00eb gjykat\u00eb, i mbrojtur fuqimisht nga Konventa Europiane e t\u00eb Drejtave t\u00eb Njeriut dhe i konsoliduar nga jurisprudence e Gjykat\u00ebs Europiane p\u00ebr t\u00eb Drejtat e Njeriut n\u00eb Strasburg.<\/p>\n<p>P\u00ebrsa i p\u00ebrket teknikave t\u00eb gjetjes s\u00eb zgjidhjes, qendra Res Publica, u shprej e gatshme t\u00eb vinte n\u00eb dispozicion kapacitetet e saj p\u00ebr t\u00eb dh\u00ebn\u00eb ndihmes\u00ebn e saj me k\u00ebshillimet dhe draftimet e nevojshme.<\/p>\n<p>Mir\u00ebpo Ministri i Drejt\u00ebsis\u00eb dhe ai i Financave nuk kthyen asnj\u00ebher\u00eb nj\u00eb p\u00ebrgjigje zyrtare ndaj k\u00ebsaj shkrese, duke detyruar Res Publican t\u00eb ulej n\u00eb stolin e pushimit dhe t\u00eb p\u00ebrgatitej p\u00ebr raundin e tret\u00eb.<\/p>\n<p><b><i>\u00a0<\/i><\/b><\/p>\n<p><b><i>Raundi 3<\/i><\/b><\/p>\n<p>Duke par\u00eb se sistemi nuk krijonte shum\u00eb mund\u00ebsi efektive p\u00ebr zgjidhjen e k\u00ebtij problemi, Res Publica vendosi t\u00eb testoj\u00eb nj\u00eb zgjidhje t\u00eb pazakont\u00eb, at\u00eb t\u00eb d\u00ebrgimit t\u00eb nj\u00eb \u00e7\u00ebshtjeje direkt n\u00eb Gjykat\u00ebn Europiane p\u00ebr t\u00eb Drejtat e Njeriut, pa pritur t\u00eb ezauroheshin m\u00eb par\u00eb ankimet n\u00eb gjykatat vendase. Kjo lloj praktike pranohet rrall\u00eb, por nuk p\u00ebrjashtohet si mund\u00ebsi. Gjykata e Strasburgut n\u00eb raste t\u00eb vecant\u00eb merr n\u00eb shqyrtim c\u00ebshtje edhe kur krijon bindjen se ankimi n\u00eb gjykatat vendase \u00ebsht\u00eb t\u00ebr\u00ebsisht inefektiv. K\u00ebshtu nj\u00eb individ (R. Bregu) q\u00eb jetonte me ndihm\u00eb ekonomike dhe k\u00ebrkonte t\u00eb celte nj\u00eb gjyq pik\u00ebrisht n\u00eb lidhje me t\u00eb ardhurat e tij, nuk kishte mund\u00ebsi reale p\u00ebr t\u2019u d\u00ebgjuar nga gjykata pasi objektivisht nuk kishte asnj\u00eb mund\u00ebsi t\u00eb paguante taks\u00ebn e padis\u00eb. Sipas praktik\u00ebs s\u00eb gjykat\u00ebs vlera e taks\u00ebs merret n\u00eb sportel n\u00eb momentin e depozitimit t\u00eb saj dhe kompetenca e dh\u00ebn\u00eb sekretaris\u00eb s\u00eb gjykat\u00ebs n\u00eb praktik\u00eb \u00ebsht\u00eb e paankimueshme n\u00eb gjykata m\u00eb t\u00eb larta p\u00ebr shkak t\u00eb vet\u00eb natyr\u00ebs s\u00eb saj m\u00eb shum\u00eb faktike se juridike.<\/p>\n<p>C\u00ebshtja \u00ebsht\u00eb ende n\u00eb pritje t\u00eb shqyrtimit t\u00eb saj, por sigurisht q\u00eb p\u00ebr nga natyra e saj nuk ofron garancit\u00eb e duhura p\u00ebr zgjidhje. K\u00ebshtu Res Publica preferoi t\u00eb mos humbte koh\u00eb por t\u00eb k\u00ebrkonte zgjidhje t\u00eb tjera.<\/p>\n<p><b><i>\u00a0<\/i><\/b><\/p>\n<p><b><i>Raundi 4<\/i><\/b><\/p>\n<p>Q\u00eb nga prilli 2011 e deri n\u00eb maj 2012 Res Publica paraqiti n\u00eb cdo rast n\u00eb gjyqet e familjar\u00ebve t\u00eb viktimave t\u00eb G\u00ebrdecit, dhe n\u00eb gjyqe t\u00eb tjer\u00eb, mbi 20 k\u00ebrkesa p\u00ebr p\u00ebrjashtim nga taksa e padis\u00eb. N\u00eb cdo rast k\u00ebrkesat u shoq\u00ebruan me dokumenta provuese q\u00eb tregonin nivelin e ul\u00ebt t\u00eb t\u00eb ardhurave t\u00eb aplikant\u00ebve, t\u00eb cil\u00ebt n\u00eb pjes\u00ebn d\u00ebrrmuese ishin pa pune, pa pasuri t\u00eb paluajtshme, pa biznese t\u00eb regjistruara n\u00eb organet tatimore, t\u00eb patrajtuar me tok\u00eb bujq\u00ebsore, pensionist\u00eb, nx\u00ebn\u00ebs shkollash, persona t\u00eb trajtuar me ndihm\u00eb ekonomike, t\u00eb mitur, etj. N\u00eb t\u00eb gjith\u00eb rastet gjyqtar\u00ebt kan\u00eb hezituar t\u00eb dalin me nj\u00eb vendim pro apo kund\u00ebr k\u00ebtyre k\u00ebrkesave, duke gjetur moduse p\u00ebr t\u00eb shtyr\u00eb zgjidhjen n\u00eb seancat pasardh\u00ebse.<\/p>\n<p>Risia e k\u00ebtyre k\u00ebrkesave ishte shoq\u00ebrimi i tyre me nj\u00eb k\u00ebrkes\u00eb alternative, q\u00eb ishte k\u00ebrkesa p\u00ebr kontroll incidental t\u00eb ligjit p\u00ebr taksat me Kushtetut\u00ebn dhe Konvent\u00ebn Europiane p\u00ebr t\u00eb Drejtat e Njeriut. P\u00ebr her\u00eb t\u00eb par\u00eb gjykat\u00ebs iu dha mund\u00ebsia q\u00eb t\u00eb zgjedh\u00eb n\u00eb mes k\u00ebtyre objekteve at\u00eb q\u00eb konsideronte m\u00eb t\u00eb p\u00ebrshtatsh\u00ebm. Madje u ofrua si e pranueshme edhe nj\u00eb zgjidhje e tret\u00eb, ajo e pages\u00ebs s\u00eb m\u00ebvonshme apo e ndarjes me k\u00ebste t\u00eb taks\u00ebs s\u00eb padis\u00eb. Mir\u00ebpo n\u00eb cdo rast gjykata hezitoi p\u00ebr t\u00eb zgjedhur edhe midis k\u00ebtyre varianteve.<\/p>\n<p>Nd\u00ebrmjet argumentave t\u00eb ndrysh\u00ebm q\u00eb u soll\u00ebn n\u00eb v\u00ebmendjen e gjykat\u00ebs ishin se k\u00ebrkesa b\u00ebhej bazuar n\u00eb parimin kushtetues p\u00ebr t\u00eb siguruar akses n\u00eb drejt\u00ebsi p\u00ebr t\u00eb gjith\u00eb, si nj\u00eb parim i mbrojtur fuqimisht nga Konventa Europiane e t\u00eb Drejtave t\u00eb Njeriut dhe nga praktikat e Gjykat\u00ebs Europiane p\u00ebr t\u00eb Drejtat e Njeriut n\u00eb Strasburg. Gjykat\u00ebs iu soll si sh\u00ebmbull nj\u00eb nga c\u00ebshtjet baz\u00eb q\u00eb ka trajtuar nj\u00eb rast t\u00eb till\u00eb, Kreuz kund\u00ebr Polonis\u00eb, aplikimi nr. 28249\/95, gjykim i dat\u00ebs 19-06-2001. N\u00eb k\u00ebt\u00eb rast:\u00a0<i>\u201cGjykata (e Strasburgut) konsideroi q\u00eb autoritetet gjyq\u00ebsore nuk kishin arritur t\u00eb siguronin nj\u00eb baraspesh\u00eb t\u00eb duhur nd\u00ebrmjet, n\u00eb nj\u00ebr\u00ebn an\u00eb, interesit t\u00eb Shtetit n\u00eb mbledhjen e taksave gjyq\u00ebsore dhe, n\u00eb an\u00ebn tjet\u00ebr, interesit t\u00eb k\u00ebrkuesit n\u00eb vendikimin e pretendimit t\u00eb tij\u00a0<\/i><i>p\u00ebrmes gjykatave. Pagesa e k\u00ebrkuar ndaj aplikantit me veprimin e tij ishte e tepruar dhe rezultoi n\u00eb pushimin e gjykimit mbi pretendimin e tij duke mos u d\u00ebgjuar nga nj\u00eb gjykat\u00eb, e cila, sipas mendimit t\u00eb Gjykat\u00ebs, ka d\u00ebmtuar thelbin e t\u00eb drejt\u00ebs s\u00eb tij p\u00ebr akses n\u00eb gjykat\u00eb.\u00a0<\/i><i>Si rezultat, Gjykata gjeti se kishte pasur shkelje t\u00eb nenit 6 \u00a7 1.\u201d<\/i><\/p>\n<p>Nga Res Publica u pranua se Gjykata e Strasburgut e ka p\u00ebrs\u00ebritur dhe theksuar disa her\u00eb se e drejta p\u00ebr akses n\u00eb gjykat\u00eb, e garantuar nga neni 6 i Konvent\u00ebs, nuk \u00ebsht\u00eb absolute, por mund t\u00eb jet\u00eb subjekt i kufizimeve duke pranuar se imponimi i taksave gjyq\u00ebsore ose shpenzimeve t\u00eb lidhura me t\u00eb nuk p\u00ebrb\u00ebn n\u00eb parim dhe n\u00eb vetvete nj\u00eb shkelje t\u00eb Nenit 6. Megjithat\u00eb kjo Gjykat\u00eb ka b\u00ebr\u00eb gjithashtu t\u00eb qart\u00eb se kufizime t\u00eb tilla nuk duhet t\u00eb pengojn\u00eb padrejt\u00ebsisht aksesin e aplikantit n\u00eb gjykat\u00eb. K\u00ebto kufizime duhet t\u00eb jen\u00eb n\u00eb mb\u00ebshtetje t\u00eb nj\u00eb objektivi legjitim, nd\u00ebrsa duhet t\u00eb ekzistoj\u00eb nj\u00eb marr\u00ebdh\u00ebnie e arsyeshme e proporcionalitetit midis mjeteve t\u00eb p\u00ebrdorura dhe q\u00ebllimit legjitim q\u00eb k\u00ebrkohet t\u00eb arrihet.<\/p>\n<p>Res Publica e orientoi Gjykat\u00ebn e Rrethit Gjyq\u00ebsor Tiran\u00eb q\u00eb p\u00ebr t\u00eb vler\u00ebsuar n\u00ebse k\u00ebrkesa p\u00ebr t\u00eb paguar taksat gjyq\u00ebsore n\u00eb \u00e7do rast t\u00eb caktuar nuk \u00ebsht\u00eb n\u00eb kund\u00ebrshtim me nenin 6, Gjykata e Strasburgut merr n\u00eb konsiderat\u00eb parametrat n\u00eb vijim: nivein e tarif\u00ebs s\u00eb k\u00ebrkuar, gjendjen financiare t\u00eb aplikantit, n\u00ebse kufizimi i t\u00eb drejt\u00ebs p\u00ebr akses n\u00eb gjyq \u00ebsht\u00eb thjesht e natyr\u00ebs financiare, n\u00eb faz\u00ebn e procedurale n\u00eb t\u00eb cil\u00ebn pagesat jan\u00eb t\u00eb zbatueshme dhe n\u00ebse ajo mund t\u00eb paguhet n\u00eb k\u00ebste, n\u00ebse procesi kryesor gjyq\u00ebsor mund t\u00eb vazhdoj\u00eb i pavarur n\u00eb lidhje me pages\u00ebn ose jo t\u00eb taks\u00ebs gjyq\u00ebsore dhe gjykimit n\u00eb fund n\u00ebse nga k\u00ebrkesa p\u00ebr pages\u00ebn e taks\u00ebs gjyq\u00ebsore mund t\u00eb hiqet dor\u00eb,<\/p>\n<p>Jo pak c\u00ebshtje u soll\u00ebn si shembuj si Urbanek kund\u00ebr Austris\u00eb, Pedro Ramos kund\u00ebr Zvicr\u00ebs,\u00a0 Podbielski dhe PPU Polpure kund\u00ebr Polonis\u00eb, Paykar Yev Haghtanak Ltd kund\u00ebr Armenis\u00eb, Marina kund\u00ebr Letonis\u00eb, etj. E p\u00ebrbashk\u00ebta e t\u00eb gjith\u00eb k\u00ebtyre rasteve t\u00eb m\u00ebsip\u00ebrm \u00ebsht\u00eb se gjykata duhet t\u00eb shqyrtoj\u00eb me kujdes n\u00ebse \u00ebsht\u00eb e pritshme q\u00eb aplikant\u00ebt t\u00eb paguajn\u00eb taks\u00ebn e nevojshme gjyq\u00ebsore. N\u00eb rast t\u00eb kund\u00ebrt gjykata duhet t\u00eb shqyrtoj\u00eb se si mund t\u2019i ndihmoj\u00eb k\u00ebrkuesit n\u00eb lidhje me detyrimin p\u00ebr t\u00eb paguar taksat gjyq\u00ebsore, duke siguruar q\u00eb ai t\u00eb jet\u00eb t\u00eb d\u00ebgjohet nga gjykata.<\/p>\n<p>N\u00eb rastin e familjar\u00ebve t\u00eb viktimave t\u00eb G\u00ebrdecit k\u00ebrkuesit jan\u00eb n\u00eb pamund\u00ebsi p\u00ebr t\u00eb shlyer k\u00ebt\u00eb detyrim dhe ata rrezikonin q\u00eb t\u00eb mos kishin asnj\u00eb t\u00eb drejt\u00eb p\u00ebr t\u2019u d\u00ebgjuar nga gjykata n\u00ebse kjo e fundit nuk do t\u00eb pranonte k\u00ebrkes\u00ebn p\u00ebr t\u2019i p\u00ebrjashtuar ata totalisht nga detyrimi p\u00ebr t\u00eb paguar taks\u00ebn (tarif\u00ebn) e ngritjes s\u00eb padis\u00eb. E nj\u00ebjta nevoj\u00eb paraqitet edhe p\u00ebrsa i p\u00ebrket shpenzimeve t\u00eb tjera sic jan\u00eb ato t\u00eb parashikuara nga neni 105\/b i Kodit t\u00eb Procedur\u00ebs Civile. Vlen t\u00eb theksohet edhe fakti se k\u00ebrkuesit kan\u00eb pajtuar avokat\u00ebt e qendr\u00ebs Res Publica, e cila ofron sh\u00ebrbime ligjore pa pages\u00eb, p\u00ebr arsye t\u00eb pamund\u00ebsis\u00eb financiare p\u00ebr t\u00eb p\u00ebrballuar shpenzimet p\u00ebr avokat.<\/p>\n<p>Gjykat\u00ebs iu k\u00ebrkuar q\u00eb n\u00ebse nuk do ta shihte si t\u00eb pranueshme p\u00ebrjashtimin nga pagesa e tarif\u00ebs n\u00eb fjal\u00eb, at\u00ebher\u00eb t\u00eb shihte mund\u00ebsin\u00eb q\u00eb kjo tarif\u00eb t\u00eb paguhej me k\u00ebste t\u00eb p\u00ebrballueshme nga padit\u00ebsit, n\u00eb proporcion me t\u00eb ardhurat e tij, pas nj\u00eb investigimi t\u00eb mund\u00ebsive reale financiare q\u00eb ai ka.<\/p>\n<p>Duke par\u00eb se ky ishte nj\u00eb problem q\u00eb lidhej ngusht\u00eb me perceptimin e gjyqtar\u00ebve, Res Publica u mundua t\u00eb nd\u00ebrtonte dialog me ata gjyqtar\u00eb q\u00eb kishin prirjen t\u00eb pranonin se k\u00ebrkesa ishte n\u00eb thelb e drejt\u00eb dhe se aksesi n\u00eb gjykat\u00eb prevalon mbi interesin e shtetit p\u00ebr t\u00eb siguruar financimin e sh\u00ebrbimeve t\u00eb veta. Nj\u00eb prej gjyqtar\u00ebve, Z. Klodian Rado, gjyqtar i Gjykat\u00ebs s\u00eb Rrethit Gjyq\u00ebsor Pogradec tashm\u00eb kishte b\u00ebr\u00eb udh\u00eb n\u00eb k\u00ebt\u00eb drejtim duke k\u00ebrkuar kontrollin incidental t\u00eb nj\u00eb norme t\u00eb Kodit Doganor me Kushtetut\u00ebn p\u00ebr t\u00eb nj\u00ebjtat arsye. K\u00ebrkesa e tij u pasua nga nj\u00eb vendim pozitiv i Gjykat\u00ebs Kushtetuese n\u00eb vitin 2010. Ky precedent i suksessh\u00ebm iu referua cdo gjyqtari n\u00eb Gjykat\u00ebn e Rrethit Gjyq\u00ebsor Tiran\u00eb dhe m\u00eb 2 maj 2012, gjyqtarja Enkela Bajo (Vlora) mori vendimin p\u00ebr t\u00eb k\u00ebrkuar kontrollin incidental t\u00eb ligjit p\u00ebr taksat dhe tarifat n\u00eb raport me Kushtetut\u00ebn. Vendimi n\u00eb fjal\u00eb u parapri me dy jav\u00eb nga vendimi me t\u00eb nj\u00ebjtin objekt i gjyqtarit Klodian Rado n\u00eb Pogradec, i cili tashm\u00eb mori p\u00ebrsip\u00ebr t\u00eb zgjidhte vet\u00eb, n\u00eb m\u00ebnyr\u00eb m\u00eb efektive se shum\u00eb organizata t\u00eb shoq\u00ebris\u00eb civile, problemin e penges\u00ebs s\u00eb padrejt\u00eb t\u00eb aksesit n\u00eb gjykat\u00eb, ardhur nga taksa e pap\u00ebrballueshme e padis\u00eb.<\/p>\n<p>Pas k\u00ebtyre dy k\u00ebrkesave paralele, gjyqtar\u00ebt e tjer\u00eb, t\u00eb cil\u00ebve u ishte paraqitur nj\u00eb k\u00ebrkes\u00eb e till\u00eb, vendos\u00ebn t\u00eb pezullojn\u00eb ose t\u00eb shtyjn\u00eb proceset deri n\u00eb momentin q\u00eb Gjykata Kushtetuese do t\u00eb shprehej me nj\u00eb vendim final.<\/p>\n<p><b><i>Raundi 5<\/i><\/b><\/p>\n<p>Vendimet e gjyqtarit Rado dhe gjyqtares Bajo (Vlora) vun\u00eb n\u00eb l\u00ebvizje Gjykat\u00ebn Kushtetuese p\u00ebr t\u00eb dh\u00ebn\u00eb nj\u00eb p\u00ebrgjigje finale rreth problemit n\u00eb fjal\u00eb. Sigurisht q\u00eb ky vendim do t\u00eb p\u00ebrcaktonte edhe fatet e c\u00ebshtjes Bregu kund\u00ebr Shqip\u00ebris\u00eb, e cila pret n\u00eb Strasburg.<\/p>\n<p>N\u00eb datat 18 shtator dhe 4 tetor 2012 Gjykata Kushtetuese ka zhvilluar dy seanca d\u00ebgjimore ku u shpalos\u00ebn argumentat e pal\u00ebs tjet\u00ebr, Kuvendit, Ministris\u00eb s\u00eb Drejt\u00ebsis\u00eb dhe Ministris\u00eb s\u00eb Financave.\u00a0 N\u00eb seanc\u00ebn e dat\u00ebs 4 tetor 2012 pesh\u00ebn kryesore e zun\u00eb pretendimet e Ministris\u00eb s\u00eb Drejt\u00ebsis\u00eb, e cila argumentoi kryesisht se:<\/p>\n<ul>\n<li>pavar\u00ebsisht rritjes s\u00eb taks\u00ebs s\u00eb padis\u00eb, numri i c\u00ebshtjeve t\u00eb trajtuara nga gjykatat kan\u00eb p\u00ebsuar rritje;<\/li>\n<li>nj\u00eb nga arsyet ishte edhe p\u00ebrdorimi i k\u00ebsaj takse si instrument p\u00ebr t\u00eb frenuar rritjen e m\u00ebtejshme t\u00eb numrit t\u00eb c\u00ebshtjeve duke par\u00eb mbingarkes\u00ebn e gjykatave;<\/li>\n<li>pal\u00ebt nuk kan\u00eb ezauruar ankimin n\u00eb gjykatat e tjera para se t\u2019i drejtohen Gjykat\u00ebs Kushtetuese.<\/li>\n<\/ul>\n<p>Asnj\u00eb nga k\u00ebto argumenta nuk vlen p\u00ebr t\u2019u marr\u00eb seriozisht nga Gjykata Kushtetuese, sepse rritja e numrit t\u00eb c\u00ebshtjeve \u00ebsht\u00eb argument shum\u00eb p\u00ebrgjith\u00ebsues dhe nuk lidhet direkt me k\u00ebrkes\u00ebn e personave konkret\u00eb t\u00eb cil\u00ebt duken qart\u00eb se u \u00ebsht\u00eb mohuar aksesi n\u00eb gjykat\u00eb. C\u00ebshtja nuk duhet t\u00eb shtrohet se sa c\u00ebshtje jan\u00eb trajtuar nga gjykata por sa c\u00ebshtje mund t\u00eb ishin trajtuar n\u00ebse taksa e padis\u00eb nuk do t\u00eb p\u00ebrb\u00ebnte penges\u00eb serioze.<\/p>\n<p>P\u00ebrdorimi i taks\u00ebs si mjet p\u00ebr t\u00eb frenuar rritjen e mbingarkes\u00ebs s\u00eb gjykat\u00ebs ishte edhe qershia mbi tort\u00eb i gjith\u00eb k\u00ebtij diskursi, sepse ky \u00ebsht\u00eb edhe treguesi kryesor q\u00eb kemi t\u00eb b\u00ebjm\u00eb me nj\u00eb pengim t\u00eb q\u00ebllimsh\u00ebm dhe aspak aksidental t\u00eb aksesit n\u00eb gjykat\u00eb t\u00eb individ\u00ebve t\u00eb varf\u00ebr.<\/p>\n<p>Gjithashtu edhe argumenti tjet\u00ebr nuk vlen pasi p\u00ebr shpalljen antikushtetues t\u00eb ligjeve dhe p\u00ebr interpretimin e tyre kompetenca ekskluzive i takon Gjykat\u00ebs Kushtetuese dhe asnj\u00eb gjykat\u00eb tjet\u00ebr nuk mund t\u00eb ezauroj\u00eb k\u00ebt\u00eb funksion.<\/p>\n<p><b><i>Raundi 6<\/i><\/b><\/p>\n<p>N\u00eb pritje t\u00eb nj\u00eb vendimi nga Gjykata Kushtetuese nuk mund t\u00eb linim pa provuar edhe nxitjen e cdo presioni pozitiv p\u00ebr t\u2019u zgjidhur ky problem edhe me shtys\u00ebn e organizmave nd\u00ebrkomb\u00ebtar\u00eb.<\/p>\n<p>Nd\u00ebrsa fatkeq\u00ebsisht argumentet e renditura para Gjykat\u00ebs Kushtetuese jan\u00eb shprehur nga zyrtar\u00eb t\u00eb qeveris\u00eb, disa zhvillime t\u00eb r\u00ebnd\u00ebsishme kan\u00eb ndodhur koh\u00ebt e fundit p\u00ebr \u00e7\u00ebshtjen e aksesit n\u00eb drejt\u00ebsi p\u00ebr njer\u00ebzit e varf\u00ebr n\u00eb nj\u00eb nivel nd\u00ebrkomb\u00ebtar. Shtatorin e kaluar, K\u00ebshilli i t\u00eb Drejtave t\u00eb Njeriut i Kombeve t\u00eb Bashkuara me \u00a0vendimin A\/HRC\/21\/L.20 t\u00eb dat\u00ebs 21 shtator 2012, miratoi parimet e rishikuara udh\u00ebzuese p\u00ebr varf\u00ebrin\u00eb e skajshme dhe t\u00eb drejtat e njeriut v\u00ebn\u00eb p\u00ebrpara nga Raportuesi Special mbi varf\u00ebrin\u00eb ekstreme dhe t\u00eb drejtat e njeriut, duke i cil\u00ebsuar ato si \u201cnj\u00eb mjet i dobish\u00ebm p\u00ebr shtetet n\u00eb formulimin dhe zbatimin e politikave t\u00eb reduktimit dhe \u00e7rr\u00ebnjosjes s\u00eb varf\u00ebris\u00eb\u201d. Pa dyshim, gjuha e p\u00ebrdorur n\u00eb dokumentet e OKB-s\u00eb mund t\u00eb jet\u00eb shum\u00eb e that\u00eb dhe vendimi lexohet m\u00eb shum\u00eb si nj\u00eb artikull akademik sesa nj\u00eb thirrje e zjarrt\u00eb p\u00ebr veprim. Por kurr\u00eb nuk duhet t\u00eb harrojm\u00eb se mungesa e aksesit n\u00eb drejt\u00ebsi ka pasoja shum\u00eb negative materiale p\u00ebr njer\u00ebzit e varf\u00ebr. Si\u00e7 \u00ebsht\u00eb p\u00ebrcaktuar me elokuenc\u00eb n\u00eb nj\u00eb artikull t\u00eb koh\u00ebve t\u00eb fundit (p\u00ebrkthyer nga Res Publica n\u00eb gjuh\u00ebn shqipe p\u00ebr t\u2019u riprodhuar n\u00eb postin e ardhsh\u00ebm) nga filantropisti George Soros dhe aktivisti i t\u00eb drejtave t\u00eb njeriut Fazle Hasan Abed:\u00a0<i>\u201cPa nj\u00eb fuqizim ligjor baz\u00eb, t\u00eb varf\u00ebrve jetojn\u00eb n\u00eb ekzistenc\u00eb t\u00eb pasigurt, nga frika e privimit zhvendosjes zhveshjes nga posedimi. Nj\u00eb i mitur \u00ebsht\u00eb arrestuar gabimisht dhe humbet koh\u00eb n\u00eb shkoll\u00eb, toka n\u00eb fshat d\u00ebmtohet nga nj\u00eb kompani minerare pa kompensim, nj\u00eb vejusheje analfabete i mohoet trash\u00ebgimia q\u00eb ajo ka t\u00eb drejt\u00eb t\u00eb p\u00ebrfitoj\u00eb dhe p\u00ebr k\u00ebt\u00eb arsye e detyrojn\u00eb ta hedhin n\u00eb rrug\u00eb s\u00eb bashku me f\u00ebmij\u00ebt e saj.\u201d<\/i>\u00a0Edhe pse k\u00ebto fjal\u00eb nuk jan\u00eb shkruar duke pasur Shqip\u00ebrin\u00eb n\u00eb mendje, me siguri q\u00eb disa prej lexuesve e din\u00eb apo madje edhe gjejn\u00eb veten n\u00eb nj\u00eb telash t\u00eb ngjash\u00ebm.<\/p>\n<p>Megjith\u00ebse duket pak e cuditshme, v\u00ebm\u00eb re se Shqip\u00ebria ka marr\u00eb angazhime t\u00eb kahershme p\u00ebr t\u00eb b\u00ebr\u00eb zgjidhje n\u00eb favor t\u00eb shtresave t\u00eb varf\u00ebra. M\u00eb 12.10.2012 gjat\u00eb prezantimit t\u00eb progres raportit t\u00eb fundit t\u00eb Shqip\u00ebris\u00eb,p\u00ebrfaq\u00ebsuesi i Res Publica, Dorian Matlija shtroi pyetjen se<i>\u00a0\u201c\u2026n\u00eb faqen 17 ngrini shqet\u00ebsimin q\u00eb grupe vulnerabile nuk kan\u00eb mund\u00ebsi t\u00eb ken\u00eb akses n\u00eb gjykat\u00eb p\u00ebr shkak t\u00eb tarifave t\u00eb larta. Duke qen\u00eb se numri i individ\u00ebve t\u00eb k\u00ebtyre grupeve vulnerabile mund t\u00eb shkoj\u00eb deri n\u00eb 400 mij\u00eb shqiptar\u00eb, nisur edhe nga statistikat e personave q\u00eb jetojn\u00eb n\u00eb nivelet e minimumit jetik, a e konsideroni zgjidhjen e k\u00ebsaj c\u00ebshtjeje si emergjente, e cila duhet t\u00eb trajtohet s\u00eb bashke me aspektet e tjer\u00eb t\u00eb reform\u00ebs n\u00eb drejt\u00ebsi?\u201d.\u00a0<\/i>K\u00ebsaj pyetjeje,Shefi i Seksionit te Politik\u00ebs, Ekonomis\u00eb dhe Informacionit, Z. Clive Rumbold, i autorizuar per t\u2019u pergjigjur nga ambasadori Ettore Sequi, iu p\u00ebrgjigj:\u00a0<i>\u201cKy \u00ebsht\u00eb nj\u00eb problem shum\u00eb i madh, sepse aksesi n\u00eb gjykat\u00eb \u00ebsht\u00eb shum\u00eb i r\u00ebnd\u00ebsish\u00ebm n\u00eb nj\u00eb shoq\u00ebri demokratike. Ne kemi informacione nga organizata t\u00eb ndryshme rreth k\u00ebtij problemi q\u00eb \u00ebsht\u00eb ende i pazgjidhur. Sigurisht q\u00eb ka lidhje me reformat n\u00eb drejt\u00ebsi, por mendoj se nuk \u00ebsht\u00eb vet\u00ebm problem i ligjeve por edhe i implemetimit t\u00eb tyre, pasi ka probleme n\u00eb marr\u00ebdh\u00ebniet dhe koordinimin mes intitucioneve. Mungesa e gjetjes s\u00eb nj\u00eb zgjidhjeje deri tani p\u00ebr sigurimin e aksesit ne gjykate te personave te varfer eshte nje deshtim. P\u00ebrderisa ne e kemi publikuar edhe n\u00eb progres raport k\u00ebt\u00eb fakt, do t\u00eb thot\u00eb q\u00eb ne e kemi n\u00eb v\u00ebmendjen ton\u00eb si problem dhe se n\u00eb t\u00eb ardhmen do t\u00eb vazhdojm\u00eb t\u00eb k\u00ebrkojm\u00eb prej qeveris\u00eb shqiptare q\u00eb t\u00eb zgjidh\u00eb p\u00ebrfundimisht k\u00ebt\u00eb problem.\u201d<\/i><\/p>\n<p>Kjo deklarat\u00eb nuk \u00ebsht\u00eb e shk\u00ebputur sepse edhe raporte t\u00eb tjer\u00eb kan\u00eb prekur k\u00ebt\u00eb tem\u00eb. P\u00ebrfaq\u00ebsuesi i lart\u00eb i BE b\u00ebri n\u00eb k\u00ebt\u00eb rast jo vet\u00ebm nj\u00eb koment shum\u00eb t\u00eb qart\u00eb p\u00ebr d\u00ebshtimin e Shqip\u00ebris\u00eb n\u00eb k\u00ebt\u00eb aspekt, por theksoi se zgjidhja duhej t\u00eb b\u00ebhej shpejt dhe se konsiderohej si pjes\u00eb e reform\u00ebs zgjedhore, n\u00eb nj\u00eb koh\u00eb kur kjo reform\u00eb \u00ebsht\u00eb nj\u00eb prej 3 pikave t\u00eb mbetura pa zgjidhur deri tani nga Shqip\u00ebria p\u00ebr t\u00eb marr\u00eb statusin e kandidatit p\u00ebr an\u00ebtar\u00ebsimin n\u00eb BE.<\/p>\n<p><i>\u00a0<\/i><\/p>\n<p><b><i>Raundi 7<\/i><\/b><\/p>\n<p>N\u00eb pritje t\u00eb nj\u00eb zgjidhjes s\u00eb k\u00ebtij ng\u00ebrci nga Gjykata Kushtetuese, Res Publica \u00ebsht\u00eb e nd\u00ebrgjegjshme se kjo nuk mund t\u00eb p\u00ebrb\u00ebj\u00eb nj\u00eb zgjidhje finale. Nisur nga misioni i Gjykat\u00ebs Kushtetuese ajo nuk mund t\u00eb prodhoj\u00eb norma t\u00eb reja juridike, por vet\u00ebm mund t\u00eb shpall\u00eb normat aktuale si antikushtetuese ose jo. P\u00ebr k\u00ebt\u00eb arsye lind nevoja t\u00eb gjendet nj\u00eb zgjidhje e plot\u00eb dhe e p\u00ebrhershme.<\/p>\n<p>Res Publica prej koh\u00ebsh ka p\u00ebrgatitur nj\u00eb draft p\u00ebr nj\u00eb nd\u00ebrhyrje n\u00eb ligjin p\u00ebr taksat, por evolimi i mendimit juridik ka sjell\u00eb nevoj\u00ebn e rishikimit t\u00eb k\u00ebtij drafti, duke marr\u00eb edhe mendimin e organizatave t\u00eb tjera. Koh\u00ebt e fundit \u00ebsht\u00eb duke u diskutuar edhe nj\u00eb draft tjet\u00ebr nga nj\u00eb organizat\u00eb kolege, por edhe n\u00eb k\u00ebt\u00eb rast jemi p\u00ebrpara nevoj\u00ebs q\u00eb kjo zgjidhje t\u00eb jet\u00eb m\u00eb gjith\u00ebp\u00ebrfshir\u00ebse sepse ka ardhur koha p\u00ebr nj\u00eb zgjidhje finale q\u00eb nuk prek vet\u00ebm nj\u00eb kategori t\u00eb vog\u00ebl, por nj\u00eb mas\u00eb shum\u00eb t\u00eb madhe individ\u00ebsh e personash juridik\u00eb, si dhe t\u00eb b\u00ebj\u00eb nj\u00eb riklasifikim t\u00eb sh\u00ebrbimeve dhe tarifave t\u00eb tyre.<\/p>\n<p>Res Publica mendon se \u00ebsht\u00eb e aft\u00eb t\u00eb parashtroj\u00eb nj\u00eb zgjidhje tekniko legjislative t\u00eb mir\u00eb, por kjo k\u00ebrkon koordinimin e veprimeve me shum\u00eb subjekte ndaj dhe fton t\u00eb gjitha organizatat e interesuara q\u00eb t\u00eb bashk\u00ebpunojn\u00eb, n\u00eb m\u00ebnyr\u00eb q\u00eb ky kapitull t\u00eb gjej\u00eb nj\u00eb zgjidhje t\u00eb p\u00eblqyeshme dhe afatgjat\u00eb.<\/p>\n<p>D.
