N\u00eb m\u00ebnyr\u00eb t\u00eb p\u00ebrmbledhur po ju tregojm\u00eb se \u00e7far\u00eb ndodhi dhe sesi reaguan pal\u00ebt.<br \/>\nS\u00eb pari:<br \/>\nGjykata verifikoi prezenc\u00ebn e pal\u00ebve, moment kur konstatoi se p\u00ebrfaq\u00ebsuesi i Ministris\u00eb s\u00eb Financave, pa ndonj\u00eb shkak ligjor nuk ishte prezent n\u00eb seanc\u00eb. Gjykata pasi u konsultua me pal\u00ebt prezent vendosi zhvillimin e seanc\u00ebs n\u00eb munges\u00eb t\u00eb Ministris\u00eb s\u00eb Financave.<br \/>\nN\u00eb nj\u00eb moment t\u00eb dyt\u00eb p\u00ebrfaq\u00ebsuesit e Qendr\u00ebs p\u00ebr Nismat Ligjore Qytetare parashtruan si me posht\u00eb :<br \/>\n1. Udh\u00ebzimi i Ministris\u00eb s\u00eb Financave dhe Ministris\u00eb s\u00eb Drejt\u00ebsis\u00eb nuk \u00ebsht\u00eb n\u00eb pajtim me nenin 18 t\u00eb Kushtetut\u00ebs, sepse diskriminon nj\u00eb kategori t\u00eb caktuar t\u00eb qytetar\u00ebve. Ky diskriminim \u00ebsht\u00eb i drejtp\u00ebrdrejt\u00eb dhe i t\u00ebrthort\u00eb, q\u00eb do t\u00eb thot\u00eb trajtim i barabart\u00eb p\u00ebr persona q\u00eb jan\u00eb n\u00eb situate t\u00eb pabarabarta. Kjo parashikohet edhe n\u00eb rastin Klimens vs Greqis\u00eb dhe Gregoros vs Zvicr\u00ebs.<br \/>\n2. Cenohet thelbi dhe i ligjit p\u00ebr mbrojtjen nga diskriminimi. Diskriminimi ekziston: p\u00ebr shkak t\u00eb gjinis\u00eb, mosh\u00ebs, aft\u00ebsive fizike. Ky udh\u00ebzim nuk merr parasysh parashikimet e b\u00ebra nga neni 54 dhe 59 t\u00eb Kushtetut\u00ebs, t\u00eb cil\u00ebt parashikojn\u00eb detyrimin pozitiv p\u00ebr shtetin kundrejt nj\u00eb kategorie t\u00eb caktuar personash. Parashikimi i k\u00ebsaj takse nga ana e udh\u00ebzimit, p\u00ebrb\u00ebn luks t\u00eb tepruar p\u00ebr kategorit\u00eb e margjinalizuara e k\u00ebsisoj kthehet n\u00eb v\u00ebshtir\u00ebsi t\u00eb pa kap\u00ebrcyeshme p\u00ebr t\u2019iu drejtuar gjykat\u00ebs. Si argument u soll interpretimi i GJEDNJ n\u00eb rastin e Skordino vs Italis\u00eb, n\u00eb 2006.<br \/>\n3. Neni 155 i Kushtetut\u00ebs duhet interpretuar, sepse nuk nxjerr n\u00eb pah parimin e aft\u00ebsis\u00eb paguese, parim i cili sanksionohet n\u00eb shum\u00eb Kushtetuta t\u00eb vendeve t\u00eb tjera. Psh: Kushtetuta e Italis\u00eb p\u00ebrkat\u00ebsisht n\u00eb nenin 53; kushtetut\u00ebs s\u00eb Bullgaris\u00eb n\u00eb nenin 63. Parimi i aft\u00ebsis\u00eb paguese do t\u00eb thot\u00eb, q\u00eb taksat t\u00eb vendosen n\u00eb proporcion me aft\u00ebsin\u00eb paguese t\u00eb personit.. Ligji p\u00ebr taksat n\u00eb Shqip\u00ebri duksh\u00ebm nuk e ka marr\u00eb parasysh k\u00ebt\u00eb fakt.<br \/>\n4. Parimi i proporcionalitetit nuk \u00ebsht\u00eb marr\u00eb n\u00eb konsiderat\u00eb.<br \/>\nP\u00ebrfaq\u00ebsuesit t\u00eb qendr\u00ebs iu drejtuan disa pyetje sqaruese nga Gjykata si m\u00eb posht\u00eb vijon:<br \/>\n1. A \u00ebsht\u00eb udh\u00ebzimi diskriminues n\u00eb p\u00ebrputhje me nenin 18 t\u00eb Kushtetut\u00ebs s\u00eb Shqip\u00ebris\u00eb? N\u00eb raport me k\u00ebt\u00eb logjik\u00eb ju k\u00ebrkoni shfuqizimin e k\u00ebtij neni, apo favorizimin e nj\u00eb target grupi t\u00eb caktuar?<br \/>\n2. Ky udh\u00ebzim a cenon t\u00eb drejt\u00ebn e aksesit n\u00eb gjykat\u00eb?<br \/>\n3. Cili \u00ebsht\u00eb q\u00ebllimi I vendosjes s\u00eb taks\u00ebs sipas jush?<br \/>\n4. A duhet parashikuar rezerva ligjore p\u00ebr nenin 155 t\u00eb Kushtetut\u00ebs?<br \/>\n5. A ka dallim midis nenit 17 dhe nenit 155 , n\u00eb lidhje me konceptin ligj.<br \/>\n6. A \u00ebsht\u00eb n\u00eb p\u00ebrputhje udh\u00ebzimi me ligjin dhe Kushtetut\u00ebn dhe a \u00ebsht\u00eb respektuar parimi i ligjshm\u00ebris\u00eb n\u00eb k\u00ebt\u00eb raport?<br \/>\n7. 3% e vler\u00ebs s\u00eb d\u00ebmit e parashikuar nga udh\u00ebzimi a \u00ebsht\u00eb proporcionale?<br \/>\n8. A ka dallim midis konceptit taks\u00eb dhe tarif\u00eb?<br \/>\nP\u00ebrgjigjet e p\u00ebrfaq\u00ebsuesit t\u00eb Qendr\u00ebs ishin si m\u00eb posht\u00eb:<br \/>\n1. Po. udh\u00ebzimi \u00ebsht\u00eb diskriminues, dhe n\u00eb k\u00ebto kushte k\u00ebrkojm\u00eb shfuqizimin e k\u00ebtij neni p\u00ebr arsyet e p\u00ebrmendura m\u00eb n\u00eb parashtrime.<br \/>\n2. Parashikimi i k\u00ebsaj dispozite p\u00ebrb\u00ebn nj\u00eb barrier\u00eb t\u00eb pakap\u00ebrcyeshme p\u00ebr aksesin n\u00eb gjykat\u00eb.<br \/>\n3. Sigurisht q\u00eb tarifa, dhe taks\u00eb duhet t\u00eb k\u00ebt\u00eb. Ato vendosen p\u00ebr interesin e publikut, por ato duhet t\u00eb jen\u00eb proporcionale.<br \/>\n4. P\u00ebrcaktimi I taksave dhe tarifave duhet t\u00eb b\u00ebhet me ligj dhe jo me udh\u00ebzime apo akte t\u00eb tjera n\u00ebnligjore. Nxjerrja e Udh\u00ebzimit nuk ka zbatuar parimin e ligjshm\u00ebris\u00eb, p\u00ebr k\u00ebt\u00eb arsye ai \u00ebsht\u00eb n\u00eb kund\u00ebrshtimin me parimet Kushtetuese. Gjithashtu p\u00ebrqindja e parashikuar nga Udh\u00ebzimi nuk \u00ebsht\u00eb proporcional, si dhe nuk parashikon asnj\u00eb p\u00ebrjashtimi p\u00ebr grupe t\u00eb caktuar q\u00eb nuk kan\u00eb aft\u00ebsi paguese.<br \/>\n5. Ka dallim midis taks\u00ebs dhe tarif\u00ebs, por vet\u00eb ligji referon duke parashikuar se terminologjia e p\u00ebrdorur nga Kodi Procedur\u00ebs Civile z\u00ebvend\u00ebsohet me termin tarif\u00eb.<\/p>\n<p>P\u00ebrfaq\u00ebsuesi i Ministris\u00eb s\u00eb Drejt\u00ebsis\u00eb ishte m\u00eb pas n\u00eb radh\u00eb duke pretenduar fillimisht: p\u00ebr jo legjitimitet t\u00eb pal\u00ebve. Pala pati pretendim se: Gjykatat e rrethit se ato nuk mund t\u00eb iniciojn\u00eb Gjykat\u00ebn Kushtetuese p\u00ebr t\u00eb drejt\u00ebn procedurale, por vet\u00ebm p\u00ebr at\u00eb materiale<br \/>\nGjithashtu pretendoi se Qendra \u201cP\u00ebr nisma ligjore qytetare\u201d nuk kishte ezauruar rruget gjyq\u00ebsore p\u00ebrpara se t\u00eb vinte ne l\u00ebvizje Gjykat\u00ebs Kushtetuese. P\u00ebrfaq\u00ebsuesi i ministris\u00eb s\u00eb Drejt\u00ebsis\u00eb paraqiti p\u00ebrpara Gjykat\u00ebs dhe nj\u00eb list\u00eb me satistika, ku u pretendua se nga vendosja e taksave t\u00eb reja numri i \u00e7\u00ebshtjeve kishte ardhur n\u00eb rritje, e k\u00ebsisoj kjo taks\u00eb nuk ka cenuar aksesin n\u00eb Gjykat\u00eb. P\u00ebrfaq\u00ebsuesi justifikoi nxjerrjen e aktit me arsyen e interesit publik.<br \/>\nGjykata i drejtoi disa pyetje sakt\u00ebsuese :<br \/>\n1. -A mundet nj\u00eb individ t\u00eb k\u00ebrkoj\u00eb shfuqizimin e nj\u00eb akti normativ n\u00eb gjykatat e zakonshme?<br \/>\n2. -A p\u00ebrb\u00ebn kufizim udh\u00ebzimi n\u00eb raport me nenin 42 t\u00eb Kushtetut\u00ebs?<br \/>\n3. -N\u00eb ndryshimin e shpesht\u00eb t\u00eb mas\u00ebs s\u00eb taks\u00ebs brenda nj\u00eb viti klendarik, a \u00ebsht\u00eb marr\u00eb parasysh parimi i siguris\u00eb juridike?<br \/>\n4.-A \u00ebsht\u00eb i zbatuesh\u00ebm nenin 158 I KPC ?<br \/>\n5.-Cila \u00ebsht\u00eb arsyeja e rritjes s\u00eb tarif\u00ebs?<br \/>\nP\u00ebrfaq\u00ebsuesi vijoi me k\u00ebto p\u00ebrgjigjie :<br \/>\n1. Po, nj\u00eb individ mund t\u00eb k\u00ebrkoj\u00eb shfuqizimin e nj\u00eb akti normative n\u00eb gjykatat e zakonshme, n\u00eb baz\u00eb t\u00eb nenit 324, 326 t\u00eb KPC.<br \/>\n2. P\u00ebrb\u00ebn nj\u00ebfar\u00eb kufizimi, por ai \u00ebsht\u00eb proporcional.<br \/>\n3. Nuk \u00ebsht\u00eb cenuar parimi i siguris\u00eb juridike, sepse n\u00eb t\u00eb gjitha legjislacionet ligjet p\u00ebr taksat jan\u00eb t\u00eb ndryshueshme n\u00eb koh\u00eb t\u00eb shkurtra. Ato ato botohen n\u00eb Fletoren Zyrtare e nga ky moment b\u00ebhen t\u00eb njohura p\u00ebr t\u00eb gjith\u00eb.<br \/>\n4. N\u00eb lidhje me nenin 158 nuk u p\u00ebrgjigj, p\u00ebr munges\u00eb informacioni, por p\u00ebr argumentim solli si shembull faktin se gjykat\u00ebsit nuk mund t\u00eb p\u00ebrjashtojn\u00eb nj\u00eb person nga taksa; dhe n\u00eb rastet kur e b\u00ebjn\u00eb k\u00ebt\u00eb, praktika ka treguar se atyre u \u00ebsht\u00eb k\u00ebrkuar pagesa e k\u00ebsaj takse nga ana e KLSH.<br \/>\n5. Tarifat jan\u00eb rritur shum\u00eb p\u00ebr shkak t\u00eb zhvillimit ekonomik.<br \/>\n6. Shkak tjet\u00ebr i logjiksh\u00ebm sipas p\u00ebrfaq\u00ebsuesit ishte se gjykatat ishin ngarkuar me \u00e7\u00ebshtje dhe duhej gjetur m\u00ebnyra p\u00ebr t\u00eb ulur k\u00ebt\u00eb ngarkes\u00eb. Efikase kishte rezultuar ngritja e taksave.<br \/>\nMe p\u00ebrgjigjien e fundit ministria e drejt\u00ebsis\u00eb ka treguar se nuk ishte niveli i lart\u00eb ekonomik, por pik\u00ebrisht tendenca p\u00ebr t\u00eb leht\u00ebsuar pun\u00ebn e Gjykat\u00ebs duke paksuar numrin e k\u00ebrkuesve. Kjo p\u00ebrgjigjien q\u00eb pavar\u00ebsisht efi\u00e7enc\u00ebs, ka \u00e7uar n\u00eb mohim t\u00eb aksesit n\u00eb drejt\u00ebsi t\u00eb 400 mij\u00eb Shqiptareve. Teknika e p\u00ebrdorur \u00ebsht\u00eb jo e ligjshme.<br \/>\nP\u00ebrfaq\u00ebsuesit e Kuvendit mb\u00ebshtet\u00ebn pretendimet e P\u00ebrfaq\u00ebsuesit t\u00eb Ministris\u00eb s\u00eb Drejt\u00ebsis\u00eb duke sjell\u00eb asnj\u00eb argument t\u00eb ri. Ky q\u00ebndrim p\u00ebrforcon pozicionin e ngurt\u00eb t\u00eb institucioneve nga aksesit sa me t\u00eb gjer\u00eb ne drejt\u00ebsi, t\u00eb t\u00eb gjitha kategorive.
