{"id":527,"date":"2013-02-02T15:59:01","date_gmt":"2013-02-02T13:59:01","guid":{"rendered":"http:\/\/www.respublica.org.al\/?p=527"},"modified":"2013-10-02T16:02:05","modified_gmt":"2013-10-02T14:02:05","slug":"keqpolitika-e-faktit-te-kryer","status":"publish","type":"post","link":"https:\/\/www.respublica.org.al\/web\/?p=527","title":{"rendered":"Keqpolitika e faktit t\u00eb kryer"},"content":{"rendered":"<p><strong>Keqpolitika e faktit t\u00eb kryer<\/strong><\/p>\n<p>Nuk habit m\u00eb, me gjith\u00eb rrezikshm\u00ebrin\u00eb e shtuar, tentativa e rradh\u00ebs e PD-ist\u00ebve n\u00eb kund\u00ebrshtim t\u00eb hapur e t\u00eb plot\u00eb me ligjin shqiptar, konkretizuar n\u00eb nism\u00ebn e fundit t\u00eb kryetarit t\u00eb grupit parlamentar t\u00eb PD-s\u00eb, p\u00ebr \u201clirimin\u201d e nj\u00eb an\u00ebtari t\u00eb KQZ-s\u00eb t\u00eb zgjedhur nga LSI-a. Nj\u00eb tentativ\u00eb q\u00eb p\u00ebrpikm\u00ebrisht demonstron se \u00e7far\u00eb jan\u00eb t\u00eb gatsh\u00ebm t\u00eb b\u00ebjn\u00eb p\u00ebrfaq\u00ebsuesit e partis\u00eb n\u00eb pushtet kur vjen fjala p\u00ebr t\u00eb mos e l\u00ebshuar pushtetin.<\/p>\n<p>Tentativ\u00eb e cila n\u00eb xhiron e dy-tre dit\u00ebve, lindi dhe kaloi sakaq Komisionin e Ligjeve, n\u00eb pritje t\u00eb miratimit p\u00ebrfundimtar pas disa dit\u00ebsh n\u00eb Kuvend. Tentativ\u00eb e cila qart\u00ebsisht shkel nj\u00eb s\u00ebr\u00eb nenesh sanksionuar posa\u00e7\u00ebrisht nga Kodi Zgjedhor n\u00eb fuqi, mbi rregullimin e mandatit t\u00eb an\u00ebtarit t\u00eb KQZ-s\u00eb, q\u00eb p\u00ebrcaktojn\u00eb n\u00eb mas\u00eb t\u00eb lart\u00eb edhe pavar\u00ebsin\u00eb e supozuar t\u00eb k\u00ebtij institucioni. Duke filluar nga termi i improvizuar \u201clirim nga detyra\u201d i an\u00ebtarit, kur Kodi flet qart\u00ebsisht p\u00ebr \u201cnd\u00ebrprerje t\u00eb mandatit\u201d n\u00eb m\u00ebnyr\u00eb t\u00eb parakohshme; te arsyet e\u00a0nd\u00ebrprerjes\u00a0t\u00eb parakohshme t\u00eb k\u00ebtij mandati, q\u00eb nuk kan\u00eb asnj\u00eb lidhje me pretendimet e llojit t\u00eb faktit t\u00eb kryer t\u00eb PD-s\u00eb; te paanshm\u00ebria q\u00eb Kodi Zgjedhor pretendon p\u00ebr an\u00ebtar\u00ebt e KQZ-s\u00eb pavar\u00ebsisht zgjedhjes s\u00eb tyre nga politika; dhe te vet\u00eb fraksioni i procesit ku parlamentar\u00ebt kan\u00eb z\u00eb n\u00eb kapitull lidhur me an\u00ebtar\u00ebt e KQZ-s\u00eb, q\u00eb \u00ebsht\u00eb vet\u00ebm momenti i zgjedhjes, pas t\u00eb cilit k\u00ebta t\u00eb fundit i p\u00ebrgjigjen vet\u00ebm Kushtetut\u00ebs dhe ligjeve.<\/p>\n<p>E megjithat\u00eb, asnj\u00eb nga parashikimet e Kodit Zgjedhor n\u00eb fuqi, nj\u00eb ligj q\u00eb k\u00ebrkon shumic\u00eb t\u00eb cil\u00ebsuar prej 3\/5 p\u00ebr t\u2019u miratuar, nuk e ndali shpur\u00ebn e jurist\u00ebve dhe t\u00eb nism\u00ebtar\u00ebve PD-ist\u00eb q\u00eb t\u00eb na ofronin nj\u00eb tjet\u00ebr mund\u00ebsi p\u00ebr t\u00eb kujtuar kapacitetin e tyre p\u00ebr t\u00eb shkelur ligjet me arroganc\u00eb e n\u00eb koh\u00eb rekord.<\/p>\n<p>B\u00ebhet fjal\u00eb p\u00ebr shkelje e nisma t\u00eb llojit q\u00eb jan\u00eb intensifikuar n\u00eb vitet e fundit, e q\u00eb gjithnj\u00eb e m\u00eb shum\u00eb risjellin n\u00eb kujtes\u00eb vitet e mbrapshta \u201990: 1994 e Kushtetut\u00ebs t\u00eb autografuar nga Berisha, si p\u00ebr t\u2019i dh\u00ebn\u00eb nj\u00eb prekje t\u00eb personalizuar themeleve t\u00eb shtetit; 1996 e dhun\u00ebs mbi opozit\u00ebn, gazetar\u00ebt e vrojtuesit e zgjedhjeve, pse nuk donin ta l\u00ebshonin pushtetin as t\u00eb vdekur; 1997 fam\u00ebkeqe e err\u00ebsir\u00ebs financiare, ekonomike, sociale e politike p\u00ebr t\u00eb gjith\u00eb shqiptar\u00ebt, n\u00ebn kortezin\u00eb e pashmangshme t\u00eb qeverisjes e presidenc\u00ebs PD-iste; 1998 e pu\u00e7it t\u00eb shtetit, sa koh\u00eb arm\u00ebt e 1997 ishin akoma t\u00eb nxehta e t\u00eb gatshme p\u00ebr p\u00ebrdorim. E m\u00eb larg akoma 1992 dhe precedenti i p\u00ebrjashtimit t\u00eb kandidat\u00ebve t\u00eb ligjsh\u00ebm p\u00ebr deputet nga listat e PD-s\u00eb, pas p\u00ebrjashtimit t\u00eb tyre nga partia. Ishte viti kur PD-ja sapo kish ardhur n\u00eb pushtet me pretendimin dhe flamurin e demokratizimit t\u00eb vendit, q\u00eb nuk e pengoi aspak t\u00eb shfaqte tendenca autoritare q\u00eb n\u00eb muajt e par\u00eb t\u00eb veprimit.<\/p>\n<p>P\u00ebrjashtimit t\u00eb z\u00ebrave kritik\u00eb nga partia i pasoi k\u00ebrkesa e kryesis\u00eb s\u00eb PD-s\u00eb, drejtuar Kuvendit Popullor n\u00eb gushtin 1992, ku k\u00ebrkohej heqja e emrave t\u00eb tre t\u00eb p\u00ebrjashtuarve edhe nga lista p\u00ebr deputet\u00eb, 6 muaj pasi ishin fituar zgjedhjet dhe kandidat\u00ebt kishin tashm\u00eb vendin e tyre t\u00eb pac\u00ebnuesh\u00ebm n\u00eb listat fituese, n\u00eb rast vendesh vakante n\u00eb Kuvendin Popullor (p\u00ebr shkaqe dor\u00ebheqjesh eventuale, etj.).<\/p>\n<p>Dhe n\u00eb fakt, me krijimin e vakanc\u00ebs s\u00eb tre vendeve n\u00eb Kuvendin Popullor n\u00eb gusht 1992, tre t\u00eb p\u00ebrjashtuarve nga partia iu mohua me vendim Kuvendi Popullore drejta e ligjshme p\u00ebr t\u2019u b\u00ebr\u00eb deputet\u00eb. E drejta e tre t\u00eb p\u00ebrjashtuarve nga partia, p\u00ebr t\u00eb qen\u00eb sidoqoft\u00eb deputet\u00ebt n\u00eb vendet vakante, fal\u00eb pozicionit t\u00eb tyre n\u00eb list\u00eb, t\u00eb p\u00ebrcaktuar nga votat e marra dhe pozicionimi n\u00eb list\u00eb, u shkel pa ceremoni, fal\u00eb k\u00ebrkes\u00ebs q\u00eb jo kryetari i grupit parlamentar (si n\u00eb rastin e Patozit sot), por partia vet\u00eb, nga selit\u00eb e veta jasht\u00eb-institucionale, i drejtonte Kuvendit Popullor ku dhe ruante shumic\u00ebn vendimmarr\u00ebse.<\/p>\n<p>As Gjykata Kushtetuese e asaj kohe nuk arriti t\u00eb vinte n\u00eb vend t\u00eb drejt\u00ebn e t\u00eb p\u00ebrjashtuarve nga partia, p\u00ebr t\u00eb mos qen\u00eb t\u00eb p\u00ebrjashtuar edhe nga listat. N\u00eb 1993, Gjykata Kushtetuese e hodhi posht\u00eb k\u00ebrkes\u00ebn e tre kandidat\u00ebve t\u00eb mb\u00ebshtetur nga Partia Socialiste, n\u00eb shkelje t\u00eb ligjit p\u00ebr zgjedhjet, q\u00eb vendoste afate p\u00ebr ndryshimin dhe depozitimin e listave p\u00ebr deputet\u00eb para zgjedhjeve, gj\u00eb q\u00eb i b\u00ebnte listat t\u00eb pac\u00ebnueshm\u00eb pas zgjedhjeve, e aq m\u00eb shum\u00eb 6 muaj pas zgjedhjeve, n\u00eb cil\u00ebsin\u00eb e dokumentave zgjedhor\u00eb. P\u00ebr m\u00eb tep\u00ebr Gjykata Kushtetuese, duksh\u00ebm e ndikuar nga politika n\u00eb vendimmarje, anashkaloi norm\u00ebn e ligjit n\u00eb fuqi, edhe pse pranonte se ligji mbi zgjedhjet nuk parashikonte asnj\u00eb kusht t\u00eb t\u00eb qenit kandidat n\u00eb list\u00eb elektorale krahas atij t\u00eb t\u00eb qenit an\u00ebtar ipartis\u00eb n\u00eb fjal\u00eb. N\u00eb vend t\u00eb zbatimit t\u00eb ligjit ekzistues q\u00eb nuk p\u00ebrmbante asnj\u00eb ndalim n\u00eb k\u00ebt\u00eb drejtim, Gjykata zgjodhi t\u00eb improvizonte nj\u00eb rregull t\u00eb atyp\u00ebratysh\u00ebm, sipas s\u00eb cilit: \u201c<i>Nj\u00eb parti nuk mund t\u00eb detyrohet t\u00eb mbaj\u00eb n\u00eb listat e veta si kandidat\u00eb t\u00eb saj nj\u00eb person q\u00eb vihet n\u00eb opozit\u00eb me programin e saj. Largimi ose nxjerrja nga radh\u00ebt e partis\u00eb presupozon edhe mund\u00ebsin\u00eb e ndryshimeve n\u00eb list\u00ebn, kap\u00ebrcimin n\u00eb renditjen e saj<\/i>\u201d.<\/p>\n<p>\u00c7\u00ebshtja b\u00ebri buj\u00eb asokohe, e akoma sot p\u00ebrmendet n\u00eb literatur\u00eb si nj\u00eb nga shkeljet e m\u00ebdha t\u00eb realizuara n\u00eb kuadrin zgjedhor e parlamentar shqiptar, e t\u00eb shkeljes flagrante t\u00eb ligjit. Megjithat\u00eb, 20 vjet m\u00eb von\u00eb nuk duket se gj\u00ebrat kan\u00eb ndryshuar. Sot n\u00eb 2013, n\u00eb pragun e zgjedhjeve t\u00eb reja parlamentare, parimi i shkeljes s\u00eb hapur dhe i instaurimit t\u00eb politik\u00ebs s\u00eb faktit t\u00eb kryer, n\u00eb kund\u00ebrshtim t\u00eb hapur me ligjin, nuk vonon t\u00eb sjell\u00eb pasoja t\u00eb menj\u00ebhershme n\u00eb konfigurimin e KQZ-s\u00eb si organ ky\u00e7 p\u00ebr mbar\u00ebvajtjen e zgjedhjeve. N\u00eb rrug\u00eb t\u00ebr\u00ebsisht t\u00eb nj\u00ebanshme, imponuese e arrogante me gjith\u00eb\u00e7ka shteti i shp\u00ebrfolur ligjor p\u00ebrmban n\u00eb esenc\u00ebn e tij, duke filluar nga bazamenti, ose zgjedhjet e lira e t\u00eb ndershme.<\/p>\n<p>Nj\u00eb tentativ\u00eb ajo e djeshmja (vitet \u201890), e ndjekur besnik\u00ebrisht nga e sotmja p\u00ebr t\u00eb kontrolluar politikisht dhe paligjshm\u00ebrisht, at\u00eb \u00e7ka nj\u00eb ligj me shumic\u00eb t\u00eb cil\u00ebsuar si Kodi Zgjedhor, k\u00ebrkon q\u00eb t\u00eb ruhet si organ i pavarur.<\/p>\n<p>Kjo \u00ebsht\u00eb tentativa e rradh\u00ebs dhe pritshm\u00ebria prej koh\u00ebsh \u00ebsht\u00eb se nuk do t\u00eb jet\u00eb e vetmja.<\/p>\n<p>Improvizimet e kundraligjshme t\u00eb kujt nuk ka nd\u00ebrmend n\u00eb asnj\u00eb form\u00eb t\u2019i zbres\u00eb karriges s\u00eb pushtetit, ashtu si dhe ato t\u00eb organeve t\u00eb garancis\u00eb (gjykatat), jan\u00eb rikthyer n\u00eb rend t\u00eb dit\u00ebs, nj\u00ebsoj si n\u00eb vitet fam\u00ebkeqe \u201890.<\/p>\n<p>Pasojat jan\u00eb t\u00eb r\u00ebnd\u00ebsishme. Duke filluar nga pik\u00ebpyetja e madhe se \u00e7\u2019do t\u00eb b\u00ebhet me ne e me k\u00ebt\u00eb vend, me institucionet e nevoj\u00ebn e pap\u00ebrmbushur p\u00ebr ligjshm\u00ebri e drejt\u00ebsi n\u00eb dhjet\u00ebvje\u00e7ar\u00eb ku nd\u00ebrrohen brezat, por mbetet e paprekur esenca perverse e k\u00ebsaj politike kriminale. E duke vijuar me frik\u00ebn se tashm\u00eb \u00e7do thirrje apo pretendim p\u00ebr t\u2019iu apeluar rregullave, sociale e morale, por sidomos ligjore, \u00ebsht\u00eb shnd\u00ebrruar n\u00eb mjetin m\u00eb t\u00eb suksessh\u00ebm t\u00eb delegjitimimit t\u00eb rregullave e ligjeve vet\u00eb, p\u00ebr sa koh\u00eb ligji e Kushtetuta shp\u00ebrfolen n\u00eb goj\u00ebn e pushtetit q\u00eb i shp\u00ebrdoron p\u00ebrdit\u00eb, para syve tan\u00eb. E duke e larguar gjithnj\u00eb e m\u00eb shum\u00eb shpres\u00ebn e shoq\u00ebris\u00eb shqiptare p\u00ebr nj\u00eb instaurim t\u00eb ligjshm\u00ebris\u00eb e t\u00eb drejt\u00ebsis\u00eb thelb\u00ebsore e funksionale.<\/p>\n<p>Artikulimi i ligjit nga goja e pushtetit, sa vjen e p\u00ebrhumb n\u00eb m\u00ebnyr\u00eb perverse, linj\u00ebn dalluese mes shkel\u00ebsit e t\u00eb shkelurit, p\u00ebrgjegj\u00ebsit dhe p\u00ebsuesit t\u00eb paligjshm\u00ebris\u00eb e t\u00eb dhun\u00ebs shum\u00ebdimensionale, sot, nj\u00ebsoj si 20 vjet m\u00eb par\u00eb.<script type=\"text\/javascript\"
