M\u00eb dat\u00eb 4 n\u00ebntor 2013, me an\u00eb t\u00eb dekretit filloi zbatimin ky ligj dhe pun\u00ebn Gjykata Administrative. Gjat\u00eb periudh\u00ebs t\u00eb l\u00ebn\u00eb pezull nga moment i hyrjes n\u00eb fuqi deri n\u00eb momentin kur Gjykata Administrative filloi pun\u00ebn, \u00e7\u00ebshtjet administrative gjykoheshin nga seksioni administrative ne gjykaten civile. Puna e Gjykat\u00ebs Administrative menj\u00ebher\u00eb pasi kishte filluar funksionimin u ndesh me disa problem, t\u00eb cilat \u00e7uan Kolegjet e Bashkuara t\u00eb Gjykat\u00ebs s\u00eb Lart\u00eb t\u00eb dilnin me 2 Vendime Unifikuese, p\u00ebr t\u00eb unifikuar k\u00ebto probleme.<\/p>\n<p><b>1.\u00a0\u00a0\u00a0\u00a0\u00a0 <\/b><b>Cila nga gjykatat do ishte kompetente p\u00ebr t\u00eb gjykuar \u00e7\u00ebshtjet administrative, t\u00eb cilat ishin n\u00eb proces gjykimi n\u00eb gjykat\u00ebn civile n\u00eb momentin kur filloi funksionimin gjykata administrative?<\/b><\/p>\n<p>Ligji p\u00ebr organizimin dhe funksionimin e gjykat\u00ebs administrative ndryshe nga ligjet e tjera nuk kishte parashikuar dispozitat kalimtare t\u00eb cilat t\u00eb rregullonin \u00e7\u00ebshtjet n\u00eb gjykim. P\u00ebr t\u00eb zgjidhur k\u00ebt\u00eb vakum ligjor, Gjykata e Lart\u00eb u shpreh se<a title=\"\" href=\"file:\/\/\/C:\/Users\/Planet.Computers\/Desktop\/Funksionimi%20i%20Gjykates%20Administrative%20dhe%20pasojat%20e%20para%20ne%20praktike.docx#_ftn1\">[1]<\/a>:<\/p>\n<p><i>Gjykatat administrative t\u00eb shkall\u00ebs s\u00eb par\u00eb, Gjykata e Apelit Administrativ dhe Kolegji Administrativ i Gjykat\u00ebs s\u00eb Lart\u00eb, t\u00eb krijuara me ligjin nr.49, dat\u00eb 03.05.2012 \u201cP\u00ebr organizimin dhe funksionimin e gjykatave administrative dhe gjykimin e mosmarr\u00ebveshjeve administrative\u201d, jan\u00eb kompetente p\u00ebr shqyrtimin e t\u00eb gjitha \u00e7\u00ebshtjeve, t\u00eb cilat sipas nenit 7 t\u00eb k\u00ebtij ligji p\u00ebrb\u00ebjn\u00eb mosmarr\u00ebveshje administrative, pavar\u00ebsisht gjendjes, faz\u00ebs apo shkall\u00ebs s\u00eb gjykimit. K\u00ebto gjykata jan\u00eb kompetente p\u00ebr \u00e7\u00ebshtjet administrative p\u00ebr t\u00eb cilat, padia, ankimi ose rekursi \u00ebsht\u00eb depozituar p\u00ebrpara dat\u00ebs 04.11.2013, respektivisht n\u00eb gjykatat e shkall\u00ebs s\u00eb par\u00eb, t\u00eb apelit apo n\u00eb Gjykat\u00eb t\u00eb Lart\u00eb dhe deri n\u00eb k\u00ebt\u00eb dat\u00eb, shqyrtimi n\u00eb k\u00ebto gjykata nuk ka p\u00ebrfunduar akoma<\/i><i>.<\/i><\/p>\n<p>Me an\u00eb t\u00eb k\u00ebtij vendimi Gjykata e Lart\u00eb zgjidhinj\u00eb vakum ligjor, por \u00e7\u00ebshtja q\u00eb ngrihet \u00ebsht\u00eb <i>a ka kompetnc\u00eb Gjykata e Lart\u00eb p\u00ebr t\u00eb krijuar ligj dhe a \u00ebsht\u00eb kushtetues ky vendim?<\/i><\/p>\n<p>P\u00ebr zgjidhjen e kushtetutshm\u00ebris\u00eb s\u00eb vendimit, \u00e7\u00ebshtja \u00ebsht\u00eb d\u00ebrguar n\u00eb Gjykat\u00ebn Kushtetuese, e cila akoma nuk ka dal\u00eb me nj\u00eb vendim.<\/p>\n<p>Vendimi gjithashtu solli reagime n\u00eb rradh\u00ebt e jurist\u00ebve, pasi kishte \u00e7\u00ebshtje t\u00eb cilat ishin n\u00eb faz\u00ebn ku ishte mbyllur shqyrtimi gjyq\u00ebsor dhe pritej shpallja e vendimit dhe n\u00eb baz\u00eb t\u00eb k\u00ebtij vendimi, gjykata \u00ebsht\u00eb e detyruar t\u00eb nxjerr\u00eb \u00e7\u00ebshtjen p\u00ebr inkompetenc\u00eb. Si pasoj\u00eb \u00e7\u00ebshtja do filloj\u00eb gjykimin nga e para.<\/p>\n<p><i>Po n\u00eb rastet kur gjykata ka marr\u00eb vendimin, por ka l\u00ebn\u00eb nj\u00eb dat\u00eb p\u00ebr ta shpallur at\u00eb, a mund t\u00eb gjykoj\u00eb kompetenc\u00ebn kur vendimi tashm\u00eb \u00ebsht\u00eb marr?<\/i><\/p>\n<p>Edhe n\u00eb k\u00ebt\u00eb rast n\u00eb baz\u00eb t\u00eb Vendimit Unifikues gjykata ka deklaruar inkompetenc\u00ebn, duke e d\u00ebrguar \u00e7\u00ebshtjen p\u00ebr gjykim n\u00eb gjykat\u00ebn administrative.<\/p>\n<p>Pavarsisht se n\u00eb dukje Vendimi Unifikues ka zgjidhur nj\u00eb problem, mendoj q\u00eb pasojat n\u00eb praktik\u00eb jan\u00eb shum\u00eb t\u00eb r\u00ebnda, pasi \u00ebsht\u00eb c\u00ebnuar parimi i siguris\u00eb juridike, parimi i vazhdim\u00ebsis\u00eb s\u00eb gjykimit, ku nj\u00eb \u00e7\u00ebshtje duhet t\u00eb niset dhe t\u00eb p\u00ebrfundohet nga e nj\u00ebjta gjykat\u00eb dhe nga i nj\u00ebjti trup gjykues, parimi i ekonomizimit t\u00eb gjykat\u00ebs, parimi i zgjidhjes s\u00eb \u00e7\u00ebshtjes brenda nj\u00eb afati t\u00eb arsyesh\u00ebm etj. Gjithashtu n\u00eb zbatim t\u00eb k\u00ebtij vendimi, gjykatat kan\u00eb nxjerr \u00e7\u00ebshtjet jasht\u00eb kompetence, duke i v\u00ebn\u00eb gjykat\u00ebs administrative nj\u00eb ngarkes\u00eb t\u00eb madhe, pasojat e t\u00eb cil\u00ebs vihen re n\u00eb shkeljen e afateve brenda t\u00eb cilave duhet t\u00eb p\u00ebrfundoj\u00eb nj\u00eb gjykim administrativ.<\/p>\n<p>Nj\u00eb tjet\u00ebr problem q\u00eb \u00ebsht\u00eb hasur ka t\u00eb b\u00ebj\u00eb me shtrirjen e kompetencave t\u00eb Gjykat\u00ebs Administrative. N\u00eb nenin 7 dhe n\u00eb nenin 17 t\u00eb Ligjit q\u00eb rregullon organizimin dhe funksionimin e Gjykat\u00ebs Administrative jan\u00eb parashikuar rastet t\u00eb cilat do t\u00eb gjykohen nga kjo gjykat\u00eb.<\/p>\n<p>Problemi q\u00eb \u00ebsht\u00eb hasur n\u00eb praktik\u00eb ka t\u00eb b\u00ebj\u00eb me rastet kur nj\u00eb \u00e7\u00ebshtje administrative \u00ebsht\u00eb nd\u00ebrrthur me nj\u00eb \u00e7\u00ebshtje civile.<\/p>\n<p><b>2.\u00a0\u00a0\u00a0\u00a0\u00a0 <\/b><b><i>Cila nga gjykatat do t\u00eb jet\u00eb kompetente p\u00ebr ta gjykuar \u00e7\u00ebshtjen Gjykata Civile apo ajo Administrative?<\/i><\/b><\/p>\n<p>P\u00ebr zgjidhjen e k\u00ebsaj \u00e7\u00ebshtjeje Gjykata e Lart\u00eb ka dal\u00eb me nj\u00eb Vendim Unifikues duke u shprehur se<a title=\"\" href=\"file:\/\/\/C:\/Users\/Planet.Computers\/Desktop\/Funksionimi%20i%20Gjykates%20Administrative%20dhe%20pasojat%20e%20para%20ne%20praktike.docx#_ftn2\">[2]<\/a>:<\/p>\n<ul>\n<li><i>Kur n\u00eb objektin e gjykimit ka disa k\u00ebrkime si t\u00eb natyr\u00ebs civile dhe administrative dhe k\u00ebto k\u00ebrkime konstatohen nga gjykata se jan\u00eb nj\u00eb bashkim i thjesht\u00eb i tyre, at\u00ebher\u00eb referuar nenit 61 dhe 159 t\u00eb K.Pr.Civile dhe 13 dhe 23 t\u00eb Ligjit 49\/2012, gjykata duhet t\u00eb ve\u00e7oj\u00eb objektet q\u00eb nuk jan\u00eb n\u00eb kompetenc\u00ebn e saj l\u00ebndore duke ja kaluar ato gjykat\u00ebs kompetente.<\/i><i><\/i><\/li>\n<li><i>Kur n\u00eb objektin e gjykimit ka disa k\u00ebrkime si t\u00eb natyr\u00ebs civile dhe administrative dhe k\u00ebto k\u00ebrkime konstatohet nga gjykata se jan\u00eb nj\u00eb bashkim i nd\u00ebrvarur mes tyre, at\u00ebher\u00eb referuar nenit 55 t\u00eb K.Pr.Civile dhe nenit 24 t\u00eb Ligjit 49\/2012 dhe zbatimit t\u00eb parimit \u201clex specialis derogat generali\u201d, gjykata kompetente \u00ebsht\u00eb si m\u00eb posht\u00eb:<\/i><i><\/i>\n<ul>\n<li><i>kur n\u00eb objektin e gjykimit pala padit\u00ebse, nd\u00ebr t\u00eb tjera, ka p\u00ebr objekt kund\u00ebrshtimin e nj\u00eb akti administrativ dhe nga pasojat e aktit prodhohen pasoja civile, n\u00eb \u00e7do rast kompetente \u00ebsht\u00eb gjykata administrative. <\/i><i><\/i><\/li>\n<li><i>kur nj\u00eb nd\u00ebr objektet e gjykimit \u00ebsht\u00eb nj\u00eb k\u00ebrkim me natyr\u00eb civile, por q\u00eb \u00ebsht\u00eb i lidhur ngusht\u00eb me aktin administrativ dhe pasojat e k\u00ebtij akti kan\u00eb ardhur nga vullneti shtet\u00ebror, at\u00ebher\u00eb p\u00ebrs\u00ebri gjykat\u00eb kompetente \u00ebsht\u00eb gjykata administrative.<\/i><i><\/i><\/li>\n<li><i>kur objektet e tjera t\u00eb padis\u00eb jo t\u00eb natyr\u00ebs s\u00eb mosmarr\u00ebveshjes administrative jan\u00eb t\u00eb nd\u00ebrvarur nga pasojat e aktit administrativ edhe n\u00eb k\u00ebt\u00eb rast kjo t\u00eb \u00e7on tek kompetenca e gjykat\u00ebs administrative. <\/i><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>Gjykata e Lart\u00eb ka arritur n\u00eb k\u00ebt\u00eb p\u00ebrfundim duke u bazuar n\u00eb parimin <i>\u201clex specialis derogat generali\u201d,<\/i><i> <\/i>si dhe<i> <\/i>sipas gjykates ligji p\u00ebr organizimin e gjykat\u00ebs administrative nuk \u00ebsht\u00eb thjesht nj\u00eb ligj material, por dhe nj\u00eb ligj procedurial<i>.<\/i><\/p>\n<p><i><\/i><b>3.\u00a0\u00a0\u00a0\u00a0\u00a0 <\/b><b>Po n\u00eb rastet kur padia ka natyr\u00eb civile dhe kund\u00ebrpadia ka natyr\u00eb administrative, cila do jet\u00eb gjykata q\u00eb do shqyrtoj\u00eb \u00e7\u00ebshtjen?<\/b><\/p>\n<p>Sipas vendimit t\u00eb m\u00ebsip\u00ebrm do ndajm\u00eb dy moment, kur padia dhe kund\u00ebrpadia mund t\u00eb ndahen (fakt q\u00eb bie n\u00eb kund\u00ebrshtim me aspektet proceduriale, pasi kund\u00ebrpadia ngrihet kur ka lidhje me objektin e padis\u00eb ose kur ka mund\u00ebsi kompensimi) n\u00eb k\u00ebt\u00eb rast gjykata civile do jet\u00eb kompetente p\u00ebr gjykimin e padis\u00eb dhe gjykata administrative p\u00ebr gjykimin e kund\u00ebrpadis\u00eb. Nd\u00ebrsa n\u00eb rastet kur dy padit\u00eb nuk mund t\u00eb ndahen gjykata kompetente do jet\u00eb gjykata administrative.<\/p>\n<p>Nuk jam dakort n\u00eb k\u00ebt\u00eb pjes\u00eb me vendimin e Gjykat\u00ebs s\u00eb Lart\u00eb, pasi n\u00eb nenin 55 t\u00eb Kodit t\u00eb Procedur\u00ebs Civile rregullohet n\u00eb m\u00ebnyr\u00eb t\u00eb posa\u00e7me kjo pjese:<\/p>\n<p>\u201c<i>Gjykata q\u00eb gjykon padin\u00eb kryesore \u00ebsht\u00eb kompetente p\u00ebr t\u00eb shqyrtuar edhe k\u00ebrkesat dyt\u00ebsore, kund\u00ebrpadin\u00eb ose nd\u00ebrhyrjen kryesore. N\u00eb k\u00ebt\u00eb rast gjykata merr vendim p\u00ebr bashkimin e tyre n\u00eb nj\u00eb \u00e7\u00ebshtje t\u00eb vetme\u201d<\/i><\/p>\n<p>Duke u bazuar dhe n\u00eb argumentimet e Gjykat\u00ebs s\u00eb Lart\u00eb q\u00eb ligji p\u00ebr funksionimin e gjykat\u00ebs administrative, nuk \u00ebsht\u00eb thjesht nje ligj material por edhe procedurial, n\u00eb k\u00ebt\u00eb rast nuk mund t\u00eb zbatohet parimi <i>\u201clex specialis derogat generali<\/i>\u201d, pasi ky ligj nuk parashikon asnj\u00eb dispozit\u00eb p\u00ebr t\u00eb rregulluar k\u00ebt\u00eb situat\u00eb. N\u00ebse do t\u00eb pranonim t\u00eb kund\u00ebrt\u00ebn do t\u00eb ishim p\u00ebrball nj\u00eb konflikti normash n\u00eb m\u00ebnyr\u00eb \u201cin abstractio\u201d ku nga nj\u00ebra an\u00eb do kishim nj\u00eb norm\u00eb proceduriale e cila e ka rregulluar n\u00eb m\u00ebnyr\u00eb t\u00eb qart\u00eb nj\u00eb situat\u00eb dhe nga ana tjet\u00ebr nj\u00eb interpretim jurispudencial bazuar n\u00eb parime t\u00eb p\u00ebrgjithshme.<\/p>\n<p>Gjithashtu me an\u00eb t\u00eb k\u00ebtij vednimi jan\u00eb v\u00ebn\u00eb n\u00eb diskutim institutet civile, ku q\u00ebnia pal\u00eb e nj\u00eb organi administrativ pasjell q\u00eb kjo \u00e7\u00ebshtje me natyr\u00eb t\u00eb \u201cpast\u00ebr\u201d civile do t\u00eb gjykohet nga gjykata administrative.<\/p>\n<p><b>Nj\u00eb pyetje q\u00eb ngrihet ka t\u00eb b\u00ebj\u00eb n\u00eb rastin kur pal\u00eb t\u00eb paditur p\u00ebr nj\u00eb objekt me natyr\u00eb civile jan\u00eb si institucionet publike ashtu dhe persona fizik apo juridik?<\/b><\/p>\n<p>Gjykatat bazuar n\u00eb Vendimin Unifikues nr.4 kan\u00eb nxjerre \u00e7\u00ebshtjet p\u00ebr inkompetenc\u00eb. K\u00ebto vendime jan\u00eb ankimuar n\u00eb Gjykat\u00ebn e Lart\u00eb, e cila nuk \u00ebsht\u00eb shprehur akoma.<\/p>\n<p>Vendimet Unifikuese n\u00eb dukje i kan\u00eb dh\u00ebn\u00eb zgjidhje nj\u00eb s\u00ebr\u00eb problemeve q\u00eb u ngrit\u00ebn menj\u00ebher\u00eb pasi Gjykata Administrative filloi funksionimin, por n\u00eb praktik\u00eb mendoj\u00eb q\u00eb kjo do t\u00eb krijoj\u00eb probleme, pasi vet\u00eb q\u00ebllimi i ngritjes s\u00eb Gjykat\u00ebs Administrative ishte nj\u00eb zgjidhje e shpejt\u00eb e \u00e7\u00ebshtjeve dhe brenda disa seancave. Nj\u00eb risi q\u00eb solli ligji ishte kalimi i barr\u00ebs s\u00eb prov\u00ebs autoritetit publik. Por me kalimin e t\u00eb gjitha \u00e7\u00ebshtjeve q\u00eb nga natyra mund t\u00eb jen\u00eb civile por p\u00ebrmbajn\u00eb elemente t\u00eb natyr\u00ebs administrative apo kur objekti i padis\u00eb \u00ebsht\u00eb i nd\u00ebrvarur nga pasojat e nj\u00eb akti administrativ do t\u00eb duhet q\u00eb procesi n\u00eb dukje t\u00eb marr\u00eb natyr\u00ebn e nj\u00eb procesi civil, ku barra e prov\u00ebs do jet\u00eb e ndar\u00eb midis padit\u00ebsit dhe t\u00eb paditurit. Kjo p\u00ebrb\u00ebn nj\u00eb problem m\u00eb vete pasi \u00ebsht\u00eb konstatuar nj\u00eb munges\u00eb vullneti e autoriteteve publike p\u00ebr t\u00eb marr\u00eb pjes\u00eb n\u00eb proces.<\/p>\n<p>Ndryshe nga perceptimi q\u00eb me fillimin e funksionimit t\u00eb Gjykat\u00ebs Administrative proceset do zgjidheshin brenda nj\u00eb afati t\u00eb shkurt\u00ebr, n\u00eb fakt \u00ebsht\u00eb konstatuar q\u00eb proceset po zgjasin, kjo si pasoj\u00eb edhe t\u00eb mbingarkes\u00ebs s\u00eb gjykat\u00ebs.<\/p>\n<p>&nbsp;<\/p>\n<p>A.Kurti<\/p>\n<p>&nbsp;<\/p>\n<div><br
