Qendra Res Publica, pasi mori dijeni p\u00ebr projektligjin \u201cP\u00ebr ndihm\u00ebn juridike\u201d dhe me k\u00ebrkes\u00eb t\u00eb Komisionit p\u00ebr \u00c7\u00ebshtjet Ligjore, Administrat\u00ebn Publike dhe t\u00eb Drejtat e Njeriut, parashtroi disa argumenta q\u00eb duhet t\u00eb p\u00ebrfshihen n\u00eb k\u00ebt\u00eb projektligj.<\/p>\n<p>&nbsp;<\/p>\n<p>1. Sipas Qendr\u00ebs Res Publica, n\u00eb rrethin e subjekteve q\u00eb duhet t\u00eb p\u00ebrfitojn\u00eb nga ndihma ekonomike, duhet t\u00eb p\u00ebrfshihen p\u00ebrve\u00e7 shtetasve shqiptar\u00eb me vendbanim n\u00eb territorin e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, shtetasit e huaj q\u00eb e p\u00ebrfitojn\u00eb at\u00eb mbi baz\u00ebn e parimit t\u00eb reciprocitetit dhe personat pa shtet\u00ebsi t\u00eb pajisur me leje q\u00ebndrimi, t\u00eb shtohen edhe\u00a0 \u201cshtetasit e huaj, t\u00eb cil\u00ebt nuk jan\u00eb t\u00eb pajisur me leje q\u00ebndrimi dhe jan\u00eb n\u00eb kushtet e pamund\u00ebsis\u00eb ekonomike\/financiare\u201d.<\/p>\n<p>&nbsp;<\/p>\n<p>2. N\u00eb projektligj parashikohej se mund t\u00eb p\u00ebrfitonin ndihm\u00eb juridike personat q\u00eb kishin t\u00eb ardhura n\u00ebn pag\u00ebn minimale. Vendosja e standartit t\u00eb pag\u00ebs minimale si kusht i vet\u00ebm dhe absolut p\u00ebr t\u00eb p\u00ebrfituar nga ndihma juridike nuk mund t\u00eb q\u00ebndroj\u00eb, pasi ka shum\u00eb familje, t\u00eb cilat ndon\u00ebse mund t\u00eb ken\u00eb nj\u00eb pag\u00eb mbi at\u00eb minimale, t\u00eb ardhurat e tyre mund t\u00eb jet\u00eb t\u00eb pamjaftueshme p\u00ebr t\u00eb p\u00ebrballuar shpenzimet e jetes\u00ebs, pasi mund t\u00eb ket\u00eb shum\u00eb f\u00ebmij\u00eb apo persona t\u00eb paaft\u00eb p\u00ebr t\u00eb siguruar t\u00eb ardhura, mund t\u00eb ket\u00eb probleme sh\u00ebndet\u00ebsore, kurimi i t\u00eb cilave kushton etj, prandaj n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb e ka t\u00eb pamundur t\u00eb paguaj\u00eb shpenzimet gjyq\u00ebsore. Vendosja e k\u00ebtij standarti i privon ato nga p\u00ebrfitimi i ndihm\u00ebs juridike, pavarsisht faktit q\u00eb mund t\u00eb jen\u00eb p\u00ebrpara pamund\u00ebsis\u00eb reale p\u00ebr t\u00eb paguar shpenzimet gjyq\u00ebsore.\u00a0 Qendra Res Publica \u00ebsht\u00eb bazuar edhe n\u00eb vendimin e\u00a0 Gjykat\u00ebs Europiane e t\u00eb Drejtave t\u00eb Njeriut, e cila mban t\u00eb nj\u00ebjtin q\u00ebndrim:<\/p>\n<p>&nbsp;<\/p>\n<p style=\"padding-left: 30px;\"><i> \u201cGjykata konsideroi q\u00eb autoritetet gjyq\u00ebsore nuk kishin arritur t\u00eb siguronin nj\u00eb baraspesh\u00eb t\u00eb duhur nd\u00ebrmjet, n\u00eb nj\u00ebr\u00ebn an\u00eb, interesit t\u00eb Shtetit n\u00eb mbledhjen e taksave gjyq\u00ebsore dhe, n\u00eb an\u00ebn tjet\u00ebr, interesit t\u00eb k\u00ebrkuesit n\u00eb vendikimin e pretendimit t\u00eb tij p\u00ebrmes gjykatave. Pagesa e k\u00ebrkuar ndaj aplikantit me veprimin e tij ishte e tepruar dhe rezultoi n\u00eb pushimin e gjykimit mbi pretendimin e tij duke mos u d\u00ebgjuar nga nj\u00eb gjykat\u00eb, e cila, sipas mendimit t\u00eb Gjykat\u00ebs, ka d\u00ebmtuar thelbin e t\u00eb drejt\u00ebs s\u00eb tij p\u00ebr akses n\u00eb gjykat\u00eb. Si rezultat, Gjykata gjeti se kishte pasur shkelje t\u00eb nenit 6 \u00a7 1.\u201d<\/i><\/p>\n<p>&nbsp;<\/p>\n<p>Nj\u00eb \u00e7\u00ebshtje tjet\u00ebr me interes p\u00ebr k\u00ebt\u00eb tem\u00eb \u00ebsht\u00eb edhe Cibicki kund\u00ebr Polonis\u00eb, aplikimi nr. 20482\/03, aktgjykimi i dat\u00ebs 3 mars 2009. N\u00eb k\u00ebt\u00eb rast gjykata u shpreh:<\/p>\n<p>&nbsp;<\/p>\n<p style=\"padding-left: 30px;\"><i>\u201c32. Gjykata v\u00ebren m\u00eb tej se ankuesi ishte nj\u00eb person i moshuar dhe jeton e pensionit t\u00eb tij t\u00eb pleq\u00ebris\u00eb s\u00eb 700 Zloti. Familja e tij p\u00ebrfshinte gruan e tij t\u00eb papun\u00eb dhe v\u00ebllain e saj me t\u00eb meta, i cili merrte 450 Zloti p\u00ebr shkak t\u00eb invaliditetit. Nga vendimet e gjykatave t\u00eb brendshme konstatohet se autoritetet ishin n\u00eb dijeni t\u00eb gjendjes s\u00eb v\u00ebshtir\u00eb, sidomos t\u00eb aplikantit. Megjithat\u00eb, gjykatat supozuan se aplikanti duhet t\u00eb kishte ruajtur parat\u00eb q\u00eb nga fillimi i procedur\u00ebs n\u00eb 1997 dhe se ai duhej t\u00eb kishte parashikuar se do t\u2019i k\u00ebrkohej t\u00eb paguante taksat gjyq\u00ebsore kur t\u00eb paraqiste padin\u00eb civile. Gjykata v\u00ebren, megjithat\u00eb, se n\u00eb fillim t\u00eb procedur\u00ebs ankuesi u p\u00ebrjashtua nga taksat gjyq\u00ebsore n\u00eb m\u00ebnyr\u00eb t\u00eb plot\u00eb. Meq\u00ebn\u00ebse gjendja e tij financiare nuk \u00ebsht\u00eb p\u00ebrmir\u00ebsuar pas k\u00ebtij momenti, ai mund t\u00eb pres\u00eb me t\u00eb drejt\u00eb se ai do t\u00eb urdh\u00ebrohet p\u00ebr t\u00eb paguar taksat gjyq\u00ebsore n\u00eb fazat e m\u00ebvonshme t\u00eb procedur\u00ebs. P\u00ebr m\u00eb tep\u00ebr, Gjykata \u00e7mon se vler\u00ebsimi i gjykat\u00ebs vendase e gjendjes financiare t\u00eb aplikantit ishte bazuar n\u00eb nj\u00eb llogaritje tep\u00ebr teorike t\u00eb aft\u00ebsis\u00eb s\u00eb tij, p\u00ebr t\u00eb kursyer para nga t\u00eb ardhura shum\u00eb modeste, t\u00eb cilat ndaheshin mes tre personave. Gjat\u00eb procedur\u00ebs \u00ebsht\u00eb v\u00ebn\u00eb re se t\u00eb ardhurat e familjes s\u00eb ankuesit nuk kishin qen\u00eb t\u00eb mjaftueshme p\u00ebr t\u00eb mbuluar jetes\u00ebn, medikamentet, dhe nevojat e tjera themelore. Nuk ka asgj\u00eb element bind\u00ebs q\u00eb autoritetet vendase t\u00eb besonin se ankuesi kishte burime t\u00eb tjera t\u00eb t\u00eb ardhurave ose aseteve. Nd\u00ebrsa \u00ebsht\u00eb e v\u00ebrtet\u00eb q\u00eb aplikanti ishte p\u00ebrjashtuar pjes\u00ebrisht nga taksat gjyq\u00ebsore, gjithsesi shuma e mbetur prej 600 Zloti nuk mund t\u00eb konsiderohet e pap\u00ebrfillshme p\u00ebr k\u00ebrkuesin, pasi ishte pothuajse e barabart\u00eb me t\u00eb ardhurat e tij mujore.\u201d<\/i><\/p>\n<p>&nbsp;<\/p>\n<p>Qendra Res Publica \u00ebsht\u00eb bazuar edhe n\u00eb praktik\u00ebn ton\u00eb, e cila lidhet me padit\u00eb civile t\u00eb ngritura nga familjar\u00ebt e viktimave t\u00eb G\u00ebrdecit dhe 21 janarit. Objekti i padis\u00eb s\u00eb tyre ka nj\u00eb vler\u00eb t\u00eb lart\u00eb sepse b\u00ebhet fjal\u00eb p\u00ebr kompensimin e humbjes s\u00eb jet\u00ebs s\u00eb familjar\u00ebve t\u00eb tyre, dhe nga ana tjet\u00ebr, shuma p\u00ebr t\u2019u paguar \u00ebsht\u00eb n\u00eb mas\u00ebn 1% t\u00eb k\u00ebtij k\u00ebrkimi. N\u00eb pjes\u00ebn d\u00ebrrmuese, tarifa e gjykat\u00ebs varion nga 200.000 lek\u00eb n\u00eb 1.500.000 lek\u00eb p\u00ebr cdo familje, nd\u00ebrkoh\u00eb q\u00eb disa prej tyre jan\u00eb t\u00eb pun\u00ebsuar me paga relativisht t\u00eb ul\u00ebta, prej 20.000 deri 50.000 lek\u00eb n\u00eb muaj. N\u00eb t\u00eb gjith\u00eb rastet, t\u00eb ardhurat e tyre jan\u00eb mbi pag\u00ebn minimale t\u00eb vendosur nga K\u00ebshilli i Ministrave (19.000 lek\u00eb n\u00eb muaj), por n\u00eb rrethanat konkrete ata jan\u00eb objektivisht t\u00eb paaft\u00eb p\u00ebr t\u00eb paguar vler\u00ebn e k\u00ebrkuar nga gjykata. Ndryshimi ligjor q\u00eb paraqet ky projekt-ligj, do t\u2019i vendos\u00eb ata n\u00eb pozicion t\u00eb v\u00ebshtir\u00eb, pasi nuk do t\u2019i klasifikoj\u00eb ata si p\u00ebrfitues.<\/p>\n<p>&nbsp;<\/p>\n<p>P\u00ebrjashtimi nga pagimi i tarif\u00ebs gjyq\u00ebsore pasohet edhe me efekte n\u00eb lidhje me shpenzimet e tjera gjyq\u00ebsore. Sjellim n\u00eb v\u00ebmendjen tuaj nenin 105 t\u00eb Kodit t\u00eb Procedur\u00ebs Civile, n\u00eb t\u00eb cilin parashikohet:<\/p>\n<p>&nbsp;<\/p>\n<p style=\"padding-left: 30px;\"><i>\u201cShpenzimet p\u00ebr d\u00ebshmitar\u00ebt, ekspert\u00ebt dhe p\u00ebr k\u00ebqyrjen e sendeve ose k\u00ebqyrjen n\u00eb vend parapaguhen nga pala q\u00eb i ka k\u00ebrkuar n\u00eb shum\u00ebn q\u00eb ka caktuar gjykata. Por gjykata, duke marr\u00eb parasysh rrethanat e \u00e7\u00ebshtjes dhe gjendjen pasurore t\u00eb pal\u00ebve, mund t\u00eb ngarkoj\u00eb nj\u00ebr\u00ebn ose t\u00eb dyja pal\u00ebt q\u00eb t\u00eb paguajn\u00eb shpenzimet e tyre, pavar\u00ebsisht se kush prej tyre ka k\u00ebrkuar pyetjen e d\u00ebshmitar\u00ebve, kryerjen e ekspertimit ose t\u00eb k\u00ebqyrjes.<\/i><\/p>\n<p style=\"padding-left: 30px;\"><i>Kur nj\u00eb pal\u00eb \u00ebsht\u00eb e detyruar q\u00eb t\u00eb paguaj\u00eb shpenzimet gjyq\u00ebsore dhe nuk i paguan vullnetarisht, gjykata urdh\u00ebron me vendim nxjerrjen e tyre t\u00eb detyrueshme.\u201d<\/i><\/p>\n<p>&nbsp;<\/p>\n<p>Nd\u00ebrkoh\u00eb, paragrafi i par\u00eb i nenit 105\/b i Kodit t\u00eb Procedur\u00ebs Civile, shprehet:<\/p>\n<p>&nbsp;<\/p>\n<p style=\"padding-left: 30px;\"><i>\u201cPersonat q\u00eb, sipas dispozitave p\u00ebr taks\u00ebn mbi aktet, p\u00ebrjashtohen nga pagimi i taks\u00ebs, p\u00ebrjashtohen edhe nga pagimi i shpenzimeve t\u00eb tjera gjyq\u00ebsore. N\u00eb k\u00ebto raste, shpenzimet p\u00ebrballohen nga fondi p\u00ebrkat\u00ebs i parashikuar n\u00eb Buxhetin e Shtetit.\u201d<\/i><\/p>\n<p>&nbsp;<\/p>\n<p>Nga sa m\u00eb sip\u00ebr rezulton se personat q\u00eb do t\u00eb p\u00ebrfitojn\u00eb ndihm\u00ebn juridike n\u00eb form\u00ebn e p\u00ebrjashtimit nga tarifat gjyq\u00ebsore, kan\u00eb t\u00eb drejt\u00eb t\u00eb k\u00ebrkojn\u00eb edhe p\u00ebrjashtimin e detyrimit t\u00eb pagimit t\u00eb shpenzimeve t\u00eb tjera gjyq\u00ebsore, sic jan\u00eb shpenzimet p\u00ebr d\u00ebshmitar\u00ebt, ekspert\u00ebt dhe p\u00ebr kqyrjen e sendeve. Shpesh k\u00ebto shpenzime jan\u00eb t\u00eb larta, sidomos ato t\u00eb ekspert\u00ebve. N\u00eb \u00e7\u00ebshtjet e referuara m\u00eb lart, familjar\u00ebt e viktimave t\u00eb G\u00ebrdecit dhe 21 janarit do t\u00eb duhet t\u00eb p\u00ebrballojn\u00eb vet\u00eb pagesat e ekspert\u00ebve q\u00eb p\u00ebr \u00e7do familje arrijn\u00eb vler\u00ebn e 170.000 deri 200.000 lek\u00eb. N\u00ebse ata nuk do t\u00eb p\u00ebrjashtohen nga k\u00ebto detyrime, pasi jan\u00eb n\u00eb kushte objektive t\u00eb pamund\u00ebsis\u00eb ekonomike, ndaj tyre mund t\u00eb aplikohen dy veprime t\u00eb d\u00ebmshme: (1) pushimi i gjykimit, (2) detyrimin e pagimit forc\u00ebrisht, duke vendosur sht\u00ebpit\u00eb e banimit (p\u00ebr ata q\u00eb disponojn\u00eb nj\u00eb t\u00eb till\u00eb) n\u00eb sekuestro dhe m\u00eb pas n\u00eb shitje me ankand.<\/p>\n<p>&nbsp;<\/p>\n<p>T\u00eb dy skenar\u00ebt jan\u00eb t\u00eb d\u00ebmshm\u00ebm dhe nuk p\u00ebrmbushin standardet e nj\u00eb procesi t\u00eb rregullt ligjor. P\u00ebr k\u00ebto arsye, Qendra Res Publica mban q\u00ebndrimin se duhet t\u00eb rishikohet kriteri i p\u00ebrfitimit t\u00eb ndihm\u00ebs juridike, duke marr\u00eb parasysh realitetin e vendit dhe shembuj t\u00eb mir\u00eb nga bota.<\/p>\n<p>&nbsp;<\/p>\n<p>Duke analizuar situat\u00ebn dhe pasi u bazuam n\u00eb standartet nd\u00ebrkomb\u00ebtare, sugjeruam q\u00eb ndihma juridike n\u00eb lidhje me p\u00ebrjashtimin nga shpenzimet gjyq\u00ebsore t\u00eb p\u00ebrcaktohet n\u00eb p\u00ebrqindje, n\u00eb p\u00ebrputhje me t\u00eb ardhurat e individit, duke marr\u00eb parasysh nivelin e t\u00eb ardhurave, n\u00eb raport me kritere t\u00eb tjera si: kushtet familjare, shpenzimet p\u00ebr personat q\u00eb ka n\u00eb ngarkim, gjendja sociale, sh\u00ebndet\u00ebsore etj, t\u00eb cilat duhet t\u00eb shqyrtohen rast pas rasti nga Komisioni. Nj\u00eb shembull i mire q\u00eb i\u2019u sugjerua, ishte sistemi i ndihm\u00ebs juridike n\u00eb Franc\u00eb, ku shteti ndihmon aplikant\u00ebt duke marr\u00eb pjes\u00eb n\u00eb p\u00ebrballimin e shpenzimeve gjyq\u00ebsore sipas nivelit t\u00eb t\u00eb ardhurave personale, duke konkluduar n\u00eb tabel\u00ebn e m\u00ebposhtme:<\/p>\n<p>&nbsp;<\/p>\n<table border=\"0\" width=\"552\"
