Projektligji shoq\u00ebrohet me nj\u00eb relacion shpjegues, dhe ndaj k\u00ebtyre dy dokumentave shprehim shqet\u00ebsimin ton\u00eb, duke e cil\u00ebsuar si nj\u00eb hap t\u00eb madh mbrapa p\u00ebr lirin\u00eb e shprehjes, t\u00eb rreziksh\u00ebm p\u00ebr demokracin\u00eb, dhe t\u00eb pavend n\u00eb nj\u00eb shoq\u00ebri demokratike. Shprehemi n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb p\u00ebr arsyet e m\u00ebposhtme:<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li><strong>Arsyeja e dh\u00ebn\u00eb nga propozuesi (Kryeministri) \u00ebsht\u00eb e nj\u00eb natyre paternaliste dhe kund\u00ebr frym\u00ebs s\u00eb nenit 10\/2 t\u00eb KEDNJ<\/strong><\/li>\n<\/ol>\n<p>Relacioni shprehet:<\/p>\n<p><em>\u201cP\u00ebshtjellimi, q\u00eb \u201cdenoncime\u201d t\u00eb tilla shpif\u00ebse shkaktojn\u00eb n\u00eb opinionin shoq\u00ebror, \u00ebsht\u00eb i till\u00eb q\u00eb cenon maksimalisht dhe mbi t\u00eb gjitha ndjenj\u00ebn e siguris\u00eb dhe t\u00eb besimit q\u00eb shteti n\u00ebp\u00ebrmjet p\u00ebrfaq\u00ebsueve t\u00eb tij m\u00eb t\u00eb lart\u00eb shtet\u00ebror\u00eb p\u00ebr\u00e7on dhe ka p\u00ebr detyr\u00eb t\u00eb p\u00ebr\u00e7oj\u00eb te qytetar\u00ebt.\u201d<\/em><\/p>\n<p>Kjo arsye \u00ebsht\u00eb shprehje e nj\u00eb qajseje paternaliste, ku Kryeministri merr p\u00ebrsip\u00ebr rolin e garantuesit t\u00eb ndjenj\u00ebs s\u00eb siguris\u00eb q\u00eb duhet t\u00eb p\u00ebrcillet nga shteti te qytetar\u00ebt dhe k\u00ebrkon ta vesh\u00eb k\u00ebt\u00eb qasje me vullnet legjislativ. Aktet ligjore q\u00eb kufizojn\u00eb lirin\u00eb e shprehjes duhet t\u00eb jen\u00eb n\u00eb p\u00ebrputhje me pik\u00ebn 2 t\u00eb nenit 10 t\u00eb Konvent\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut, e cila nuk p\u00ebrmban nj\u00eb referenc\u00eb t\u00eb qart\u00eb se ku t\u00eb mund t\u00eb p\u00ebrfshihet edhe motivi i m\u00ebsip\u00ebrm Kryeministrit, dhe me kusht q\u00eb t\u00eb mos jet\u00eb adresuar ende nga kuadri ligjor aktual.<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"2\">\n<li><strong>Nuk \u00ebsht\u00eb e v\u00ebrtet\u00eb q\u00eb kjo zgjidhje \u00ebsht\u00eb dh\u00ebn\u00eb n\u00eb legjislacionet e vendeve t\u00eb m\u00eb t\u00eb zhvilluara t\u00eb Bashkimit Evropian<\/strong><\/li>\n<\/ol>\n<p>Relacioni shprehet:<\/p>\n<p><em>\u201cPik\u00ebrisht sjellje t\u00eb tilla, nj\u00ebsoj si n\u00eb legjislacionet e vendeve m\u00eb t\u00eb zhvilluara t\u00eb Bashkimit Evropian, si Franc\u00eb, Itali, nuk mund t\u00eb shp\u00ebrfillen, p\u00ebrkundrazi nevojitet t\u00eb sanksionohen qart\u00eb dhe p\u00ebrfundimisht n\u00eb Kodin Penal.\u201d<\/em><\/p>\n<p>S\u00eb pari, duhet t\u00eb v\u00ebm\u00eb n\u00eb dukje se Italia dhe Franca, s\u00eb bashku me Turqin\u00eb, apo Spanj\u00ebn, jan\u00eb vendet m\u00eb t\u00eb kritikuar p\u00ebr k\u00ebt\u00eb aspekt nga K\u00ebshilli i Evrop\u00ebs, OKB dhe OSBE.<\/p>\n<p>S\u00eb dyti, Franca ka pasur d\u00ebnimin me burgim vet\u00ebm p\u00ebr fyerjen e Presidentit (kujtojm\u00eb k\u00ebtu q\u00eb Franca \u00ebsht\u00eb Republik\u00eb gjys\u00ebmpresidenciale). N\u00eb vitin 2013, pasi Gjykata Evropiane p\u00ebr t\u00eb Drejtat e Njeriut n\u00eb c\u00ebshtjen Eon kund\u00ebr Franc\u00ebs (Aplikimi nr. 26118\/10, dat\u00eb 14.06.2013) e cil\u00ebsoi shkelje t\u00eb liris\u00eb s\u00eb shprehjes d\u00ebnimin me burgim t\u00eb Herv\u00e9 Eon, i cili mbante n\u00eb dor\u00eb nj\u00eb pankart\u00eb fyese nga Presidentit Nikola Sarkozi (i pari president francez q\u00eb n\u00eb dekada ka k\u00ebrkuar t\u00eb aplikohet nj\u00eb d\u00ebnim i till\u00eb, pasi Fran\u00e7ois Mitterrand dhe Jacques Chirac nuk e kan\u00eb p\u00ebrdorur kurr\u00eb at\u00eb). Menj\u00ebher\u00eb pas k\u00ebtij vendimi nisi nj\u00eb proces rishikues i Kodit Penal p\u00ebr t\u00eb hequr k\u00ebt\u00eb rudiment. Pas ndryshimit t\u00eb Kodit Penal Francez n\u00eb Korrik 2013, fyerja ndaj zyrtar\u00ebve t\u00eb lart\u00eb mbeti e d\u00ebnueshme me gjob\u00eb, por edhe kjo mas\u00eb \u00ebsht\u00eb kritikuar nga organizmat m\u00eb t\u00eb r\u00ebnd\u00ebsish\u00ebm nd\u00ebrkomb\u00ebtar\u00eb.<\/p>\n<p>S\u00eb treti, Italia e ka hequr d\u00ebnimin me burgim p\u00ebr shpifjen n\u00eb vitin 2014. N\u00eb nj\u00eb artikull t\u00eb p\u00ebrbashk\u00ebt t\u00eb botuar n\u00eb \u201cCorriere della Sera\u201d, m\u00eb 8 qershor 2014, Komisioneri i K\u00ebshillit t\u00eb Evrop\u00ebs p\u00ebr t\u00eb Drejtat e Njeriut, Raportuesi Special i Kombeve t\u00eb Bashkuara p\u00ebr Promovimin dhe Mbrojtjen e t\u00eb Drejt\u00ebs p\u00ebr Lirin\u00eb e Mendimit dhe t\u00eb Shprehjes dhe P\u00ebrfaq\u00ebsuesi i OSBE-s\u00eb p\u00ebr Lirin\u00eb e Medias, duke p\u00ebrsh\u00ebndetur heqjen e d\u00ebnimeve me burgim p\u00ebr shpifje, kritikuan gjithashtu projektligjin italian p\u00ebr shpifjen, p\u00ebr shkak t\u00eb rritjes s\u00eb gjobave monetare t\u00eb d\u00ebnimit. Duke e konsideruar k\u00ebt\u00eb nj\u00eb mund\u00ebsi t\u00eb madhe p\u00ebr Italin\u00eb p\u00ebr t\u00eb riparuar ndjesh\u00ebm kuadrin e vet anakronik ligjor p\u00ebr shpifje, ata i b\u00ebn thirrje Senatit Italian p\u00ebr t\u00eb ndryshuar projektligjin dhe <strong>t\u00eb dekriminalizojn\u00eb plot\u00ebsisht shpifjen<\/strong>.<\/p>\n<p>Pa dashur t\u00eb zgjatemi me nj\u00eb vazhd\u00eb tep\u00ebr e gjat\u00eb vendimesh t\u00eb Gjykat\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut, duket qart\u00eb se standardet m\u00eb t\u00eb larta q\u00eb jan\u00eb t\u00eb p\u00ebrshtatshme p\u00ebr nj\u00eb shoq\u00ebri demokratike nuk gjenden n\u00eb Itali dhe Franc\u00eb.<\/p>\n<p>P\u00ebrdorimi i k\u00ebtyre dy vendeve duket se duket se \u00ebsht\u00eb b\u00ebr\u00eb p\u00ebr q\u00ebllime sugjestionimi p\u00ebr shkak t\u00eb emrit t\u00eb madh q\u00eb k\u00ebto dy shtete p\u00ebrfaq\u00ebsojn\u00eb n\u00eb aren\u00ebn nd\u00ebrkomb\u00ebtare, por e themi me bindje se jan\u00eb dy prej \u201cdeleve t\u00eb zeza\u201d t\u00eb liris\u00eb s\u00eb shprehjes n\u00eb Bashkimin Evropian.<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"3\">\n<li><strong>Sipas standardeve nd\u00ebrkomb\u00ebtare shpifja duhet t\u00eb dekriminalizohet t\u00ebr\u00ebsisht, dhe zyrtar\u00ebt e lart\u00eb nuk mund t\u00eb g\u00ebzojn\u00eb mbrojtje m\u00eb t\u00eb madhe ligjore se shtetasit<\/strong><\/li>\n<\/ol>\n<p>N\u00eb raportin e vitit 2002 mbi lirin\u00eb e medias n\u00eb Shqip\u00ebri, Human Rights \u00cbatch arriti n\u00eb p\u00ebrfundimin se <strong>d\u00ebnimet gjyq\u00ebsore p\u00ebr shpifje bien ndesh me aktet nd\u00ebrkomb\u00ebtare p\u00ebr t\u00eb drejtat e njeriut dhe p\u00ebrb\u00ebjn\u00eb nj\u00eb k\u00ebrc\u00ebnim n\u00eb rritje ndaj liris\u00eb s\u00eb medias dhe debatit publik n\u00eb Shqip\u00ebri.<\/strong> Sipas raportit, padit\u00eb p\u00ebr shpifjen, n\u00eb gjykat\u00ebn penale dhe civile jan\u00eb b\u00ebr\u00eb nj\u00eb arm\u00eb e preferuar e politikan\u00ebve shqiptar\u00eb p\u00ebr t\u00eb parandaluar kritikat dhe raportimet e gazetar\u00ebve. Sot shum\u00eb profesionist\u00eb t\u00eb medias n\u00eb Shqip\u00ebri ngren\u00eb shqet\u00ebsimin se gj\u00ebrat nuk kan\u00eb ndryshuar.<\/p>\n<p>&nbsp;<\/p>\n<p><em>Perspektivat nd\u00ebrkomb\u00ebtare<\/em><\/p>\n<p>Rezoluta 1577 (2007) \u201cDrejt dekriminalizimit t\u00eb shpifjes\u201d, miratuar m\u00eb 4 tetor 2007 nga Asambleja Parlamentare e K\u00ebshillit t\u00eb Evrop\u00ebs (PACE), \u00ebsht\u00eb nj\u00eb nga instrumentet kryesore p\u00ebr vendosjen e standardeve n\u00eb fush\u00ebn e dekriminalizimit t\u00eb shpifjes. N\u00eb k\u00ebt\u00eb rezolut\u00ebn, PACE i b\u00ebri thirrje shteteve an\u00ebtare t\u00eb garantonin t\u00eb mos keqp\u00ebrdorim procedurat penale p\u00ebr shpifje dhe se <strong>duhet t\u00eb shfuqizonin \u00e7do dispozit\u00eb ligjore q\u00eb ofron nj\u00eb mbrojtje t\u00eb privilegjuar p\u00ebr figurat publike<\/strong>. Gjithashtu shteteve i \u00ebsht\u00eb k\u00ebrkuar q\u00eb t\u00eb vendosin kufij t\u00eb arsyesh\u00ebm p\u00ebr d\u00ebmshp\u00ebrblimet, me q\u00ebllim q\u00eb t\u00eb mos rrezikohet pozita e medias. P\u00ebr m\u00eb tep\u00ebr, ligjet duhet t\u00eb japin garancit\u00eb e duhura p\u00ebr ankimimin ndaj atyre d\u00ebmshp\u00ebrblimeve, q\u00eb jan\u00eb n\u00eb shp\u00ebrpjes\u00ebtim me d\u00ebmin e v\u00ebrtet\u00eb moral t\u00eb p\u00ebsuar nga padit\u00ebsi.<\/p>\n<p>Rezoluta e PACE ka sh\u00ebrbyer si burim frym\u00ebzimi p\u00ebr Gjykat\u00ebn Evropiane p\u00ebr t\u00eb Drejtat e Njeriut gjat\u00eb shqyrtimit t\u00eb p\u00ebrputhshm\u00ebris\u00eb s\u00eb d\u00ebnimeve t\u00eb gazetar\u00ebve p\u00ebr shpifje, me nenin 10 t\u00eb Konvent\u00ebs q\u00eb mbron t\u00eb drejt\u00ebn e liris\u00eb s\u00eb shprehjes. <strong>N\u00eb jurisprudenc\u00ebn e k\u00ebsaj gjykate ekziston nj\u00eb trend i fuqish\u00ebm drejt dekriminalizimit t\u00eb plot\u00eb t\u00eb shpifjes<\/strong>. Sipas P\u00ebrfaq\u00ebsuesit t\u00eb OSBE-s\u00eb p\u00ebr Lirin\u00eb e Medias, 15 nga 57 shtetet pjes\u00ebmarr\u00ebse t\u00eb OSBE-s\u00eb kan\u00eb si q\u00ebllim dhe synim shfuqizimin e ligjeve penale p\u00ebr shpifjen <strong>nd\u00ebrsa n\u00eb shtetet e tjera, gjykatat vendase tashm\u00eb i kan\u00eb konstatuar si antikushtetues ligjet penale p\u00ebr shpifjen.<\/strong><\/p>\n<p>Nj\u00eb akt tjet\u00ebr, Rezoluta 1636 (2008) e Asambles\u00eb Parlamentare t\u00eb K\u00ebshillit t\u00eb Evrop\u00ebs, ka miratuar \u201cIndikator\u00ebt e medias n\u00eb demokraci\u201d, duke u shprehur si m\u00eb posht\u00eb:<\/p>\n<p><em>\u201c8.2. Zyrtar\u00ebt e shtetit <strong>nuk duhet<\/strong> t\u00eb g\u00ebzojn\u00eb nj\u00eb nivel m\u00eb t\u00eb lart\u00eb mbrojtjeje ndaj kriticizmit se njer\u00ebzit e zakonsh\u00ebm, si p\u00ebr shembull me an\u00eb t\u00eb ligjeve penale q\u00eb parashikojn\u00eb d\u00ebnime m\u00eb t\u00eb ashpra. Gazetar\u00ebt nuk duhet t\u00eb burgosen, apo mediat t\u00eb mbyllen, p\u00ebr komentet kritike\u201d<\/em><\/p>\n<p><em>\u00a0<\/em><\/p>\n<p><em>Zhvillimet ligjore n\u00eb Shqip\u00ebri \u2013 sa m\u00eb shum\u00eb gj\u00ebrat ndryshojn\u00eb, aq m\u00eb shum\u00eb q\u00ebndrojm\u00eb n\u00eb t\u00eb nj\u00ebjtin vend?<\/em><\/p>\n<p>\u00cbsht\u00eb tep\u00ebr interesante t\u00eb theksohet se reformat e fundit t\u00eb vitit 2012 n\u00eb legjislacionin shqiptar p\u00ebr shpifjen n\u00eb aspektin penal dhe civil, ishin produkt i shtat\u00eb vjet lobimi nga Instituti Shqiptar i Medias dhe Open Society Justice Initiative. Pavar\u00ebsisht se n\u00eb parim k\u00ebto ndryshime ishin pozitive, ndryshimet e ligjit penal n\u00eb ve\u00e7anti nuk mund t\u00eb thuhet se ishin shembull modernizmi. K\u00ebshtu, ligjv\u00ebn\u00ebsi shqiptar vendosi t\u00eb mbaj\u00eb n\u00eb fuqi veprat penale t\u00eb fyerjes dhe hoqi vet\u00ebm d\u00ebnimin me burgim. Nga ana tjet\u00ebr, u vu re q\u00eb u rrit minimumi dhe maksimumi i d\u00ebnimit me gjob\u00eb, ku maksimumi \u00ebsht\u00eb 3 milion\u00eb lek\u00eb t\u00eb reja, dhe d\u00ebnimi regjistrohet n\u00eb d\u00ebshmin\u00eb e penalitetit t\u00eb t\u00eb d\u00ebnuarit.<\/p>\n<p>Nga vendimet e Gjykat\u00ebs Europiane n\u00eb dy raste, parashikohet se kjo do jet\u00eb tendenca q\u00eb k\u00ebto praktika do t\u00eb cil\u00ebsohen n\u00eb kund\u00ebrshtim me nenin 10 t\u00eb Konvent\u00ebs.<\/p>\n<p>K\u00ebshtu n\u00eb c\u00ebshtjen \u201c<em>Kasabova kund\u00ebr Bullgaris\u00eb\u201d<\/em><em>\u00a0<\/em>k\u00ebrkuesja ishte nj\u00eb gazetare e cila shkroi nj\u00eb artikull, ku pretendohej se ekspert\u00ebt p\u00ebr pranimin e f\u00ebmij\u00ebve n\u00eb shkollat profesionale ndiqnin praktika korruptive. Ekspert\u00ebt e akuzuan gazetaren p\u00ebr shpifje. Gjykata penale vendase konstatoi se e akuzuara nuk kishte vepruar n\u00eb p\u00ebrputhje me detyrat e saj si gazetare dhe e shpall\u00ebn fajtore p\u00ebr shpifje ndaj ekspert\u00ebve. Ajo u d\u00ebnua me gjob\u00eb, pagimin e shpenzimeve gjyq\u00ebsore dhe t\u00eb d\u00ebmeve t\u00eb shkaktuara n\u00eb nj\u00eb shum\u00eb totale prej 3797 Euro. Gjykata Evropiane vuri n\u00eb dukje se shuma e p\u00ebrgjithshme e d\u00ebmeve, gjobat dhe shpenzimet e tjera mbi gazetaren ishte e barabart\u00eb me gati 70 fishin e pag\u00ebs minimale mujore n\u00eb Bullgari dhe m\u00eb shum\u00eb se 35 fishin e pag\u00ebs mujore t\u00eb vet\u00eb gazetares. <strong>Gjykata pranoi q\u00eb edhe vet\u00ebm gjoba, n\u00eb shum\u00ebn 1425 Euro, ishte e tepruar<\/strong>.<\/p>\n<p>N\u00eb c\u00ebshtjen \u201c<em>Dlugolecki kund\u00ebr Polonis\u00eb\u201d<\/em>\u00a0gjoba ishte vet\u00ebm 120 Euro, por d\u00ebnimi i gazetarit p\u00ebr fyerje <strong>do t\u00eb regjistrohej n\u00eb d\u00ebshmin\u00eb e tij t\u00eb penalitetit<\/strong>. Pik\u00ebrisht ky fakt \u00e7oi Gjykat\u00ebn Evropiane t\u00eb evidentonte shkelje t\u00eb nenit 10 t\u00eb Konvent\u00ebs. Ky lloj d\u00ebnimi, sipas Gjykat\u00ebs, p\u00ebrb\u00ebnte nj\u00eb lloj censure, e cila do t\u00eb kishte efekt frik\u00ebsues p\u00ebr gazetar\u00ebt n\u00eb p\u00ebrgjith\u00ebsi. P\u00ebr k\u00ebt\u00eb arsye Gjykata Evropiane i akordoi gazetarit 3.000 euro shp\u00ebrblim p\u00ebr d\u00ebmin moral p\u00ebr shkak t\u00eb shqet\u00ebsimit dhe frustrimit q\u00eb ai kishte p\u00ebrjetuar. N\u00eb nj\u00eb rast tjet\u00ebr t\u00eb m\u00ebparsh\u00ebm, gazetarit iu akordua 5000 euro shp\u00ebrblim p\u00ebr d\u00ebmin moral <strong>vet\u00ebm p\u00ebr arsye se d\u00ebnimi i tij penal me gjob\u00eb ishte regjistruar n\u00eb d\u00ebshmin\u00eb e penalitetit<\/strong>.<\/p>\n<p>E th\u00ebn\u00eb thjesht, rastet e m\u00ebsip\u00ebrme sugjerojn\u00eb se, edhe n\u00eb qoft\u00eb se nj\u00eb gazetar shqiptar i paguar me nj\u00eb pag\u00eb modeste, ndon\u00ebse mund t\u00eb d\u00ebnohet me nj\u00eb gjob\u00eb simbolike (q\u00eb gj\u00eb as kjo nuk po ndodh sepse d\u00ebnimet n\u00eb Shqip\u00ebri kan\u00eb qen\u00eb t\u00eb larta), vet\u00eb fakti i regjistrimit t\u00eb d\u00ebnimit n\u00eb d\u00ebshmin\u00eb e penalitetit, do t\u00eb jet\u00eb i mjaftuesh\u00ebm p\u00ebr t\u00eb shkelur nenin 10 t\u00eb Konvent\u00ebs Europiane p\u00ebr t\u00eb Drejtat e Njeriut.<\/p>\n<p>Kujtojm\u00eb k\u00ebtu q\u00eb d\u00ebnimi me burgim n\u00eb dispozit\u00ebn e propozuar \u00ebsht\u00eb i pap\u00ebrshtatshm\u00eb, tep\u00ebr i lart\u00eb, dhe detyrimisht i sh\u00ebnuesh\u00ebm n\u00eb d\u00ebshmin\u00eb e penalitetit. Nuk ka asnj\u00eb shanc q\u00eb Gjykata Evropiane t\u00eb mos e cil\u00ebsoj\u00eb shkelje cdo d\u00ebnim n\u00eb baz\u00eb t\u00eb k\u00ebtij neni, n\u00ebse ai miratohet.<\/p>\n<p>Duke iu rikthyer kritik\u00ebs s\u00eb b\u00ebr\u00eb nga K\u00ebshilli i Evrop\u00ebs, OKB dhe OSBE ndaj ligjv\u00ebn\u00ebsve italian\u00eb, mesazhi i dh\u00ebn\u00eb n\u00eb adres\u00eb t\u00eb tij, i cili kishte gabuar nj\u00eblloj sic i k\u00ebrkohet sot ligjv\u00ebn\u00ebsit shqiptar t\u00eb gaboj\u00eb duke mos dekriminalizuar plot\u00ebsisht shpifjen dhe madje duke e r\u00ebndur m\u00eb shum\u00eb situat\u00ebn (duke i ngjar\u00eb m\u00eb shum\u00eb Turqis\u00eb), ishte edhe p\u00ebr ata pak shtete q\u00eb mund t\u00eb ken\u00eb mbetur ende me ligje dhe mend\u00ebsi anakronike.<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"4\">\n<li><strong>Nuk \u00ebsht\u00eb e v\u00ebrtet\u00eb q\u00eb po tentohet t\u00eb rikthehet ligji sic ishte p\u00ebrpara vitit 2012. Ai po tentohet p\u00ebrkeq\u00ebsohet ndjesh\u00ebm<\/strong><\/li>\n<\/ol>\n<p>Neni 240 i Kodit Penal, p\u00ebrpara se t\u00eb shfuqizohej n\u00eb vitin 2012, shprehej:<\/p>\n<p><em>\u201cShpifja e q\u00ebllimshme q\u00eb i b\u00ebhet punonj\u00ebsit q\u00eb kryen nj\u00eb detyr\u00eb shtet\u00ebrore apo nj\u00eb sh\u00ebrbim publik p\u00ebr shkak t\u00eb veprimtaris\u00eb s\u00eb tij shtet\u00ebrore ose t\u00eb sh\u00ebrbimit, p\u00ebrb\u00ebn kund\u00ebrvajtje penale dhe d\u00ebnohet me gjob\u00eb ose me burgim gjer n\u00eb nj\u00eb vit.<\/em><\/p>\n<p><em>Po kjo vep\u00ebr, kur kryhet bot\u00ebrisht ose n\u00eb d\u00ebm t\u00eb disa personave ose m\u00eb shum\u00eb se nj\u00eb her\u00eb, d\u00ebnohet me gjob\u00eb ose me burgim gjer n\u00eb dy vjet.\u201d<\/em><\/p>\n<p>Dispozita e propozuar ka k\u00ebt\u00eb p\u00ebrmbajtje:<\/p>\n<p><em>\u201cShpifja e kryer bot\u00ebrisht ndaj nj\u00eb funksionari t\u00eb lart\u00eb shtet\u00ebror apo t\u00eb zgjedhur, me q\u00ebllim atribuimin atij t\u00eb nj\u00eb fakti q\u00eb parashikohet nga ligji si vep\u00ebr penale, d\u00ebnohet me gjob\u00eb ose me burgim deri n\u00eb tre vjet.\u201d<\/em><\/p>\n<p>Dallimet p\u00ebrkeq\u00ebsuese jan\u00eb:<\/p>\n<ol>\n<li>D\u00ebnimi maksimal \u00ebsht\u00eb rritur nga 2 vjet n\u00eb 3 vjet.<\/li>\n<li>Nga kundravajtje penale \u00ebsht\u00eb shnd\u00ebrruar n\u00eb krim.<\/li>\n<li>P\u00ebrs\u00ebrit\u00ebsit vuajn\u00eb pasoja m\u00eb t\u00eb r\u00ebnda p\u00ebr shkak t\u00eb konsiderimit \u201ckrim\u201d.<\/li>\n<li>Rritja e k\u00ebtij maksimumi d\u00ebnimi dhe klasifikimi i vepr\u00ebs si krim legjitimon arrestimin n\u00eb flagranc\u00eb.<\/li>\n<li>Teknika legjislative e p\u00ebrdorur krijon hap\u00ebsir\u00eb p\u00ebr ekuivok. Atribuimi i nj\u00eb fakti q\u00eb p\u00ebrb\u00ebn vep\u00ebr penale ka lidhje me an\u00ebn objektive m\u00eb shum\u00eb se me an\u00ebn subjektive, duke i l\u00ebn\u00eb gjykat\u00ebs t\u00eb kuptoj\u00eb se duhet d\u00ebnuar penalisht edhe nj\u00eb gazetar i cili e kryer krimin nga pakujdesia por q\u00eb i atribuon zyrtarit t\u00eb lart\u00eb nj\u00eb fakt q\u00eb p\u00ebrb\u00ebn vep\u00ebr penale, pavar\u00ebsisht se gazetari nuk ka synuar shpifjen e q\u00ebllimshme, por zbulimin e nj\u00eb skandali p\u00ebr interes t\u00eb publikut dhe ka keqinterpretuar rrethanat gabimisht.<\/li>\n<li>Teknika legjislative e p\u00ebrdorur zgjeron pa t\u00eb drejt\u00eb fush\u00ebn e veprimit t\u00eb dispozit\u00ebs. P\u00ebpara vitit 2012 shpifja duhej t\u00eb kryhej p\u00ebr shkak t\u00eb veprimtaris\u00eb shtet\u00ebrore, nd\u00ebrsa me dispozit\u00ebn e re shpifja mjafton q\u00eb t\u00eb kryhet ndaj zyrtarit, pavar\u00ebsisht se mund t\u00eb mos ket\u00eb lidhje me veprimtarin\u00eb shtet\u00ebrore. M\u00eb thjesht, do t\u00eb konsiderohet objekt i k\u00ebsaj vepre penale jo vet\u00ebm kur publikohen fakte t\u00eb rreme p\u00ebr afera korruptive, por edhe fakte nga jeta private e zyrtarit, si p\u00ebr shembull konsumon kokain\u00eb, q\u00eb nuk lidhet me detyr\u00ebn shtet\u00ebrore p\u00ebrkat\u00ebse.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<ol start=\"5\">\n<li><strong>Ky projektligj nuk ka respektuar detyrimet e ligjit nr. 146\/2014 \u201cP\u00ebr njoftimin dhe konsultimin publik\u201d<\/strong><\/li>\n<\/ol>\n<p>Q\u00eb prej muajit Maj 2015 ka hyr\u00eb n\u00eb fuqi ligji nr. 146\/2014 \u201cP\u00ebr njoftimin dhe konsultimin publik\u201d. Ky ligj detyron hartuesit, n\u00eb rastin konkret Kryeministrin\u00eb, q\u00eb t\u00eb niste nj\u00eb proces njoftimi dhe konsultimi publik p\u00ebrpara se t\u00eb merrte form\u00ebn finale p\u00ebr t\u2019iu d\u00ebrguar Kuvendit. N\u00eb dijenin\u00eb ton\u00eb dhe t\u00eb gjith\u00eb spektrit t\u00eb gazetar\u00ebve dhe shoq\u00ebris\u00eb civile, drafti nuk \u00ebsht\u00eb publikuar askund dhe nuk \u00ebsht\u00eb konsultuar me ask\u00ebnd.<\/p>\n<p>Sa m\u00eb sip\u00ebr \u00ebsht\u00eb nj\u00eb shkelje e r\u00ebnd\u00eb e nj\u00eb prej standardeve positive t\u00eb k\u00ebsaj legjislature, e cila n\u00eb muajin N\u00ebntor 2014 miratoi nj\u00eb prej risive tep\u00ebr positive sic ishte ligji nr. 146\/2014. Mungesa e konsultimit publik ka detyruar shoq\u00ebrin\u00eb civile dhe gazetar\u00ebt q\u00eb t\u00eb reagojn\u00eb n\u00eb kushte t\u00eb pap\u00ebrshtatshme, jasht\u00eb tryezave zyrtare dhe n\u00eb nj\u00eb koh\u00eb tep\u00ebr t\u00eb pavolitshme, duke sjell\u00eb pak\u00ebsimin e fuqis\u00eb argumentuese kund\u00ebr k\u00ebtij projektligji, me impakt tep\u00ebr t\u00eb r\u00ebnd\u00ebsish\u00ebm n\u00eb demokraci.<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"6\">\n<li><strong>Konkluzione<\/strong><\/li>\n<\/ol>\n<p>Ky projektligj p\u00ebrfaq\u00ebson nj\u00eb standard t\u00eb p\u00ebrkeq\u00ebsuar dhe regresi i t\u00eb drejtave n\u00eb k\u00ebt\u00eb rast \u00ebsht\u00eb edhe nj\u00eb shkelje tjet\u00ebr e t\u00eb drejtave t\u00eb njeriut, p\u00ebrvec sa p\u00ebrmend\u00ebm m\u00eb lart. \u00a0Mentaliteti q\u00eb ka sh\u00ebrbyer si baz\u00eb p\u00ebr k\u00ebt\u00eb nism\u00eb \u00ebsht\u00eb duke u tejkaluar kudo n\u00eb Evrop\u00eb sot, sepse \u00ebsht\u00eb kund\u00ebr nevojave t\u00eb nj\u00eb shoq\u00ebrie demokratike.<\/p>\n<p>N\u00ebse, n\u00eb ndryshim nga propozuesi, mazhoranca qeveris\u00ebse sot nuk ka problem me mend\u00ebsin\u00eb, at\u00ebher\u00eb nuk i mbetet shum\u00eb pun\u00eb p\u00ebr t\u2019i kthyer propozuesit nj\u00eb p\u00ebrgjigje korrekte me vot\u00ebn kundra, n\u00eb sh\u00ebrbim t\u00eb
