{"id":891,"date":"2016-02-29T20:09:25","date_gmt":"2016-02-29T19:09:25","guid":{"rendered":"http:\/\/www.respublica.org.al\/?p=891"},"modified":"2016-03-29T19:06:06","modified_gmt":"2016-03-29T17:06:06","slug":"deklarate-per-shtyp","status":"publish","type":"post","link":"https:\/\/www.respublica.org.al\/web\/?p=891","title":{"rendered":"Gjykata Kushtetuese: Tashm\u00eb gjykatat mund t\u00eb pezullojn\u00eb vendimet p\u00ebr prishjen e objekteve pa leje"},"content":{"rendered":"<p><a href=\"http:\/\/www.respublica.org.al\/wp-content\/uploads\/2016\/02\/Inuk-ne-dajt.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignleft wp-image-892 size-medium\" src=\"http:\/\/www.respublica.org.al\/wp-content\/uploads\/2016\/02\/Inuk-ne-dajt-300x170.jpg\" alt=\"Inuk-ne-dajt\" width=\"300\" height=\"170\" srcset=\"https:\/\/www.respublica.org.al\/web\/wp-content\/uploads\/2016\/02\/Inuk-ne-dajt-300x170.jpg 300w, https:\/\/www.respublica.org.al\/web\/wp-content\/uploads\/2016\/02\/Inuk-ne-dajt-800x454.jpg 800w, https:\/\/www.respublica.org.al\/web\/wp-content\/uploads\/2016\/02\/Inuk-ne-dajt.jpg 922w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a>Gjykata Kushtetuese m\u00eb 29 Shkurt 2016 ka marr\u00eb nj\u00eb vendim n\u00eb lidhje me ankes\u00ebn kushtetuese t\u00eb ngritur nga Avokati i Popullit kund\u00ebr nenit 14 t\u00eb ligjit nr. 9780 dat\u00eb 16.07.2007 \u201cP\u00ebr inspektimin e nd\u00ebrtimit\u201d, i cili mohonte t\u00eb drejt\u00ebn e gjykatave q\u00eb t\u00eb pezullonin vendimet p\u00ebr prishjen e objekteve pa leje.\u00a0Ky nen u ndryshua n\u00eb muajin dhjetor 2014. \u00c7\u00ebshtja u mbrojt nga Avokati i Popullit, i cili bashk\u00ebpunoi me qendr\u00ebn Res Publica, e mb\u00ebshtetur nga Civil Rights Defenders.<\/p>\n<p>Gjykata Kushtetuese, n\u00eb <a href=\"http:\/\/www.gjk.gov.al\/include_php\/previewdoc.php?id_kerkesa_vendimi=2076&amp;nr_vendim=1\">Vendimin nr. 10, dat\u00eb 29.02.2016<\/a>, solli disa risi tep\u00ebr t\u00eb r\u00ebnd\u00ebsishme p\u00ebr grupet vulnerab\u00ebl, pasi njohu t\u00eb drejt\u00ebn e pezullimit t\u00eb akteve t\u00eb Inspektoriatit Komb\u00ebtar t\u00eb Mbrojtjes s\u00eb Territorit (IKMT) nga gjykatat, p\u00ebrpara se t\u00eb kryhet prishja e objekteve t\u00eb kundraligjsh\u00ebm.<\/p>\n<p>Sipas Gjykat\u00ebs Kushtetuese, gjykatat e shkall\u00ebs s\u00eb par\u00eb nuk kan\u00eb asnj\u00eb penges\u00eb ligjore q\u00eb t\u00eb vendosin pezullimin e akteve t\u00eb IKMT, kur pala e interesuar e k\u00ebrkon at\u00eb. Gjykata Kushtetuese i hapi rrug\u00ebn gjykatave t\u00eb zakonshme t\u00eb b\u00ebjn\u00eb pezullimin e akteve t\u00eb IKMT n\u00eb cdo rast kur prej tyre rrezikohet ardhja e nj\u00eb d\u00ebmi t\u00eb r\u00ebnd\u00eb e t\u00eb pariparuesh\u00ebm. N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb, arsyetimi i Gjykat\u00ebs Kushtetuese legjitimoi anashkalimin e penges\u00ebs absurde t\u00eb vendosur n\u00eb fund t\u00eb vitit 2014 q\u00eb p\u00ebrcaktonte se aktet e IKMT nuk mund t\u00eb pezulloheshin nga gjykatat. Ky ligj nuk u shfuqizua, por tashm\u00eb do t\u00eb lexohet ndryshe nga m\u00ebnyra si donte ta lexonte dhe zbatonte Qeveria.<\/p>\n<p>Vendimi i Gjykat\u00ebs Kushtetuese \u00ebsht\u00eb nj\u00eb p\u00ebrgjigje e merituar ndaj qendrimit t\u00eb Qeveris\u00eb, e cila k\u00ebrkoi q\u00eb t\u00eb mos njihej e drejta e pezullimit t\u00eb akteve t\u00eb IKMT nga gjykatat e zakonshme, me iden\u00eb q\u00eb kush cenohet nga prishja e objekteve u mjafton d\u00ebmshp\u00ebrblimi, pavar\u00ebsisht se dihet q\u00eb kjo k\u00ebrkon nj\u00eb pritje disa vje\u00e7are. Kjo \u00ebsht\u00eb e papranueshme dhe Gjykata Kushtetuese u tregua e qart\u00eb q\u00eb gjykatave t\u00eb zakonshme nuk mund t\u2019i hiqet e drejta p\u00ebr t\u00eb pezulluar aktet administrative. Kjo \u00ebsht\u00eb nj\u00eb prerogativ\u00eb e pushtetit gjyq\u00ebsor q\u00eb mbrohet nga Kushtetuta.<\/p>\n<p>R\u00ebnd\u00ebsi paraqer edhe mendimi i pakic\u00ebs, i gjyqtarit kushtetues Z. Vladimir Kristo, i cili ngriti shqet\u00ebsimin e arsyesh\u00ebm q\u00eb procedura e pezullimit t\u00eb vendimeve t\u00eb IKMT nga gjykata mund t\u00eb k\u00ebrkoj\u00eb koh\u00eb. P\u00ebr rrjedhoj\u00eb, ka premisa reale q\u00eb IKMT t\u00eb nd\u00ebrmarr\u00eb veprime arbitrare duke nd\u00ebrhyr\u00eb me shpejt\u00ebsi n\u00eb ekzekutimin e menj\u00ebhersh\u00ebm t\u00eb vendimeve, duke shmangur gjykat\u00ebn ose, e th\u00ebn\u00eb ndryshe, duke i mohuar de facto t\u00eb drejt\u00ebn e ankimit efektiv individit. Sipas gjyqtarit Kristo, ligjv\u00ebn\u00ebsi, pavar\u00ebsisht situat\u00ebs shqet\u00ebsuese t\u00eb nd\u00ebrtimeve n\u00eb territorin e Shqip\u00ebris\u00eb, duhet t\u00eb tregoj\u00eb vet\u00ebp\u00ebrmbajtje.<\/p>\n<p>N\u00eb p\u00ebrfundim, qendra Res Publica, falenderon Avokatin e Popullit p\u00ebr sip\u00ebrmarrjen e k\u00ebsaj c\u00ebshtjeje t\u00eb v\u00ebshtir\u00eb dhe strategjike, dhe shpreh besimin se m\u00eb n\u00eb fund \u00ebsht\u00eb hapur nj\u00eb dritare juridike q\u00eb vendimet e IKMT do t\u00eb mund t\u00eb pezullohen nga gjykatat, ashtu sic ndodh n\u00eb cdo vend demokratik. Tashm\u00eb duhet t\u00eb pasurohet\u00a0praktika gjyq\u00ebsore, duke inkurajuar qytetar\u00ebt q\u00eb preken nga vendimet e prishjes s\u00eb objekteve q\u00eb t\u00eb k\u00ebrkojn\u00eb sipas\u00a0rastit pezullimin e vendimeve deri sa gjykatat t\u00eb shprehen me vendim p\u00ebrfundimtar.<\/p>\n<p>Qendra Res Publica i b\u00ebn thirrje IKMT-s\u00eb q\u00eb t\u00eb tregoj\u00eb vet\u00ebp\u00ebrmbajtje dhe t\u00eb mos veproj\u00eb menj\u00ebher\u00eb me prishjen e objekteve, por t\u00eb l\u00ebr\u00eb gjykatat t\u00eb thon\u00eb fjal\u00ebn e tyre. N\u00eb cdo rast IKMT ka afat deri 30 dit\u00eb p\u00ebr prishjen e objekteve dhe ky afat \u00ebsht\u00eb i mjaftuesh\u00ebm q\u00eb t\u00eb pritet me qet\u00ebsi vendimi i gjykat\u00ebs p\u00ebr pezullimin ose jo t\u00eb prishjes s\u00eb objektit (gj\u00eb q\u00eb n\u00eb praktik\u00eb zgjat jo m\u00eb shum\u00eb se 7 \u2013 8 dit\u00eb).<\/p>\n<p>Ne e dim\u00eb q\u00eb fadromat jan\u00eb mjete m\u00eb t\u00eb shpejt\u00eb se gjykatat, por n\u00eb nj\u00eb shoq\u00ebri demokratike gara mes shtetit dhe individit b\u00ebhet p\u00ebrmes p\u00ebrplasjes s\u00eb argumentave p\u00ebrpara gjykat\u00ebs dhe jo p\u00ebrmes p\u00ebrplasjes s\u00eb pabarabart\u00eb t\u00eb individit t\u00eb thjesht\u00eb p\u00ebrkundrejt supremacis\u00eb motorike e policore t\u00eb shtetit.<\/p>\n<p>Qendra
